On treatment / end life care, I strongly recommend US. People in India have no ethics, and medical field is no exception. No matter whichever hospital you go, they will try to exploit your situation and make money out of it. Even in big hospitals, nurses treat you with a sense of apathy, and expect tip for every single thing they do. Although healthcare is an expensive deal, here people are extremely genuine and honest.

I feel extremely sorry to hear your situation. Please reach out to any lawyers and try to apply for EAD based on compelling circumstances so that both of you could take time off your work legally. It is exactly for this kind of circumstances USCIS has proposed that EAD. Please do take advantage of it. You can sort out other stuffs later when the time comes.

You can start working only after the amendment is filed. LCA filing or approval as such doesn't mean anything. If an employer stays that you can work with LCA filing, you should skip such an employer at all costs.

MY company ( I am in US) has a office in Toronto , If I get something like inter company transfer to Canada office -- Will there be LMIA exemption ?

If your IELTS results are two weeks old, please go for revaluation in writing. You would mostly get that 0.5. Even then neither direct ITA nor nomination is possible.

If your company is okay to transfer you in ICT, you will have couple of options. You can get 50 points if your company provides an offer letter with an employment assurance of one year after getting PR. Your score will boost to 451 in that case. If you cannot work that out, you could wait to complete 12 months of experience with that company and gain more points for Canadian experience. One year of Canadian experience will significantly boost your CRS points. If you still fall short you can try after 2 years of Canadian experience.

Before doing anything else, since your wife got the extension before she arrived, I would suggest you go tomorrow to the airport where your wife had arrived, ask for the CBP officer, show them your wife’s extended I797C & ask them to correct the I94 date on the passport.
My wife had a similar issue a couple of years back & we got it fixed at the airport. She had her extended I797C , returned without going for extension stamping , and although she showed the extended I797C the POE officer gave her I94 till the date of the original visa stamp expiry. We went to the airport the next day showed her extended I797C & the officer at the cbp corrected the stamp on the passport to the extended date. Also the I94 date online got updated.
Not legal advise, but something worth trying.

True, this is good idea and worth trying. Since the date of i797 is before the entry date, cbp might consider revising the i94. The only thing to be concerned is that your wife is already past approved date. I'm not sure if that would bother cbp officer at deferred inspection site.

I guess the problem is at your end. Both cbp and uscis were right in their actions. Why did she present your old i797 instead of submitting new one that has validity till 2021? If she hasn't had a copy of it, she should have waited till she got it. As someone pointed out last action rule prevails. Cbp i94 overrode uscis i94 as that was issued last. You should have at least acted after seeing that her i94 has been given only till March. Attorney might have suggested to apply fresh H4 extension as that would have been only way to stay past March.

I'm afraid the only option now would be go out and come back with stamping. That will give her new i94 and you may probably abandon this application and submit fresh one once she comes back.

No, PERM audit has nothing to do with the beneficiary. It is filed with DoL and not USCIS, so they don't even know about the beneficiary's status (they may not even be in the US).

There is a field called 'Class of Admission' in ETA 9089 aka PERM application form from which DOL will know beneficiary's status if they are in US. The form also asks for i94 number.

I signed up. It’s no different than the regular one for me. Just a fancy version of the usual one.

If you have checked status for any of your recent cases, you will understand the difference. Most extension and amendment status filed in regular mode don't get updated correctly these days in the regular case status website.

It is definitely not possible to hide the type of EAD. These days recruiters clearly have a list of approved work authorizations for a positions. If it is EAD, type of EAD also get considered.

Are you actively employed or having a break? Most of them who have a break find it difficult to land in jobs, and they many times think it is because of H4 EAD. Break is the first culprit. If you are actively employed and still don't get calls, it could be due to H4 EAD.

My previous petition is approved till 2020 with City A. I got REF for new location and RFE is altogether different then which sees days. I am guessing that your attorney goofed up something. Or USCIS probably found your job duties have no connection with the job duties mentioned for LCA occupation.

You can still work from city A if your amendment is denied.

The writer of the article very carefully and consciously avoided the work 'h1b' and instead referred to h1b people as 'skilled immigrants'.
If the main stream media is so scared to even mention 'h1b' and think that this word will only elicit animosity and not sympathy from the American public towards us, then I have little hope on any immigration bill giving relief to 'h1b people' stuck in decades long backlog.

You are looking at it the other way. The author did the right thing by avoiding the word H1b in order to keep the essence of the article as is. H1b is generally never brought in to legal immigration topics and is generally a separate topic altogether.

Let me try to convince you to be a house owner based on my situation. Family size 3 (pati, patni aur beta)

I had my PD from 2011. FTE since 2008.
First shot at a condo in early 2012 when 140 was approved. My friends and well wishers recommended me to buy a 2 bed condo. Price point 160-170 K (1000 sq ft). Was not sure, did not buy

Renter from 2008-2015. 2012-2015 rented. Paid - 65K in rent for 4 years. (1400-1500 avg.)

2015 bought a condo for 225 K. Same condo was sold for 175 K in 2011.

