Thanks a lot ctsperm.

I am sending repeated emails to the immigration team, but not getting any response. Someone reached out to me asking to fill RFE questionnaire, but RFE response cannot be filed when PERM is in denied because mine is 7th year extn.

My H1 extn was filed in premium in March and got the RFE in April 2nd. I got the PERM denial email on 7th April.

Options:
1. Go to Canada, work for an year, apply for H1/L1. Can my wife work if we relocate to Canada.
2. Is it worth going to India, wait for an year, hope to get an H1/L1, hope to get EB1 (M level) while I m back in US. I know its a long shot, but dont have other options
3. What would be a good package at M level in India.




I think if your PERM is denied and appeal is filed then it is still in process. So you should be able to file RFE. Unless CIR passes getting H1 will be difficult.

I joined CTS 3.5 yrs ago in the US and now in an unfortunate state of PERM denial.

Priority Date: 25 Jun 2012
Audit Received: 22 Aug 2012
Audit Responded: 20 September 2012
Denial Date: 08 Apr 2013

H1 expiry : May 20 2013
I 94 Expiry: Jun 3 2013
6 year completion and max out date: Aug 1 2013

My H1 Extn was applied before the PERM denial, but that is RFE status. No one from the GIT team has contacted me yet.
I had some questions and raised a ticket, but it was closed mentioning that some one will contact me.

What are my options.
1. Will CTS file an appeal for the PERM denial. I see from previous posts that there is no guarantee that it will be approved.
2. As I was recruited in US, will they offer a job in India. Will they offer a comparable pay or lowball me due to my situation
3. Will I be eligible for new H1 in the Apr 2014 (effective Oct 2014) quota if I leave US in Jun 2013.
4. Coming back to US after one year will again be a problem due to H1 lottery and also if company is willing to do tha. Also not sure if they will apply for new H1 next year (Apr 2014 effective Oct 2014).
5. For some ppl, the company processed EB1. Don't know if the company will do it next year and also if some immigration rules change by that time, I am toasted.
6. If I work from Canada, can Cog apply for L1 or H1 after an year.

Please share your thoughts and experience as it is very frustrating for me and feel helpless at times.

--- Yes they should contact you in a few days. They will typically want your manager letter and probably client letter / SOW (that is what they wanted for me)

--- Yes they should file for an appeal in your case since it will give them time get your H1 extension. Remember if they file for an appeal then PERM is still technically in process and you are eligible for 1 year extensions. The only issue is you have to wait 365 days but with recapture I think you should get H1 extension.

--- No idea but CTS is one of the better paying companies in India.

--- Yes, since you will only come back in Oct '14. I think getting H1 next year will also be on a lottery. So yes you will be eligible but the bigger question is will you get it.

--- If you are a manager in India for atleast 1 year and come to USA in the same capacity they will file in EB1. I am not sure if they are filing EB1 though. I know they are not filing Eb2 anymore.


6. If I work from Canada, can Cog apply for L1 or H1 after an year.
--- Yes.


I think you should push for premium filing for H1 so that you have more clarity on your options.

Recently I got a reply from Cognizant that they were refreshing their PERM process and hence will not be filing any PERM applications atleast until end of Q4. Is anyone having this issue or has anyone has their PERM filed recently?



I believe that is true. My PERM was denied and is in appeal. I was told that if I need to restart my PERM then I need to wait until end of Q4.

How did you apply for extension without PERM approval? Is your PD before 365 days of maxout?

I haven't talked to my account manager yet, so no idea on the next steps. I'm hoping they'll bring me back, I'm probably more valuable to the company working in the US than in India, due to the better contract rates. Pretty sure it will depend upon project requirements. The role should be the same since that's what I'm best suited for, and have experience in. Hopefully they bring me back at the same US salary that I leave with. It's all speculation at this point.



