That is just internal criterion. The USCIS criterion on top of this internal criterion should also be satisfied. The USCIS criterion is 5 years in one company before joining CTS or MS degree from USA...

Yes, the wage requirement is there but if you are getting into SA for 3 years...that will not be an issue...

Yes. from what you explaiend you case is a category for EB3. For EB2 the criterion I mentioned above #1 and #2 both MUST be satisfied..

Yes, please read some of the old posts..CTS has declared in various sessions that they do upgrade from Eb3 to Eb2. Criterion #1 is the mandatory criterion from USCIS. Criterion #2 is developed by CTS.

But there is one good thing...if you satisfy #1 above and if you stick with CTS for 3 yeras in the SA role they do upgrade your case from Eb3 to Eb2...

That is not right...I have MS from US but still they filed my case in EB3. There are two critertion for EB2

1. You should have MS from US (or 5 years of experience from previous employer..continious experience..no breaks)

AND

2. You should be employed with CTS (USA) for 3 Years if your role is SA or you should be Manager

if you satisfy both conditions then you get into EB2...

Most of the people dont have #1 above and hence it becomes very easy for GIT to knock lots of cases into EB3.

I spoke to a highly credible source in GIT and said that DOL is really short on staff. That is the reason why they are putting all the cases in the Audit so they can take few more months to clear the labor. It is purely political. The standard madate is that DOL needs to clear the PERM in 60 days, if they can not they will be questioned by their superiors. To evade this situation and since they are understaffed they just put the labor in audit queue. So instead of 60 days they can take 120 days or little more to respond at their leisure. THis is the election year. So many things are changing and it is very dynamic envrionement right now. If you got into audit just dont worry...take a deep breath and enjoy your life...thigs will get settled down in few months...

Got response from GIT "We have received an Audit notice from the DOL for your PERM application. This requires us to submit employer based documentary proof to the DOL. The Audit is a standard employer based query that DOL issues randomly at a 50% nationwide rate. It can take over 2 years for your case to be adjudicated by DOL once an audit is received"

What is the new guideline to qualify for EB2? We all know USCIS guideline for EB2...US Master's or 5 years of experience prior to joining CTS...Is there a salary requirement too?

I do not mind saying my salary but how will you be able to answer my question by knowing my salary? You think that if they hired someone at lower salary then even though the person qualifies EB2 because he was hired at lower salary they will push his/her case in EB3?

I was hired within US only. If i stay with CTS for 3 years can I automatically satisfy 3 year Global requirement? Because US hires can never satify 3 Year global requirement.

I am hearing that CTS has redesigned their EB2 policy. Again I assume its case by case basis though. The new policy for Eb2 is as follows:
1. M or Above OR
2. Sr. Associate with 3 years of Global experience and 1 year of US experience

AND

3. US Master's Degree (or 5 Years of experience before joining cognizant)

So to qualify for EB2 you need either 1 or 2 AND 3.

is this true?
