H4 & H4EAD concurrently filed - H4 online status is unchanged but EAD case updated and shows new card in process.

at the same time it wont hurt to have some knowledge about the rule when talking to a attorney..

Humanity123.... I may be complete wrong about this but can u show the rule that states this... per my understanding according to AC21 H1b can be extended beyond 6 year even if perm is approved (365 day rule) and I-140 is denied as long as the appeal is filed in timely manner.... May 2005 yates Memorandum,

your 365 day count begins when you labor was filed and as it was approved in may this year your employer must have filed it last year some time.
if it is 365 past your application date and you I-140 is pending in your case under appeal u may be eligible for 1 year extension

Topic: H4-EAD validity after primary H1B applicant Job Change

H4 EAD has two parts to it..
1st H4 - H4 is independent of the employer that the H1B works for and there is no such thing as H4 transfer. SO basically H4 status is valid as long as the H1B is and as stated on h4`s I-94.
2nd - 140. with 140 not revoked from the previous employer makes it still valid.

So to answer your question, you do not need to do anything unless H4 or H4 Ead is expiring within next 6 months. If expiring, this would be the best opportunity to get renewed along with H1b job change/extension.

I am not a legal advisor... I would recommend to seek immigration lawyer to help but the chances are most of them have no idea since there is no clear guidelines on this.

meaning if the prevailing wage is 100 k in bay area... then they should make minimum h1b wage to 250K???

Nothing is changed... what these ppl need to tell u is.. come 3rd Jan 2017 when the two year congressional term ends this bill is DEAD. It is a great effort on everyone who pitched in to get these many congress men to co-sponsor this bill but at this point when the 114th congress is close on adjourning nothing is going to happen. This bill needs to be re-introduced in the next congress and mostly likely will get a new number too and some changes if any..

An agency must submit most final rules, interim final rules, and direct final rules, along with supporting information, to both houses of Congress and the General Accounting Office before they can take effect.

Major rules are subject to a delayed effective date (with certain exceptions).

Action by Congress and the President could have an impact on the rule.

As you mentioned in your first statement that this rule is confined to protect the approved I-140 from employer revocation with no intent to provide EAD... I complete agree and so do everyone on the forum.

Just imagine yourself in a situation where legal immigrant is laid off after spending 5-10 years in the company due to economy downturn, you are skilled enough and have potential to seek new employment within matter of days. But now since you are say in 2nd or 3rd year of your H1b extension period and the your previous employer revokes your I-140. It leaves you barely enough time to file and get a new I-140 approved before you run out time. DONT YOU THINK THAT HAVING THE RULE WHERE YOUR EMPLOYER CANNOT REVOKE YOUR I-140 PETITION WOULD BE HELPFUL IN THIS CASE. I hope you do not get into this situation but if you do, you would thank this forums if successful in efforts to seek an update on the rule that does not provide EAD but just confines the employer from revoking

Understood.. but can u share the attorney`s name... if there any truth to the news what so ever every1 would like to know & would be helpful.. and one way to check that would be the credibility of the lawyer.. sharing this is not going to hurt but might be beneficial to every1.. AND AS U MENTIONED THIS IDEA OF THE FORUM IS TO SHARE INFO AND ASK QUERIES... SHARE THE ATTORNEY NAME..
