What's IV's take on HR 392 not included in either the Senate version or Goodlatte's version of DACA fix bill yesterday ?

I was quite optimistic for something to be included in Goodlatte's version, but was disappointed. The extra visas that he added are not enough (in my opinion), and are useful only when USCIS applies spillover properly, or the EB1C crisis finishes.

Thoughts ?

At this rate, deal looks difficult. Lets see how they negotiate. It would have been good if HR392 was at least on the table for discussions, but looks like might not be the case.

How much better is 18340 cards ? Only a small proportion is for India. It all boils down to the spillover, which does not happen :-(

Nope - read the bill statement : It was 9940 and its still 9940. Only spillover possibility is what we get - not sure how helpful that will be. Can some expert comment ?

Not sure how is this good news (?)
140K -> 195K is good but only if proper spillover is done (its NOT done as of now)
9940 = 7 % of 140K. So effectively it was made 7 % -> 5.09 % ??

Not good. Spillover is at the discretion of DOS/USCIS/whoever. Its well known that spillover is not done as it should be - visas are wasted anyway right now. What stops them from wasting more visas.

Just too many - If EB3 is 70 years backlogged, EB2 is also at least 20-30 years backlogged. 45 % increase does not mean much at all.

Interesting that he is conscious of the problems legals face.
But he does hint to just increasing the number allocated to EB - just increasing number by 30-40 % does not help much at all.

Topic: EB1-B My Experience: Unique case against all odds


No She wasnt an entrepreneur. The EB1 A was company sponsored.

Her current job title is Director for Scientific Services and she heads a team of 12- 15 employees with a min Phd Requirements in Science field.

But when the company originally applied for her EB1 A she was only Scientific Director for the company. At that time she was handling 1-2 million dollar accounts.
She was originally on H1B. In her 5th year the company applied for O1 and got approved. Then we filed the same O1 application for EB1 A without any change or additional evidence and got approved in Premium process.


She qualified under these following criteria:(Both O1 and EB1A)
1. Earned extensive recognition from top experts for her original and significant contributions;
2. Been selected to serve in key capacities for distinguished companies within the industry;
3. Commanded and continues to command a high salary; and
4. She has authored scholarly articles in the field in professional journals.( 3 publications- Original contributions)

All of the above criteria were approved. we didn't show any citations # for the fourth since her role does not need her to do any medical research. But her clients are from Cancer and other major disease space.


Hope this clarifies and gives u some insight.



Thanks! Thats interesting and helpful. Is this a big company ? Was she managing people when she applied for EB1A ? I am guessing she is a Phd too ?