Monthly EMI 1450 - 30 years 4.25 % in June 2015.

Refinanced Monthly EMI 1550 -20 years 3.49% in Sep 2016

Current zillow price - 238 K - Outstanding loan 175 K odd.

I am just paying the same amount as I would paid as rent for the last 3 years. In any case of visa uncertainty, I can rent the house or even sell it for the price I bought. I would still be at a profit.

If the GC comes in 3 years or so, I can buy a bigger house and use my current place as a rental property.

How much you spent on other expenses in these three years? Like maintenance, repairs, property tax etc? Also how would you be in profit if you sell for same price for 225 k? If you sell for original price, and consider your other expenses , even with 5k per year, you would be at a loss of 15 k in miscellaneous expense when compared to renting isn't it?

Guys please gauge your risk appetite rather than going by market trends or visa trends.

Some people don't bother about immigration status and just go boldly for investments like house. It requires a unique boldness to oversee the fact that one is on temporary visa and invest money in the house. Go for house only if you have that confidence of dealing things, no matter what. Don't get pressurized by the fact that market is going up, mortgage rates are going up etc, and fall for the house. You will be enormously stressed if something like extension denial or visa denial happens if you are not cut for it.

In my opinion, it is not a good idea to buy house without immigration stability. One aspect is visa rejections, and the other aspect is layoff scenario. Even with a extension of several years, there is a high chance that client ends the project soon or the company where someone is employed lays them off. Given that visa restricts mobility, one will also often need to relocate based on job circumstances where it is lot easy for GC holders to find a job in the area they are based. House will be an absolute pain to deal at that point if it is taking time to sell.

If one wants to live in good set up, renting bigger town home is always an option.

So she joined army to get GC/citizenship? This like EB1C is another loophole. The day is not far when WITCH's will tell their employees to join the army and work part time.

Don't jump guns.. it is not a loophole. They let people do it knowing what it is and it is not easy as it sounds. If you fail basic training, you will lose your status in US. That is first major problem.

Next is you will sign a contract for six years and they will call you for deployment any time they wish. And there is extremely high likelihood of the deployment being in war torn zones like Iraq, Syria etc. They can put you there for multiple years and there is no guarantee for life. I have heard personal experiences on how such bases tend to you be. You will be in safe area, but you will keep hearing bomb sounds outside often, and you cannot discuss about it to anyone. And militant and enemy attack on US bases is so common in such countries. You could be kidnapped by terrorist in such places too. And you will have very limited contact with your family in all those years. There are very slim chances of being deployed in an ally country like Germany, South Korea too, but that is less probable.

Above all you don't know how those things would psychologically affect you. Many US soldiers get in to depression after several years of war posting.

US is not fool to let people get citizenship out of nothing. They will make you pay an appropriate price for everything.

You can google and find out many posts in Avvo on people wanting to opt out of MAVNI (aka this army citizenship program) after enrolling themselves.

These bills are jokes and will never be passed. The only reason Govt is paying attention to DACA is these people will end up paying taxes. Think of it, everyone knows, DACA kids will stay here legally or illegally. Now when they have to stay, why not pay taxes atleast govt will have some profit. Vote bank is secondary, US is a capitalist economy and all they see is profit and loss. Illegal DACA is loss while Legal is Profit.

Now we poor law abiding Indians are already paying taxes and doing our share of work for the economy, so there's no way we appear as a loss for the economy so they're OK with where we are. Most of us will not claim Social Security as after waiting for so many years will end up returning to India.

Now lets put ourself in American govt shoes and think of Indians and DACA:

1) Segment 1: This segment is already providing profit to country and eventually most of them will leave the country while filling Social Security and other tax bins with their hard earned money. These people are far away from doing any crime and don't create any noise. They already have their own demons where none of the naturalized citizens, congressman (Bobby Jindal) or AG (like Preet Bharara etc) belonging to the same heritage want to do anything for them. So if govt kick them out, its not like they'll lose any vote bank which is again an after thought for them.

2) Segment 2: This segment will stay here no matter how much they try to kick them out. They'll keep on coming back. They do crimes and don't get caught as most of the times as they're not in the system. They take benefit of the school, security etc but don't pay for it. Since they know they can't get rid of them, atleast make them pay taxes so Govt gets some profit out of them. Moreover, they have sympathy from naturalized citizens belonging to the same heritage and most of the people who hold higher positions in the society. There is a big chance of losing profit and vote bank if they kick this segment out.

Now tell me without getting biased with GC situation, what would you have done if you were the govt?

I would let the DACA fail too if the ask is to keep family and diversity lottery. Eliminating chain and diversity migration in lieu of DACA seems like very rational thing to me. No developed country in world has this big quota for family and asyulum based immigration like US does. Economic immigration should be majority in any immigration program for a country's benefit.

LOL, DACA rescinding itself is on hold, H4 EAD rescinding is a pipe dream of this admin, just like gutting Obamacare completely....ain't gonna happen

That's why they are going after the H1 holder instead of H4 EAD move by the admin, they want to tackle the root of the problem instead of the symptoms...

Add travel ban to the failed list too.
