Topic: H4 EAD Revocation rule

(PS. I know DHS announced agenda to rescind the rule, but that doesn't mean they have to do it.)

Quite possible that sometimes DHS might announce a rule & then either not come up with anything or drag its' feet on the rule. But that will not be possible in this case in view of the fact that Save Jobs USA has gone to court against this. Only thing is Save Jobs is challenging the Authority of DHS to issue such EADs, & DHS is trying to remove H4 EAD while at the same time trying to retain its' powers to issue EADS.

just provide what is asked in RFE and all is fine if legal
Agree completely. If your qualifications, & experience fit the bill, & your job is in a specialty occupation, with a genuine Company, & you are getting the salary you deserve for that occupation, then why worry ?

urgently need advice
my H4 EAD going to expire on 30th DEC 2017 - i have filed renewal on 20th Nov and received Received EAC receipt number wondering if i can still work once EAD expire . is there any grace period or Interim EAD can be requested ? until i get my approved EAD ?

somehow i was under impression that once your spouse H1B visa extension get approved it should quick renewal for EAD - but doesn;t seems to be - wondering what is options i have it ? should i talk to my employer if they can still allow me to work on without payroll ?

since i have approved Receipt does that allow me to keep my employment with out pay ? or do i have to take time off ?
but not sure what i can do in this ?

Whether with or without pay, You can be an employee only with a valid EAD. If you do not get your approval by the 30th of Dec, you will have to stop working till you get the approval.
Not a good idea in the current environment to go in for renewals at the last minute. Everything is taking much longer than before.

Topic: Called as a witness in court while I 485 pending...

Someone hit my car last year who was evading a police, whom they caught later.At that time, police took my information and now I got a letter from the court that I have to be present in the court as a witness and I have to appear the court on day to day basis unless discharged by court. The big question is will it effect my pending I-485?? Its really stressful. Any advice is appreciated...

You are a witness & not the accused so why should it affect your GC process ? Ensure that you do a good job as a witness by honestly narrating what you saw.

My EB2-I I-140 with priority date of 2016 is approved 6+ months so-
1- Does that mean I can keep on extending/transferring my H1B to unlimited time?
Yes, you can keep on doing so.
2- As my company can not revoke I-140 should I hurry to file new perm with new company or I should keep quite to couple of years for new GC/Perm? I know I can not use same I-140 to file I-485 with new employer.
I would prefer to be in a state of readiness by ensuring that my approved I140 is always with my current employer. Who knows, laws could change anytime & a miracle could always happen.
3- Can I extend/transfer my H1b from India also? Do old H1B petition should be active when you transfer you H1B?
You will always need to have a valid H1B in order to extend or transfer it. Are you planning to be in India for long term ? In which case you will be able to recapture time spent outside India. But indefinite extensions may not be possible if you do not have U S pay stubs as supporting documentation.

H4 ead is nowhere to go. Recent politico article suggests that a bunch of restrictions are coming for new and existing h1bs.
Trump administration is very much aware that h1b loophole is the major reason for all abuse and mess. If they are able to trim h1bs, h4 ead will be automatically restricted. After so many rants on DACA, trump administration didn't not touch on DACA.
And only 97000 h4 eads are given till now which is very less for them to take any action.
Completely agree with you. H1Bs will be filtered out. Tighter policies will ensure that genuinely needed H1Bs will remain. This will result in jobs for the Citizens. Consequently H4EAD will continue, since the impact on the job market will be minimal.

I have an offer from employer B (non IT American) and approved i140 for more than 1 year with my current employer A (non IT). I know for sure that employer A will withdraw my i140 as soon as I move to employer B. I wasn't sure whether the new rule would apply and allow me to extend H1B. Especially given there is no premium processing these days.

I140 approved > 180 days cannot be revoked by Employer. Only USCIS can do so if it was obtained fraudulently.

I dont blame US or USCIS for this mess. It was bound to happen. I just blame the consulting companies who practice their business in pathetic way and bring all sort of cheap labor here. Those are the guys whom I blame.

