Wrong. If PERM is pending approval for 365 days, you can get H1B extension. So in this case, since they filed his PERM late by 35 days, he just has to catch up on those many days by going outside of the country. GIT can then file the H1 extn once it is 365 days from PD(June 2012). Overall it might take 2 months to actually get the visa. I-140 approval is the next stage which can be done only when PERM is approved. All this is an issue only when PERM is in audit.

The only option is to work outside US(India/Canada etc) for 35 days and catch up on the 365 pending days.

I meant that the Canadian option can be used if your PERM is NOT filed before 365 days of max out and you need to catch up.
If PERM is filed before 365 days, no issues on the extension.

Is your max out Nov 2013? If yes, you don't have any other option. GIT will not file a GC unless they are in a filing cycle(no matter who you are and what your max out date is). So there is no question of Canadian work permit here. That works if your GC is filed and you need to catch up on the 365 days of pending PERM approval from the PD.

That is correct. You can extend H1 even from India/Canada afrter 6 years via consular processing since the PERM is already applied.

There is no conversion here since EB1 doesn't have PERM phase. Irrespective of the status of your EB2/EB3 application, they will file EB1 for you if you are eligible. Many people have already gone back to India and are waiting to complete the 1 year to become eligible for EB1. Note: Just being in India for 1 yr doesn't qualify you for EB1, you need to have x(unknown) number of direct/indirect reportees.

Yes, that's correct. Make sure you keep yourself updated with the changing criteria of EB1. Last I heard, GIT was 're-designing' the PERM process.

Well, no management can guarantee a comeback after 1 year!!
As long as you have a project, it should be okay. No, thats not a fresh H1(meaning doesn't go to the cap bucket).

1) Yes, you can. Infact many have and this is the best option to get GC quickly.
2) Yes, CTS does and I know of guys who have got it. You don't even have to be a manager. You should lead a team(they don't specify the strength of the team even if you ask). It does include indirect reportees too.
3) Not personal but I have friends who have got it.

Ofcourse it IS triggered with intervention in CTS. You also have to pay something like $300 and only then they initiate I-140 for you.

You cannot. CTS doesn't entertain such queries, people have tried a lot. Going to Canada for atleast a year is a very good option. If you can get a managerial role there, you can also try for EB1.
