There is no way you can be applied in EB1 since it is for only 'International Manager' category and you should have worked outside of US in the same company in a managerial position for atleast 365 days.

My guess is that we will be in total dark and will not hear anything from GIT for next 6 months.. until DOL issues an approval or denial... Always remember that we are dealing with GIT (black hole from where nothing comes back.. let alone a response) :-)
It might be even longer because DOL doesn't follow a set timeframe for supervised recruitment.

SR is usually for the employer when DOL believes that employer is not conducting the recruitment properly. There is a very slim chance of the PERM getting approved and on top of it the employer may not even withdraw the PERM because of a backlash from DOL.
We are all doomed now because DOL doesn't provide any timelines on how they will administer the SR process or how long will they continue it before publishing the recruitment report. The denial chance on SR is very high...about 65% according to various forums on internet.

Also CTS can not request for withdrawal of these perms because repeated requests to withdraw different applications undergoing supervised recruitment will be carefully reviewed and may evidence a pattern or practice of the employer's failure to comply with the supervised recruitment process, and may subject the employer to debarment from the permanent labor certification program for a reasonable period of no more than three years pursuant to 20 CFR 656.31(f)(1)(v).

All in all CTS will go ahead with the SR process and it could take forever to get approved or denied. If it gets approved at the end of it that's still ok however God forbid if it gets denied then your 2 years are lost and CTS will file a new PERM but by then you would have lost precious time.

Finally.. after lots of followups...They have got a Supervised Recruitment request from DOL (otherwise known as Second Audit).

While DOL imposes a strict timeline to complete required action items, the process is controlled by the DOL, and DOL is not required to issue next steps or a decision on the PERM application within any certain timeframe.

I am told that it can take anywhere from 1-2 years from now because GIT will now have to do all the process all over again starting with the recruitment advertisement. The whole process will be supervised by DOL and they don't have a set timeframe for it.

This is not like the regular audit (otherwise known as First Audit) where DOL was just asking for additional documentation and is publishing a processing timeframe on ICERT.

GIT says that this is a new process for CTS and they did not have such cases at all earlier but now that they have come under scanner most cases are getting supervised recruitment request (Second Audit)

My concern is what if GIT is withholding information unnecessarily because they know for sure that if they give us status...we will immidiately jump on them to file i-140 in Premium Processing so that on its basis you can file H1 extension for 3 years.. now in the next 4 months GIT will have to not only quickly file your i-140 PP and then your H1 PP etc.. they don't have bandwidth for that..so they may be thinking to just hold on till you file your H1 extension and then tell you about your Perm.

Assuming that GIT is not withholding any information and that DOL itself hasn't provided any updates then what is stopping GIT to just send an email to DOL helpline because Aug 2011 is more than 3 months older to DOL's current processing timeline of Dec 2011 and they have written on ICERT site that any case older than 3 months can be enquired on their email address for an update.

Why does GIT not respond to any of my emails at all?

What audit you got? is that Random Audit (The Audit is a standard employer based query that DOL issues randomly at a 50% nationwide rate)?



yeah..typical random audit only... GIT wrote at the time of receiving audit that they typically get such audit requests for 50% of their cases :(

GIT simply won't respond to me and last 2 times that I opened GSD tickets, I got the standard template response that we will get back when we would have any updates. Plz check myvisa.

I am maxing out in Nov and have no updates whatsoever.
