Topic: NJ Driving license renewal based on pending h1b extension

I dont know much about special window, but you should not have shown them the approved visa doc. I was in similar situation and the person at counter advised me not to give them approved document. But since your license is expiring in 2 months, you need to go back with extension receipt and not talk about any approval and ask for license renewal. They would give it somewhere between 3 months to 6 months duration.

Yes, The DMV guys always have problems knowing the rules. I had similar problem recently in a different state and not NJ. I tried explaining the lady but she would not agree so eventually I went to a different DMV on next day and they easily accepted the application and I got 3 months of license. Generally they give 6 months but this time they gave me 3 months not sure why though.

Topic: processing at California location for H1 transfer slowed down

You may be right, my current employers extension was pending at Nebraska and got RFE within 3 months which faster compared to their recent processing time. But they had transferred the application somewhere else as well. I am also desperately waiting for my transfer which was filed on 25th May. I could not even afford to delay joining at this place because of non-compete etc.

Topic: processing at California location for H1 transfer slowed down

Has anyone observed looking at tracker here, the H1B transfers processing at California location was pretty fast recently.
As per tracker many people who filed by 10th May have already gotten approved or RFEs created. But I hardly see applications approved after that. I have been seeing the applications were processed till 10th May almost 15-20 days back itself but sudden halt after that. Anyone has any idea if there is a specific reason behind it ? like California has stopped transfers momentarily etc.
My friend filed transfer 10th May and his application was approved almost a month back itself.

Topic: Contract to Hire - Vendor Agrement

You said it was a contract to hire, so client must have taken some sort of confirmation from you that you will join them after some duration. Did they not ? Many vendor companies ask me confirmation in written that I am ready to join full time to client if got an offer. I wonder if it was contract to hire it should be mentioned somewhere and ideally vendor need not have issue in that case.

I think they transferred petitions to different location after they received it at Nebraska as they have huge backlog. But I am sure no one sent it to other than Nebraska. USCIS simply rejects such petitions received at wrong center.

Thanks a lot. That helps a lot. My employer is asking hefty amount of money after working for him for 2 years and finding projects on my own so trying all options possible. I hope uscis considers the received date correctly as my application will be reaching exactly on a date my I-94 expires.

No. It is other way round. My new employer is not saying that the extension has to be approved. I am the one who is concerned about it. Practically my current H1B expires tomorrow and I will be working with my current employer for next 2 months on a petition that is pending but it will never be approved. I am just trying to check if that will be considered as out of status etc as my current employer wont pursue the case and it will never be approved. Thanks for your response I am just concerned as I am making all these arrangements at last minute.
I was reading about bridge petition etc. so just wanted to confirm if this wont be the bridge situation.

Thanks for replying. regarding I-140, my I-140 was approved 4 months backs. so my employer still has option to revoke it in next 2 months. I am joining the vendor company and my employer wants huge amount of money to break the contract. So I figured I could work for 2 more months with him so that he wont be able to revoke it anymore and I wont pay him anything and join the vendor company. But main question is my I-94 is expiring, extension is pending and I will be in status since it is in pending, but there is no way the current employer will get it approved if I leave him after 2 months as it is in regular processing.
But new employer says it will need not be approved as new H1 will be filed before expiry of current H1 and I-94.

Hi everyone, one critical question. My I-94 expires tomorrow, my current employer applied for extension in regular already which would take 6 months minimum to process I believe. At the same time new employer is ready to apply today and the application will be received at USCIS tomorrow. As per him once my application is in I can start working for him anytime in future. But at the same time main concern I have is I can not leave my employer today as he wont allow. He is the one who approved my I-140 and wants me to work for him next 2 months when it will be 6 months after approval of I-140 and the extension he filed will not be approved by then and he wont even pursue it after I left. As per new employers attorney it should not be a problem as their petition starts from tomorrow though I wont be starting to work with him till 2 months from now. Is that correct ? Do I not have to get this extension approved as I will be working for my old employer for these 2 months ?

I apologize if I did not understand it correctly. Sounds like he left his first employer before the transfer is approved and started working with new employer on receipt itself. As per my limited knowledge if the case is genuine you can open a review case with uscis and that buys you time I guess. It would take time though and you will need to pursue the case using lawyer, may be company lawyer. You will need to check with attorney for the options though.

Topic: Received RFE on already approved H1B petition

My H1B extension was approved 6 months back. Then I was due for new extension which was applied this month. I received an RFE just now. After going through application number realized that the RFE was on older application that was approved 6 months back already and that too with an RFE being raised at the time. This sounds weird. Did anyone experience this or know something similar? I am concerned about my current extension which was applied 1.5 months back and still no receipt. Mu attorney was calling USCIS and requesting them to convert current application in Premium as she messed up by sending it to wrong location and ultimately did not reach in time to correct location.
