Topic: Online MS degree

Are such degrees valid to get an opt?
Assuming if some is on H4/H4-EAD, can they get do an online degree and then once they finish the course get an OPT as well?

Topic: IV Call today Dec 17th

Though I have been skeptical with IV and chances for 392 to be passed in current immigration environment - fortunately or unfortunately most of their predictions have turned out to be true.Their logic for AC21 to be cancelled is valid. Leon fresco was part of the call, he was part of obama administration.
I listened to the week-end call today evening - their discussions seems to be rationale.

Topic: H4 EAD Revocation rule

Dude - Corporate lobbying not to help their employees but to continue extension of slavery, so that employees are stuck with them. If they need to revoke ac21 it has to be passed by Congress- where everything is lobbied.

Topic: H4 EAD Revocation rule

Numbers impacted by AC21 are way higher. Corporate lobbying (employees stuck with them) /(lawyers make money from extensions) - they will not let AC21 go away.

Unnecessary rumors - administration can make it more tough for us to live by making life tougher on H1 and issue RFE's but cannot remove a law without Congress.

No chance of HR392 moving forward in current immigration mindset.

Topic: H4 EAD Revocation rule

I will be really surprised if they cancel existing H4 EAD's, if they do so - they will unnecessarily open avenues for lawsuits.
Too many rumors going on based on the draft proposal - however, it is going to be tough to land a job on H4 EAD with additional fear mongering.

Again - I may be wrong, my best guess is within a year - H4EAD will be gone (extending/issuing new H4 EAD's) , this admin has done away with every single rule and has tightened legal immigration. However - if anyone has an upcoming extension due, best bet is do in premium and have the validity extended before they stop processing.

Topic: H4 EAD Lawsuit

From the wording of the proposed rule it appears that even existing EAD’s will be canceled, for previous such rules (like DACA) they atleast did not cancel the validity of the existing EAD. Thoughts please?

I have my I40 approved in 2013, planning to take a break and be in india for few years - If I decide to come back to US, will I have to apply a new H1 under the lottery?

Thoughts please.

Topic: EB1 C (Porting Question)

Yes - there is risk in every move we take. Tired of being in the country for more than 11 years without a LPR.
As long as we have a 140, we should be good with extensions - this is not being impacted. I really doubt if any comprehensive immigration law will be passed, worst case if nothing works out will return to homeland.

Topic: H1B Visa Stamping in India

It has been a while since I had my H1 stamped, planning to go to India by end of the year to get my visa stamped.
Can someone please provide the steps to be followed:

- How early do I need to book my stamping dates (planning for an interview in Chennai in December)
- List of forms to be completed
- Do I need to go on two different dates (one for finger printing and other for stamping ?)
