Topic: i94 extension after Passport renewal.

My indian passport expires in Jan 2015. I renewed my passport recently and got a new passport. My h1b visa is valid till jan 2016 and I have it stamped in my old passport. My i94 expires on the same date as my old passport i.e Jan 2015. How can I renew/extend my i94 after it expires? Or should I just leave it as it is till I leave USA and enter back again? Can someone help me out with this?

Topic: can 2 companies process h1b transfer at the same time?

I got 2 offers, the first offer i signed a few weeks back,I got a second offer which I am interested in taking. The first offer has already initiated the h1b transfer in regular processing and I have not got the receipt. Second offer is planning to do the h1b transfer in premium processing?

Will i run into any issues/Conflicts?

Topic: h1b transfer question

Well the setup is like this. We went through this company to mainly get a H1B. She began working for company A from the 1st of Nov. But since she had not got the client yet they din't pay her initially. They began paying her from 28th of Dec. So her first paystub is for the period of 15-31st Dec but is just for 3 days. After that she has been paid properly on time. Now she has got a new job and that company has asked for 3 paystubs for the H1B transfer. She has 2 proper paystubs and 1 paystub which is for 3 days.

What I wanted to know is if the 3 day paystub will be acceptable to USCIS. ? The starting date for her current job is 1st Nov. Will the fact that her paystub starts from 28th Dec affect her H1b transfer?

Topic: h1b transfer question

My wife is about to transfer her h1b from Company A to Company B. Company B is asking for 3 paystubs to do the transfer.

Company A had given the first pay check that was for 3 days but pay period in the paystub is for 15 days.

Can that be considered as a paystub?

Please advice

Topic: LCA processing time after shutdown

I did speak to my lawyer today,he said the iCERT website is still down and for some reasons when they are trying to submit the LCAs the application is getting kicked out and it looks like DOL is aware of this issue and they are working on a fix.

Have any one filed the LCAs this week?

I think it will be done before that. Jan 1st week would be a safe bet. I am also in the same boat...

I believe they do not follow a specific order. They randomly pick applications for the month and process them.

Topic: Does providing the documents asked in a RFE guarantee H1b ?

Thanks for the response. In my case what they have asked for is proof that i have maintained legal presence. Does that mean that they are ok with the rest of the documents i sent and this was their only concern? or is it possible that they might reject my application saying for eg that they don't think i am qualified or something even though they have not asked me any additional proof regarding that?

Topic: Does providing the documents asked in a RFE guarantee H1b ?

I am currently on an H4 visa and applied for my H1B this year and got through the lottery.

My H4 had expired in June this year and I got it extended and have an I-797 valid till 2016.

I got a RFE for my H1b application asking me for evidence that I am maintaining my legal status till I get my H1b. I will be submitting my I-797 as proof.

I wanted to know if this means that I will definitely get my H1B if I give them the documents or is it possible that they might still reject my case on some other grounds? Does an RFE mean that if you give them what they ask they will definitely consider it or can they still deny your visa?
