EB1C Texas, I140 approved on Nov 15th. I see cases move to NBC after a few days of I140 approval and then to local office for interview. No updates on my case since 140 approval. Any idea if this is a normal process? Anyone on the same boat? Any clue when to expect NBC transfer and interview? Thanks.

I am on H1b,working in USA. I have approved advance parole. I am not sure why I must be living in USA when I can just go to the local office for the interview. If I were living and working outside USA in situation where I could not come to USa for interview, I would understand I choose consular processing. I think I can simply just go for AOS interview. Not 100% sure though if it matters. I havent come across my kind of situation on any of the forums so far.

Hi,

I have my EB1 I485 pending approval. I am an Indian citizen living in Canada as I have Canada PR and working in USA. I commute 5 days a week to USA for work. I read the forums that during AOS interview, officers ask for US address proof, US drivers license. I understand for AOS interview, the office will be in USA which I can attend. I do have a usps PO box for mail correspondence in USA.

My doubt is - Am I supposed to be living in USA while I485 is pendng or is it ok to be liging outside of USA. Please advice. Thanks.

TSC used to be the fastest processing center. No progress on EB1 March I-140 applications. All March application sent to Texas remain in the same status. No significant approval numbers. Any clue why Texas center is so slow all of a sudden.

I think it's a wise strategy. Saves a lot of time. Only loss is $200-$300, rest all is gain but I don't think you will get an RFE to do medical again. You may get one for Gonnorhea test if not included with the previous medical though. Good luck!!

Medical exam is valid for one year from the date its first done. The one year time restart from when it is received by uscis. In your case, it will be valid until 12/11/2017 (It would have been the same expiry date even if you did your medical on 12/12/2015).

Thanks for sharing your experience. Can you also tell about the documents you were required to take with you and if the officer asked/saw any of those documents like passport, birth certificate, tax statements etc.

Retrogression happened coz there are a limited no. of Eb1 GCs for an year (Oct to Sep) and there was no quota left for processing any more GCs in EB1. From this week, count started from 0 for the new quota.

Are you sure your lawyer said that. There is nothing called porting I140 for EB1. Porting works for EB2, EB3 but not in case of EB1. How can a immigration lawyer not know that.
