I think everyone should hold their horses. Don't go by what's on the paper. As of today, for this proposal to go all the way it is close to impossible. Its all politics. Remember how things fell apart between Durbin and the President in the recent meeting about that "sh*t h*le" comment? That is a big deal. Any compromise between Dems and Reps on this is a far fetch at this time.

There are a lot of things in this bill which make it a non-starter. 25 billion for the wall and eliminating diversity and changing who in family can be sponsored is a big deal for Dems. Its not going to be so easy.

We should stop counting chickens before they hatch. There are hardly 2 months left before everyone on the hill gets busy with the 2018 election. So... keep that in mind before you dream about anything.

Also think about the possibility of what happens to DACA if no bill is passed? Nothing will happen immediately since the federal court has temporarily halted whatever WH wanted to do and the DACA renewals have resumed. So nothing pressing now to pass DACA immediately.

Agree completely. I think we should hold our horses and not jump to conclusions. All that is going to get traction is DACA + some Misc issues. It is no way going to be a major immigration reform as some are talking here. And if what IV says comes true then removing country limits will tag along this bill along with that $1000 per GC provision they keep talking about. Because somehow the contents should be linked to DACA. Not good or bad.. but setting ourselves some realistic expectation may be important here

Topic: USCIS is finally gonna put a STOP to EB1 Fruad

For what its worth, I don't see anything wrong with OP feeling encouraged about the article. With this administration, things always start subtle especially without any legislation to bring about a real change. Even for H1s and H1 extensions, it all started in the same simple manner where they just said "all extensions will also be treated like fresh applications". It sounds so simple but the actual result is that people who never got any RFEs in the last 10+ years are getting them now for no apparent reason. And even the denials increased.

So I will not be surprised if this is that tipping point where they just re-floated the same that was before just to clamp down in the coming days.

There is more to it than that. From my understanding.... they are waiting on some other sure shot bill that will go from house to Senate. So essentially this bill does not stand a chance on its own. Even if it immediately comes to vote and passes house, it will fail miserably in Senate or will just wait in limbo in Senate.

So the plan seems to be... adding this to another bill that will have to pass for sure in house. Since it has good number of co-sponsors. it will anyways have least objections when combined with another bigger bill in the house and then move to senate as part of that bigger bill. That is really the only chance for this bill.. if there is one.. So do not expect this bill to come on to the floor on its own. For now its just wait and watch.

One thing is for sure. Time is running out. Chances of anything to pass in 2018 is very very less. So all this increase in co-sponsors etc is just an eye wash and nothing else. This bill needs lots of luck and timing to succeed from here on.

As explained on the USCIS site... any fresh H1s and all H1 extensions where there is some kind of a material change like employer or work location etc they will still go to the location based on employer's primary location.

Only the extensions where there was absolutely no change from the previous one will go to Nebrasks no matter where in US the employer or the employee is..

Looks like effective Nov 10 the filing location has been changed from based on employee's location to based on employer's physical location. Not sure the implications of the change but it goes into effect from Nov 10

Well if and when this bill comes on to the floor, it will not be on its own. It will be a part of bigger bill. In that situation, having so many co sponsors will make sure there is not much debate or resistance against this part of that bigger bill from anyone. Hopefully it will all be as easy as it looks... LOL

Any bill that wants to be retroactive explicitly says so. Like for example when we had the country limit elimination bill, it had clearly mentioned from when it would be implemented.

If nothing is currently in the bill, then by default is is NOT retroactive. This bill might have a date going forward, if ever it comes up for discussion. At this time, this bill is just half ass, half baked one without much thought put into it. And it is only sane to say that, even if we have to take some action or do something on our part, it is not yet time.

Remember that the WH and Congress badly wanted a Comprehensive Immigration Reform (Gang of 8) during Obama's time. Nothing much happened. Same with this WH and the Obamacare. They wanted so badly. But it fell flat.

Sweeping legislation like this won't see day light so easily. And this Merit based is both Overhauling and controversial introduced with pure anti-immigrant intentions. So as it is, its a nonstarter. If this were to progress, we will have enough time to talk all logistics and details.

For one I think that this would apply only for fresh applicants and not the ones already in line. But its too early to talk about such detail as of now...

I understand the concern. I am not trying to be negative here at all. You have to understand that no matter how much WH wants this, it cannot move an inch without Congress acting on it. The only time it stands a chance is between now and Nov 2018. Come House and senate elections, at least one is going to become democrat majority and that's the end of legislation like this one.

Also everything you speak about age is a big assumption. You are suggesting people to reach out practically to Cotton and other congress members who are very anti immigrant to explain about a minor issue in a proposed bill purely based on an assumption. What if the people currently in line with approved I140s are not even part of this proposal (there is more than a very good chance of that being true)?

If you followed Sessions' statement on DACA yesterday and Sessions in general from last 10 years, you can clearly understand that there is no logic, no reasoning, no compassion. You try to "sensitize" people who are sensible. Here its pure hatred and opposition with no reasoning. I don't know what kind of compassion and understanding you are expecting by taking this path.

The best thing we can do for now, is wait until there is more clarity, if and when this bill even comes up for discussion.... until then its waste of time and energy. We will be just losing peace of mind by overthinking this....

With all due respect, we may be barking the wrong tree here. Cotton is known to be a perfect replacement for Sessions. We all know what that means. Senator Cotton would care a rats ass about the problems we are talking about on this thread. They just want to stop immigration completely if possible.

I think we might actually be doing harm to ourselves by trying to right lengthy messages to Cotton about the status quo.

My personal opinion is that we are overthinking this whole merit based proposal. It is a non-starter and needs to undergo a lot of changes even before it comes on for discussion.

Its absolutely unnecessary but some have already hit the panic button... on this half ass, half baked proposal.

If your subject line refers to the remaining Trump's term... then wait just another 1 year. Come 2018 Oct/Nov, in the worst case at least one of house or senate will be democrat. There is a good chance both house and senate will be democrat. That's enough for a cliff hanger and nothing else will come out of congress for the remaining 2 years.

If any good were to happen from congress' side, we are running out of time very, very fast!!

Agreed. RAISE Act has absolutely zero probability of advancing. Its a non-starter whether DACA or no DACA.