I have a feeling, soon in 8-9 years the entire H1B will be scrapped. These consulting companies will win and we might have to go back home.
Can't agree more. No way we can blame anyone except those who misused the visa system. DOL will definitely scrutinize to see if there are enough US citizens/ GC holders to fill existing open positions / positions currently held by H1 visa holders & if there are then deny certifications for extensions or PERMs. Only time will tell if the economy is hurt due to this. But that will be a long cycle.

I was told no by Netflix because they did not want to wait for regular H1b processing and hence they were looking for GC/USC and wanted me to start on receipt which I said no to. So indirectly yes, this is my personal experience.
Sorry to hear. Wonder what will be our plight at the time of extending our H1 visas. DOL / USCIS can give a real hard time. Also wonder if PP will be restored anytime in future.

I am seeing a trend where WITCHes are hiring only GC/Citizens within USA. Most of the emails folks are getting from them require candidates to be GC or Citizen. Does anyone know what percentage of the WITCHes employed in USA are GC holders or US Citizens?

A clear indicator will be the # of H1B applications received on the 3rd April. Let us see if it goes into a lottery.

Topic: Trump action on H-1B coming next week

We have learnt from reliable sources that trump is going to sign a bill next week. basically it will make very hard to get H1, L1 etc.

There is no bill on his desk as yet. Considering we are nearing the date (3rd April) for filings for the next fiscal year & no announcement regarding any changes, it is very doubtful if we will see any changes in the near future.
In a way they have already made it difficult for new filings by suspending premium processing.

Agree. Trying for an EAD citing compelling circumstances would be a good option. Possibly the loss of job may not be considered compelling, but loss of job combined with risk of a flight, & possibility monetary hardship could all add up to form compelling circumstances. Make use of a lawyer.

Above mentioned is changed with Jan/17/2017 published rule. Everyone have one time 60 days grace period during job change on H1b.

As long as any employer is not running pay check under your SSN while not having approved H1B (or any other legal status) , you are not accruing any period of illegal time of stay however you are out of status as soon as you lost your job. (there is difference.. you see!!). You need to make sure to reinstate your status within 60 days(avoiding accruing any illegal stay in USA)

if your employer have not actively cancelled your I-140, you should be just fine as after Jan/17/2017; employers can not cancel I-140 that have been matured 180 days or more.

Rule became effective 01/17. OP is laid off in Dec. Does the new rule apply to him / her ?

An H-1B nonimmigrant is admitted to be employed by the sponsoring H-1B petitioner. If the employment ends, this condition is no longer satisfied and the individual is no longer in a lawful nonimmigrant status and may be subject to removal proceedings. Therefore, the terminated H-1B nonimmigrant in this scenario may not be able to port to another employer, subject to certain discretionary exceptions.

Depending on the individual's circumstances, the H-1B worker may be eligible to remain in the United States due to a request for a change of status or for extension of stay that is filed while that individual is maintaining H-1B status, or on account a pending adjustment application. In deciding whether to approve a change or extension of status for any nonimmigrant who has fallen out of status, however, USCIS may exercise discretion on a case-by-case basis to grant the extension or change of status despite the failure to maintain status.

There is no automatic 10-day or other grace period for terminated employees holding H-1B status, so once the individual is no longer in a lawful nonimmigrant status, he/she usually must depart from the United States.

Let us wait n watch. Being in the news is not important. What is important is can it be reversed easily ? Is there sufficient evidence to substantiate the fact that h4 ead holders have taken away jobs of US citizens ? What about the fees that were collected by USCIS to issue the EADs ?
Again can it be end abruptly ? For e.g. My wife started a business has created jobs & currently has transactions in different phases of negotiation. Once the negotiation is complete she will have to execute the transaction or else pay a huge compensation. Who will take care of this ? She also has receivables in her books. Who will take responsibility for this ?
In my opinion end of H4 EAD, if at all will be time consuming & not a sudden death scenario.
