So DOLSTATS has denials for the cases which have been processed by DOL till 31st March 2014. Jan 2013 (when CTS did filing) case processing was started in this month (April 2014), which makes me think that the DOLSTATS denials are not relevant to us.

Based on all this, denials look highly probable now :(

DOL is processing cases from all the dates in Jan Month. Not even a single approval for CTS till date, this is really worrying sign now.

This is not entirely true. If your Perm is pending for 365 or more days, you become eligible to apply for H1B extension ( does not matter if you are in US or somewhere else) and it does not need to be approved. You need not be out of US for one year from max out date ( if your perm was applied earlier than maxout date).

Also you cannot get the H1B only on the bases of PERM approval, you need to get 140 approved as well. The rule is, if the PERM is pending for 365 days or PERM + I-140 are approved, you are eligible for H1B extension.

above is not entirely true.

The criteria for EB2 was: you should be Manager with "6+ months" of experience in CTS US

Not sure which line you are mentioning but what saw in the document on page 5 was

"Answer: No. Section 106(a) of AC21 allows an alien to obtain an extension of H-1B status beyond the
6-year maximum period, when:
A. 365 days or more have passed since the filing of any application for labor certification, Form
ETA 750, that is required or used by the alien to obtain status as an EB immigrant, or
B. 365 days or more have passed since the filing of an EB immigrant petition."

Which means one year should have been passed since filing the PERM. Let me know if i missed anything in the document.

Then what exactly this statement means?

"We are filing your PERM now in the EB-3 category in order to preserve your lawful stay in the US. We are not at this time filing any EB-2 PERM applications. GIT can assess your case for EB-2 when Cognizant is in an EB-2 filing cycle. We cannot confirm when the next EB-2 filing cycle will be. This can be anywhere from a few months to several months down the line. You will be contacted by a team member once Cognizant is closer to an EB-2 filing window so we can complete the assessment for EB-2 at that time."

So with the latest standard reply from GIT, does it mean that they will consider porting cases from EB-3(only those cases which will be filed in Jan 2013) to EB-2 whenever next EB-2 cycle will open . I have raised this query with GIT. If anybody else has got response on the same, please update the forum.