Yes, fortunately in my case I had more than a year a PERM had been pending. I am thinking of getting the extension (hopefully without RFE) and then withdraw the PERM that has been denied and apply for a new one.

My PD is in June 2012 and maxout is next month, therefore I have to leave. Earliest I can come back is when audit gets resolved, hopefully in 6-7 months.



That sucks. I am in a similar position reaching Max out and PERM is denied but is in appeal. I have applied for H1 extension and am hoping I get it before I get a decision on PERM.

Has CTS offered to bring you back after 1 year or will it depend on project requirements? EDIT: I ask this since you were a lateral hire (as am I) and were not originally employed by CTS India. So I am wondering if they have a policy on that. Also, if they do would they bring you back in your current role and salary or will they bring you back on at a different salary?

How about a funny story?

I remember I was so happy when I came onboard CTS more than a year ago. I thought since I'm joining a large reputable multinational, my visa issues were over. :)

First, my H1B transfer for RFE. I pleaded with GIT to send the required docs to USCIS immediately, but of course they took their own sweet time. So my RFE ended up getting cleared a few days AFTER my (maxout - 365 days) mark.

So then, having missed that milestone, GIT again took it's own sweet time with initiating my PERM case in MyVisa. I uploaded all my docs and completed the questionnaire at the beginning of 2012, but GIT was on a "PERM freeze" and didn't submit my application until 6/30.

And of course, after two and a half months of chewing my fingernails off and pulling my hair, I find out that I've got an audit. So gotta uproot myself and leave the country.

The funny part is, if I had applied for PERM through my previous employer (small time desi consulting company), it probably would have been approved.

Such is life. On the bright side of things, I'll be visiting India after 7.5 years, and CTS will pay for the ticket :)

Good luck to all of us who got the audit! Hope GIT can step up their game.



I am not sure I understand why you have to leave the country if your PERM is in Audit. You mentioned that you got your H1 extension so you can stay until H1 end date and then you will have to wait for 1 year since your PERM has been pending to apply for H1 extension (even if your PERM is denied it will take some time for reconsideration requests, appeal to BALCA etc.).

Assuming your PERM was filed in Jun 2012 and your H1 ends prior (including recapture) to June 2013 you may have to go out of the country until that time. In June 2013 you can push to file premium H1 and rejoin.

I was hoping for a same result that something would come through may be in September.
August has passed by and I don't have any updates from GIT, nothing is updated in MyVisa as of now.

I will open a GIT ticket to see what is going on.

Did they file your Appeal in the same category "Government Error" too?
To me that looks like a "common" categoary told to everyone around here.

Yes I received an e-mail saying my PERM was denied and then another e-mail 5 minutes later saying they have filed for an appeal as they believe it is a government error. They did not specify what the exact error was and after multiple follow ups i haven't been given an exact reason.

Also, I think they must have received denial some time back but did not update the MyVisa site because I got both the e-mails immediately. I have been following up every month on my status and I even had a ticket opened which was resolved a day before I got the denial e-mail saying they do not have any updates, which I find hard to believe.

Reason for denial - GIT never gave one only told that it's a government error.
Appeal filed in category - Government Error

Current status - No idea what is happening.




From what I have read if it was govt. error then you should hear between 30 to 45 days. You are close to 45 days mark did you try checking in with them again?

Reason: Resumes not sent by employer... but employer says they sent.. and filed in Govt. Error queue... had it been accepted in Govt. queue then Approval wud have came much earlier..., expecting something in next 30-45 days..

Do they file parallel PERM?



Did you open a ticket to find why it was denied or did you talk to someone? They just told me govt error.

Oct '11 PD, Denied in April 19th '12..
Appealed on April 27 '12
Looks the appeal is placed in Regualar queue

It takes approx 12-14 months from PD for denial cases.



According to iCert portal they are processing June 2011 appeals. So, your figure of 12-14 months from PD is correct.

What was the reason they gave you? Government error or something else? Do you know if they file parallel PERM?
