Recently I got my 9th year extension based on 365 days filed PERM and pending with DOL. One of the case my Labor filed JUNE 2012 and went audit later denied now sitting BALCA stage.

Who is Eligible for H1B Extension Using AC21?
You may extend your H1B status annually in one-year increments if your green card process was started at least 365 days prior to the day when you reach the six-year limit. Or, if your I-140 has already been approved but your priority date is not current, i.e. immigrant visa number is not available to you, you may apply for three-year extensions of your H-1B status.

Your green card process begins when a labor certification (LC) application is filed on your behalf. If you do not need LC, your process starts when your employer files I-140 for you.

Do I Have to Have a Pending I-140 to Use AC21?
No. As long as your LC was filed more than 365 days before your completion of six years in H status, you are eligible for 7th-year-extension and beyond. But keep in mind that a labor certificate now has expiration dates attached, and will become invalid if I-140 is not filed within six months of LC approval.

How Many Times May I Use AC21 to Extend My H1B
As long as you remain eligible, you may extend your H1B status unlimited times until green card approval/denial. This means you can apply for H1B 7th, 8th or 9th year extension, or even more, if you need to.

We are your's well wishers and faced these problem since JUNE 2012. My case has been in BALCA since JUNE 2012. Honestly I didn't know about this forum and cts GC process on/before 2012 when joined this company @onsite.

If one have good enough time on their H1 i.e atleast 2 year left on current H1, they try outside world and be happy..:)

You are aware about CTS filling process and you can see this thread. now you are asking our opinion to JOIN CTS or not..? Don't know.! I am not discourage you, but take wise decision so that...

I joined here when I have 2 years period left my H1 and now struck, my case went audit & then denied later. now I don't have my H1 to go out of CTS and just gt my 8th yr ext based on my PERM pending with DOL.! I couldn't realized or nobody didn't tell nor aware of this forum until recently..now what to do..:) All my junior left India whose PERM got audit and went denied in june 2012 batch..

Partially correct, I think doesn't matter you are M or below, I joined as SA and submitted after 6 months and got approved by Manager, as long as your manager approves, good to go..!

Regarding filing PERM, that depends on Immigration team mind set or Statistics for that year..! Some time they files Jan or June or Oct..God knows..:)

Did you observed this forum or other CTS forum for 2012 audit, how many CTS guys left US and joined offshore, bcz of CTS process or audit rate compared to past history. You know 700 guys went audit & denied stage including me. WISE decision just find project & process GC with Consultant.

Well, here is my situation -
PD - 4-sep -2012 ( in my H1 6th year)
Audited - 13-Nov-2012 , replied in same month
Applied for H1 extension in Sep 2013 based on PERM pending, somehow got 3 years of extension in stead of 1(it is stamped as well), I don't know how, neither my immigration team.
Got email from immigration, that my application has been chosen for supervised recruitment and they are going to respond to that.
I am sure employer is responding as they want to save themselves from future SA.
What is the best option for me here, should I wait, or change my employer, moreover can I change employer. I am directionless here. Can someone please put some light. Any help is great.

If you gets receipt number and pending with USCIS you can stay beyond your current I-94 expiry date, but meanwhile get more info and follow up with immigration team daily, create a ticket and re-open as many time as you can, so that will escalated to Sr. level

One more thing, if you can provide proof of your DRIVING LICENSE expiry copy to immigration team, they can filed through PREMIUM process, I did recently same.

I also tried this option and spoke with few consultant, one consultant told me to do a H1 transfer(i.e your 7th year which you got based pending LABOR, not regular 6 year H1-B period) to new Employer should have proof of PERM which was filled through CTS, pls check with your new employer.
1). You will get 1 year
2). 1 year will be sufficient, but risk at other end always. One of my close friend filled his PERM Feb'13 with current I-94 expiry on 1st week of Dec'13 and his PERM got approved 3rd week of Nov'13, later got approved I-140, happy, but riskkkkk..!
4). Don't believe CTS.,
5). I think we will get 1 year and keep on gets 1 year until final decision comes from DOL for 2012 June batch.

Anybody applied for 8th year extension(i.e 2nd time H1-B extension based on PERM pending, which was denied & with BALCA after re-appeal for JUNE 2012 Batch). I got my 7th year extension 6 months back and now I am planning another year i.e 8th year extension.
