DOL has challenged the decision. Months? Years? wait... and now with Trump, chances are bleak.

Calm down... count backwards 5 4 3 2 1.

You will get 5 weeks for getting a project. And if you still do not get you can raise a concern that it is year end and a lean period, ask for few more weeks. you will get close to 8 weeks.

As a backup, Apply for B1. In case nothing goes well, you can go on B1 and ask CTS to let you go on leave without pay. I have known people to go on H4 , leave without pay and continue once they have a project.

Something will work out.

@msn2013,
sorry to hear your plight. For those of us who are back in India after such situation, life is not smooth initially. Start looking for openings on internal job portal and calling hiring managers. Start looking for any location in India. Now I believe that you are a US hire and that your offshore does not have any opening. There are two scenarios here - A) Long term project in India or B) Short term project in India. In my case I was specifically looking for a short term project after the completion of which I can start looking for US positions.
Once your project in India is over, you will start getting calls from onsite (US and rest of the world). For US you can only take up a position, once PERM is pending for 365 days. I believe that will be Feb 2014. So, start looking for a short term 3-6 months project. In case you do not want to come back to US again, then believe me even if you are asked to resign there is nothing to loose. The salary at offshore is not that good. You will be low balled and have no negotiations to do.
Have a do or die attitude and a little faith in lord. What has to happen will happen but at the destined time.

For returning to onsite, did you have to negotiate? or that was their first offer?

Thanks

One thing is for sure that there is no standard reason for DOL's decision.

On going through the previous year's cases of KURUMADDALI RAJENDRA; the verdict is DENY Certification -
Quote
The Employer argues that the SWA job order website changes an input of “12 months”
into a value of “2-15 years” which is the only reason they are not in compliance. (AF 4-5). In
denying certification the CO pointed to a free form space in which the Employer could clarify its
requirements quite easily. We agree with the CO - it is up to the Employer to make it clear to
prospective applicants just what is expected of them.

For DESALPHINE DARREN; the verdict is GRANT Certification -
Quote
In the instant case, the preponderance of the evidence indicates that the Employer made a good faith effort to conduct its recruitment in accordance with the regulations and entered its actual minimum requirements of twelve months experience into the SWA job order form. The AJE’s instructions indicate that it automatically converts an experience requirement of twelve months or more into “Mid Career (2-15 years).” The preponderance of the evidence also indicates there was no way for the Employer to avoid having its experience requirement automatically convert into the AJE’s pre-determined range.
The CO’s speculation that the Employer could have utilized the job description area of the job order to state experience requirements is subjective, and there is nothing in the record before us to support such speculation.
Unquote

Further more, the union of certifying officers that has a memeber strength of 12000 is opposing the present legalisation bill. So it seems it all boils down to personal whims rather than going by the law book.

No wonder close to 200 are denied so far. Some more will be added next week.

In the end, it seems BALCA will deny all these. Going by the past trend, BALCA has upheld the CO verdict in more than 95% cases.

Million $$$ qn. Someone pls ans.

If I go to to India for 3 months to get to the 365 day policy to get H1 extn and work from India for 3 months, can we still apply for H1 extn (when I wont have latest US pay stubs) ?
**********************************************************************************************

Yes. Many people have done this. I am also in the same boat.

You don't need US pay stubs for extension, just offer letter with US salary mentioned and copy of signed client SOW.

now, where's my million $? :)

Did you get your new H1(not subject to cap) initiated?
Are you getting it sponsored via your current project?

People I have a question -
Once back in India, does one have to locate a project himself, that will send a person back to US? This is required to fill in the questionnaire. Or will G*T file for any available project and once the visa is done, the person will locate the project.

@ All those whose PERM is pending approval and are present in India...

G*T will apply for H1 extension once perm is pending for 365 days. Questions -
A) Believe G*T will file for a regular H1 - true? Anybody knows whether they do a Premium?
B) How long it takes for an H1 extension from India in regular processing?
C) For how long is the new H1 granted for? - 1year max?

