My bad luck, A guy who works for same technology as mine has put down his papers( has few years left on VISA),I have asked my account manager that i would go now and come back in 2 months and he is not interested saying he needs someone in this technology for not loosing the client and someone needs to be onsite. Meanwhile they are actively looking to hire new resources.
I need to go for stamping if i have to come back after 2 months so guess cant ask for a release now.

Haven't spoken about my pay yet but Speaking to couple of folks its maximum 10 for SA and 14 for M (depends on situation)
However people who would have got more would not post or say openly.
Also you have to give 3 months notice if you are quiting in india. Not sure how flexible is this notice period.

Yes that's an option but will take a lot of time for that company to allow you to come back to US, it does not hurt if you go voluntarily to India.
But hurts if you are forced back to india and then give little hope(meanwhile peanuts) that you can come back(Not sure whether PERM will be approved after the the audit on seeing June cases).

Good for you, They are exploiting my situation,they are concenered of loosing billing here, they are not giving me assurance that they will bring me back again and seeing few posts its very painful to come back again after i leave to India.
They would be offering 9 lakhs after my maxout in India and i need to sell my stuff etc...
If they find some replacement here who has 3 -4 yrs on H1B onsite they will not thnk about me then.

Perm applied : Jan 19th (Audit)
Need 2 months recapture

Have spoken with my account manager and he is not interested to leave for 2 months(asked for vacation /unpaid leave) now and return back and apply for extension as joined a new project recently and he says they need people from my technology onsite.
It appears he will convince me to go to india after maxout , but i see from the forms salary would be lowest and coming back it would be lowest and then a pain to apply H1 Extn in premium (Need to Beg people), Also need to sell my stuff.
Need to discuss with him further.(Dont want to get into a situation of Use and throw)
Now,Can i negogiate on my indian salary and whether salary would remain same coming here and that they would apply for my extn(Premium) at offshore if they ask me to move after maxout.
Or
Will CTS HR exploit me and does account manager have a say in the above.
Please suggest

I raised a GSD ticket and they said that we can apply only after Jan 19th, 2014.
May be its the company policy, It all depends on how badly they need you onsite.

You might be right , this needs to be confirmed.
But if so then if i apply my first extension in regular and its pending as of 01/19, Then can i apply another Visa extension on 01/19.
PERM filed 365 days prior to your H-1B max-out date*, and is presently pending at the U.S. Department of Labor (DOL) ? you are eligible H-1B extensions in increments of 1 year beyond the six year H-1B maximum period of authorized stay while the PERM application is pending at DOL

*When calculating your H-1B max-out date, you must include all days that you have been physically outside of the U.S., and re-apply that time to the maximum six year limit (example: if you spent 10 days outside the U.S. over a 365 day period, then you only used up 345 days of toward your H-1B maximum period of stay, you would add the 10 days back to your period of H-1B eligibility)

Whats the difference between coming back and applying for 7th year extn
Vs
Go back and apply Extn from India before Perm date and come back on 1 year+ Visa.

I think we need to find out whether we need two extensions or one is sufficient

When Did you Apply for Canadian ICT, I heard today from Immigration team that its taking 3 1/2 months when applied from US.There appears to be a some sort of strike
Did you submit your passports to Canadian Consulate.
You can apply H1B extn in parallel to Canada Visa.

Can you please let know the scenarios for 7th Year H1B extension based on PERM pending.
Maxout Date : Nov 19th 2013
Perm Applied on Jan 19th 2013 and received an audit.
Falling short of 2 months in order to apply 7th Year H1B extension for an year based on 365 days PERM pending rule.

Question: If i leave US on September 1st 2013 , Can i apply 7th year H1B extension on Nov 1st 2013 from outside US.(As it pushes my Max date to Jan19th 2014)
Or
Am i eligible for 7th year H1B extension only after Jan 19th 2014 from outside US.

Have couple of questions regarding above.
(a) If i go out of US now for two months , Do i need to go for stamping to come to US before maxout , Is it not a risk during stamping when i have few months left on Visa.
(b)Once i come back to US before maxout , Why cant i apply 7th year H1b extn. Should i recapture and then apply 7th year Visa.
(c) Is recapture same as Visa Extension
(d) If i go out of US now , Can' t i apply 7th Year H1 Extension from outside US before PD 01/19/2014.

Sorry for asking too many questions but need to take a decision soon, So want to get clarity on the 365 day rule

Will leaving before my current maxout for 2 months not push my Maxout date further and make me eligible for H1b extn based on 365 day rule earlier than 01/19/2014.
Is it that i can apply H1B extn based on 365 PD only after 01/19/14 in any case.
If so i will leave a week before current max out. Was wondering i would bite the bullet now than later and apply extn earlier than 01/19/14.

Short of 2 Months.
