That is really very concerning and it will put my case at risk.
I was not aware the employer is required to notify USCIS about my H1-B termination. My assumption was unless my previous employer revoke my H1-B or unless I do H1-B transfer with the new employer, USCIS will not be aware of my change in employment. It looks like that is not the case. That is why I need help from professional immigration lawyers.

Thank you so much for taking time to provide detailed response specific to my case. I agree getting a professional help for cases like me is a smart decision. The information you get here from folks who experience the same scenario helps you make informed decision and give you peace of mind. I learned a lot from this forum and its largely because of helpful guys like you who knows the painful journey in this process.
I plan to do exactly as you said. I already started doing some interviews and may get an offer by end of this week. I'll not apply for AC21 unless I get RFE.

The Occupation title in my PERM says "Computer Systems Analysts" and the jobs I am currently applying is software developer/engineer. The notion of "same or similar" job is my concern. Hopefully, my case will be approved without any obstacle. Fingers crossed.

That is very helpful. Based on the current timing at Nebraska, my application will be approved end of this year. Feb 3 is my receipt date for I-485. Companies these days don't seem to be interested for H1-B transfer. I want to get job as soon as possible. The good thing my company is not going to revoke my approved I-140. My happy scenario is my I-485 will be approved without USCIS knowing about my termination or change of employer. What is the chance of this happening? If there is RFE, I was thinking to file for AC21 and showing the termination letter as evidence. I wish its over 180 days.

I am in the same situation. Got laid off before 180 days and I have termination letter. When do those people provide the termination letter ? Is that after they receive RFE ? Do you think I can file for AC21 after 180 days even if I started working with the new employer before the 180 day mark passed ? I already have approved EAD (as a result of pending I-485) and I plan to use that for any new employment. Any info specific to my case will be greatly appreciated.

Thanks redgrapes. OMG, that is one of the most important decisions I have made recently. Its something I was not expecting. They laid off everyone and decided to close the office. I would have regretted now if I have not filed it in premium. Even the company immigration lawyer recommended me to file with regular processing saying it will not help since I-485 processing is taking longer. I was in dilemma at the beginning. I asked the question on this forum and almost everyone suggested me to file premium. I am very thankful for those folks who said that to me. I am expecting my I-485 to be approved end of this year. Hopefully, there won't be any RFE.

Thanks crooked. That seems smart and safe move. But the thing is H1-B premium processing is recently suspended and it may take several months until it gets approved. Based on my recent experience in job search, some of the companies prefer candidates which don't require H1-B sponsorship. I want to start job as soon as possible and not create any gab in my employment. I am inclined to using my EAD but that may change once I talked to an immigration office.

Thank you rkkr for sharing your experience. Your suggestions is consistent with what others said in this forum. I would definitely consider using EAD for future employments. Yeah I agree, panic will not help at all.
Yes, the company immigration lawyers told me and I also read it in the internal immigration website. That gives me some peace of mind.

Its good to hear from someone who went through the same situation. I am glad to hear that I can still go back my old H1-B.
I already applied for I-485 on Feb 2017 and its pending. It was actually concurrent filing with I-140 (PP). My employment is terminated while it was pending only for 106 days. I wouldn't be able to file for AC21 until August , 2017. I already added my case to my profile.

Thanks rfums. Its not H1-B extension. My understanding of extension is after you finish your 6 year period. I guess mine will be H1B transfer. I am still in my third year of my H1b and it needs to be renewed after Oct 2017.

Thank you for your message. Yeah I will get an immigration lawyer. What if my future company is willing to do H1-B transfer during the grace period ( 60 days ) while allowing me to work with EAD ? I know I can work with EAD, but I just need a safety net in case my pending I-458 is denied later.

Hi friends,
I am in H1-B status and got terminated yesterday. I have a pending I-485 with my company and approved I-140, EAD and AP. I was told that my company will not revoke my I-140.
I just started looking for job. The company immigration lawyers no longer provides me advice and I am freaking out.
My case has has been pending for 106 days. Since the H1-B transfer takes some time, my only option is to use EAD. Will my H1-B terminate if I start using my EAD ? What do I need to negotiate with my next employer? Do I need to file anything?
What would you do if you were in my position?
Please advice.

Hi Pray13,
It may or may not shorten the time for I-485 processing, but it will definitely shorten the entire duration (I-140 + I-485) time. Based on my research online, people who file concurrently with premium have shorter duration than those who filed in regular.
I've also opted for PP too and it will be filed begining of January.
