Thanks Tampa! I can do that but would it be advisable to use our own gold cover sheet?
I hope this gold cover sheet is just for mail-room sorting purpose.

Topic: EB3 to EB2 Porters ONLY Thread - Lets Track any updates !

Hi Tampa,

Today, I got medical reports from CS and this time it's clean. Now I am planning to send it by today or tomorrow.
I have a quick question on Gold cover sheet that I didn't receive with RFE but received an envelope which has left border in RED color. As I did not receive Gold cover sheet, do I need to use this envelope?? I am thinking it must be some kind of color coding for mailing room at USCIS. As suggested am planning to use a big envelope bcoz uscis envelope is way too small to accommodate medical report and rfe letters.

I just wanted to ensure my RFE response reaches to right officer without any delays. Any thoughts?

Thanks for your valuable input Tampa!
Yes, I am using latest I-693 (Top: OMB No. 1615-0033 / bottom: 03/30/15 N) form and will review the filled form thoroughly with all attached reports before replying to RFE.

Quick question, the envelope which I received with RFE is very small and it's in white color (left edge Red color) and it will not accommodate medical report, RFE & cover letter. Can I use any other large envelope instead of USCIS one?

I will send the RFE response to below given address on USCIS envelope-

Topic: EB3 to EB2 Porters ONLY Thread - Lets Track any updates !

Hi Tampa,

Here is an update on my Wife's Medical RFE: (1st time Medicals were submitted during I-485 filing in Nov-2015 but received RFE within 6 month)

As I mentioned earlier, X-ray report was normal but there was an error on report which states Clinical Indication as Positive tuberculosis instead of Positive PPD and this could be the reason for RFE.
Now, after many follow-ups with Radiology lab we received the corrected Addendum X Ray report stating "There is no history of positive tuberculosis and the clinical indication should be read as Positive PPD"

Today, we visited same surgeon for medicals and requested for fresh medicals. However my surgeon is not recommending for new TST within 6 months instead she is going to refer the earlier results which are still valid.
Because, she mentioned 1st TST was +ve then 2nd will be the same result. Also, she is suggesting to go for IGRA test.

So my question is, will it be a good idea to go for IGRA instead of new X Ray? Here, we can also send the corrected X- Ray report with a note from surgeon. Second, shall I insist for 2nd TST or go for earlier one?

As always appreciate you suggestions / feedback.

Here is the exact RFE details:

You must submit a Form I-693, Report of Medical examination and vaccination record. The form I-693 must be completed by a designated civil surgeon who will conduct your medical examination and administer any necessary vaccines. The civil surgeon must record the results of your medical examination and your vaccination history as provided in the instructions to the Form I-693.

Tuberculosis screening requirement:

The civil surgeon must indicate the results of a tuberculin skin test (TST) or an Interferon Gamma Release Assay (IGRA) on Form I-693 for any applicant who is two years ofrom age or older. A Form I-693 without TST or IGRA results is not acceptable. Additionally, a chest x-ray alone, without the required TST or IGRA results, is not sufficient. TST or IGRA may be waived only if medically contraindicated.

So if you see the RFE details, it seems they are looking for new medical report. What is your opinion on this RFE?

Thanks for quick response Tampa!
It seems there is an error on Xray report from Radiology lab as per our Surgeon and they are doing follow-up to correct it. I will keep you posted on this.

Now my surgeon is saying, once they received the correct report from x-ray lab then they will write a letter to USCIS with existing Medical reports and give us in closed envelope.Would it be advisable to go with existing medical report with correction bcoz it is still valid or go for a new one.

What do you suggest ? As always thanks in advance for your valuable suggestions.

Hi Tampa,

Yesterday, I received the physical copy of RFE for my wife's I-485 and SR response for my I-485 case.
The RFE is about I-693 (medicals & vaccination) for my Wife's case with details like TB screening requirement. As I mentioned earlier, we filed our I-485 in Nov 2015 and within 6 months, they issued medicals RFE. Is this normal? I checked with our surgeon for any incomplete report or section submitted on I-693 but everything looks normal. What could be the reason or Is this an error from USCIS ? I am planning to schedule medicals but don't want to repeat if there are any shortcomings in earlier report.

I received SR (Incorrect classification) response in letter stating, "Your file has been requested and will be reviewed by a supervisor. You should receive a decision or notice of other action within 30 days". For this document, they changed my case status to as Card / Document Production

Thanks Tampa ! I will wait for RFE details and keep you posted.

My PD was current in Nov 2015 as per filing date chart. Effective December 2015 bulletin onwards, USCIS retrogressed the Filing Date and then become allowed only signle - Final Date chart for filing.

Topic: EB3 to EB2 Porters ONLY Thread - Lets Track any updates !

Hi Tampa,

Today, I received text /email alert for my Wife's I-485 case and online status shows as - Request for Additional Evidence Was Mailed however my (primary) I-485 case shows - Document Was Mailed. Also, I received email alerts where my Wife's case status shows as RFE but my case status shows as Card / Document production.

1. As my PD is not current yet, I am assuming because they issued an RFE for my Wife's case and that's the reason my case status shows as - Document Was Mailed. But still I don't understand why I see status as - Card / Document production in email alert. Is this a system glitch or normally status change like this?
2. What could be the reason for RFE in my wife's case ? I don't think it will be Medical or EVL because we filed our case in Nov 2015.

As suggested, I sent an email to EBUPDATE.NSC@uscis.dhs.gov to correct preference classification in last week but no response yet. Also there is an SR open for this issue. Atleast, I can conclude my case is processing under EB-2.

Appreciate if you have any comments / suggestion in this situation.

Hi TampaCoolie,

Here is my case details. Any suggestions would be highly appreciated.

Priority Date: 28 Jan 2009 (PD ported from EB3 to EB2)
Filing Date: 24 Nov 2015
USCIS Received Date: 25 Nov 2015
First Fingerprint Date: 13 Jan 2016
EAD /AP Approval Date:14 Jan 2016

When I received I-485 receipts, I noticed that the old PD - 28 Jan 2009 is reflecting on I-485 receipt but category still showing as - Employment Based 3rd instead of EB2. Immediately I reported this typographical error by calling 1-800# and raised a SR. I received the below response:

"Only the officer reviewing your case can make the corrections that you have requested. We have forwarded your concerns to your file and they will be reviewed by the officer at the time of adjudication. No correction made at this time."

As there was no correction in 1st SR, I booked infopass and visited the local USCIS field office to correct my case. But response I got is, they can't make any correction as they don't have my file with them. So, they raised another SR. Now, I am waiting for the response to my 2nd SR.

I just want to know, if there are any other options that I need to look at.

Thanks!
