Topic: H1B stamping in Bahamas or Canada or Mexico or Jamaica

All,

I currently work for a very large American MNC. My current I797 is with them and till Sep 2017. My current visa, which is from a previous employer is expiring in Nov 2015. However, I want to get the new stamping for my current employer before it expires as I have an India trip planned in Jan 2016.

I contacted our company's immigration team and they told me that they recommend in home country (India). But I want to explore options close by, as I don't want to make a trip to India right now. My company's immigration team has no issues with me getting these on my own (fill out my DS 160 and get the checklist items ready for the interview).

Which of these countries is the best option and recommended: Bahamas or Canada or Mexico or Jamaica?

Any help is greatly appreciated!

Topic: PERM application for CTS (Cognizant) employees

How does CTS compare to Deloitte in terms of GC filing? I am a current Cognizant employee and in the midst of an offer negotiation with Deloitte. Very reluctant to join, because I've stories about Deloitte being horrible in the GC regard. My 6 years end in Aug 2017. Any thoughts/inputs will help a lot.

Topic: Vacation abroad on H1b with new employer without stamping

Hi all,

My wife and I planning a vacation to one of the caribbean countries in August. I moved to a new employer B in March 2014. My I797A with the new employer is valid till March 2015. I have a valid visa from my previous employer till Nov 2015; when I underwent the stamping in India last year.

Now, is it safe/easy to re-enter with the new approved I797A from my current employer and a valid stamp from my previous employer? Please, any advice is very helpful.

Thanks.

Topic: Vacation abroad

Hi all,

My wife and I are planning a vacation in August to one of the Caribbean islands. I have a valid visa till Nov 2015 with my previous employer A. I have a valid I797A with my current employer B, valid till March 2015. My wife is on H4 dependent visa.

Now, is it allowed/safe to travel abroad and come back to US without undergoing the stamping for my current employer from India? Please advice.

Thanks.

Topic: Cognizant employee. Deloitte offer

Thank you very much. All the reponses have been very informative and I am more or less convinced of staying back.

I have been in Management Consulting before when I was with PwC and EY and know exactly about the work stress, travel and crazy performance reviews (which usually have no rational basis).

That said, more than the brand name, my worry is about the GC/PERM. I hear horror stories about CTS but the same goes for Deloitte I guess. Thanks all!

Topic: Cognizant employee. Deloitte offer

Hi,

I am a current employee of CTS. I am in conversation with Deloitte and most likely will get an offer from them. Now, I am in a dilemma regarding the GC processing pros and cons of both companies.

My six years end in Aug 2017. I have been told by my Cognizant mgr that he will approve my gc processing this may. Now, I understand that that will not affect the GIT's timeframe in anyway and they will only apply as and when they seem fit. My max out date as calculated from the GIT doc is Apr 2016. Is there any possibility that my PERM will at least be filed with USCIS this year? What category? I am a US masters with 4 years experience, with 3 being outside CTS.

Now, coming to Deloitte. I understand they have a much better rep and brand value for advisory consulting. But, I am told by them that they will only wait for a year, evaluate my performance and then apply for GC. Any ideas/suggestions on what category they file in usually? Do they come through on the GC promise or just say it verbally at the time of interviewing and it never happens?

Basically, my dilemma is: stay with CTS and hope PERM gets applied this year and everything goes smoothly without audit etc or roll the dice and join Deloitte not knowing what to expect in terms of a timeline for GC etc.

Any advice will very helpful. Thank you all!

Topic: Re-joining Cognizant for PERM

Pretty much....Like I said I have a US masters and have been with big consulting companies (all america). I think I will join and roll the dice.

I am in a dilemma, for sure. Stemming from a couple of reasons: my current job is extremely stressful with a work-life balance of zero. The GC potential is there...might not be as dicey as in CTS...

But with CTS, how can you say it is 100% audit. I find that hard to believe! Let's say they do file in whatever period...I can still hope mine will get approved without audit. That CTS thread here is 150 pages (max of let's say 500 employees) who posted...Doesn't prove anything. There are thousands more in the US...I appreciate your inputs/thoughts.

Topic: Re-joining Cognizant for PERM

Thanks Karthik

I just had a conversation with a HR from CTS. About the GC issue, he said I will have to speak with my practice (group) and that they can promise me something in writing. Since he explicitly said that, I think I should be able to negotiate? The manager I am speaking with said that a new slot for CTS EB2 filings is opening up in June. Can I ask them to have me filed in it? Since I am ex-CTS and have about a year from my previous stint, can I ask them if that stint will count?

Like I said earlier, pay is the only driver for me. Work and culture wise, I know what to expect and I not too worried about that. And yes, GC is very important.

Venvidio,

Thanks. Is it normal for them give something in writing before joining on PERM filing? I ask this, because you mentioned about something being "off". As in, the immigration said this but why are they not promising. I mean are there any cases where they do promise this in the offer letter?

Thanks!

Hi Malabar,

Thanks for your post.

A few developments since my last post: The team is willing to pay the negotiated salary, now the managers have come back saying that they cannot promise anything but the immigration told them that I do "qualify" for EB2, since I have a MS from US.

What exactly do you mean by "they are trying a strategy on me". The pay CTS is offering is very good, so it is a big incentive for me to move. Again, I am in 2 minds and need your advice. I am not sure what benefit it is to them by not applying for my PERM soon. Thanks!

Thanks guys!

The manager I am talking to said he will try to get together a deal with immigration for my filing in EB2. However, going by the impression here, it seems that it will defiinitely get audited. So assuming they file as soon as I join, I am looking at a an average of 1-1.5 years for my PERM and I140 to get completed and come to me?

Topic: Re-joining Cognizant for PERM

Hi all,

I quit Cognizant last year to join another company. Now, I got a few calls from my team at CTS that want me to rejoin. My H1B maxout date is Nov 2017. I have a few questions on this:

1) I am trying to negotiate something with them before I join. I have been verbally told by my managers that they will file in EB2 in early 2015. Should I request for something in writing? I have heard several stories here about how CTS delays till the last moment (approaching maxout date) and then it doesn't come through and people have to go to India. I assume this may not be the case for everyone?
2) Audit: I have heard CTS filing is a sure random Audit. Is that true?
3) What is the typical timeframe for PERM and I140 to be completed and come to you with CTS?

Any help will be greatly appreciated. Thanks!