Friend,
Information you will get a lot. I think what you are looking at is first hand experience; beyond information. I moved to India early this year. We had a lot of anxiety regarding kids. (One in 3rd grade and another yet to start). How they will react to schooling here. We got them into an international school. Surprisingly after about not even a month at school they both are liking it. The school has Paragon system of learning. No text books for Science, General knowledge, English and Social studies. All information is derived from open sources. Only Maths and English subjects have text books. Schools have smart boards and surprisingly the teachers also wear western dresses. Lot of projects that inculcate practical learning. In a nutshell, schools are not the orthodox schools that we went to. It is more on Western guideline.

We are moving to a gated community in a a few months and that way we can control the environment of our kids to a great extent. School and Home both are taken care of.

Next is stability. I am 38 years old and after running around for long as a vagabond in US, I think it is time to settle down. After all we do not know, the decision USCIS will take after 6 months or a year. They can deny our application any time and can even revok once given an EAD. Right on my floor is a Manager whose EAD was revoked after 6 months. That was applied on E1C. So no stability on that front.

My wife is also happy that now she can pursue her career after a gap of 6 years.

Only one thing that worries me is my Career in India. One thing is definitly there that CTS is not a place to be. They have started giving pink slips to people who got Meets most rating. No hiring on M and above. And any onsite travel has to be authorised by BU head. And with the 2015 vision, who knows what the corporate priorities might be further down the road. In each townhall the people keep on complaining rotation policy. May be there wont be that much stability down the road.

So it seems that after all, it is not all that bad.

are you in Bantala?

Wow what a decision to have a software company in a leather cpx. Right in the midst of the hazardous zone. All kinds of pollution... Water, Land, Air. I can get my 2nd grader to actually see the textual concepts. And the miles long and piles high waste disposal ground on the way is not to be missed. If not of work, one will surely succumb to this toxic environment. Coming to work itself is a struggle cus' the nearest acco is 10 miles away or shud i say atleast 16 km.

piece of advice...Anybody coming to KOL, just don't take a transfer to Bantala.

A1) Plan ahead. Send a mail to your Talent Manager. or NA Separation asking this.
A2) M - 11.5L
A3) only 15 days acco. depends on the account or project. but 2-3 months is out of question.
A4) No comp for late nights IST. We work on Saturdays and these buggers do not even allow to put in hours in timesheet.

Bhuppi,
Here is how this process works. Ask for a relocation from your current project. If not, then your current project will release you and you will be in pool for max 5 weeks. During this period you will have to land a project and be very clear with the hiring manager regarding your aspirations, that you will go to US soon. My advice stay for a year hoping that CTS will file for EB1. But I am hearing even CTS EB1 are getting revoked, so do not know how beneficial that would be. Salary will be fixed by HR and believe me there is no negotiation on that.

I maxed out and am in India after 6 years. I am finding it hard to deal with these so called managers.

Good luck to you.

I did the exact same thing a month ago. Threw away the stuff or sold it and came back to India. At that point of time it was like the end of the world. Now I do not feel all that bad. The count down has now started to return to US. My suggestion is to treat it as a paid vacation in India. Company will sponsor your trip and pay you salary and on top of that you will meet parents, family and friends.
If you are not willing to come back then apply for B1-B2 visa and get converted on that before your max out. Talk to CTS HR that you will go on an unpaid leave as you want to take your chances of getting the PERM approved. You have more or less 1 week to do so.
I know the pressure and anxiety lot of us are facing as we do not want to leave something so dear to us, but again life is all about experiences, some good and some bad.
I will not advice keeping stuff in a storage. A friend of mine planned to be India for a couple of months but ended up returning after 2.5 years. Had to pay more for storage than the actual cost of the stuff. If you decide to have a storage then have someone as a POA to execute your will.
