Topic: H4 to H1B COS

Hello Experts,

I have a question about filing H1B COS. I am currently on H4, I was on H1B until Nov 2017. I got my H1B extension denied in Nov 2017. I completed 5 years and 10 months on H1B and also having I140 approved.

I am now trying to apply for H1B (H4 to H1B COS). I believe I come under CAP exemption but not sure when to apply. Should I wait till October 1, 2018 to activate my H1B or I can apply at any time for H1B COS and get it activated immediately?

Is there any deadline to apply for H1B COS if my previous petition was expired? Should I file H1B COS with consular processing? Please advise

I apologize, correcting point #2. I was similar situation before. Take others opinion also.

1. Renewal is in progress. You may not have new passport number yet. correct?
Using current passport number is only option. If you have new passport on your return verify/update airline on your new passport info.

2. Assuming the possibility, you had visa stamp already till 2019 and your passport expiry is till 2018. On your return to US, at POE they may (mostly) issue I-94 only till your passport expiry. Once you get the new passport in US and your I-94 is till your old passport expiry, either you need visa extension/transfer which updates I-94 or Exit US and re-enter to get new I-94 again. I-94 will NOT be updated when inside USA at any deferred action/correction offices/airports. In my case, I had a change of employer which took care of it. Few others I know walked across border Mex and returned successfully.

3. No stamping required again. You got the stamping already. It is all about I-94 Validity.

@gdsdf, Attorney mentioned in previous years they have usually received hints from USCIS in some or the other way about resuming premium processing. This year it's different, nothing heard about it and also mentioned they it may not be resumed in near future. He used the word untouched subject referring to PP and H4 EAD verdict also. This is the response received when paid for attorneys time. Looking at the trend of resuming it phase by phase, we can hope it resumes sooner and helps a lot of folks.

Per attorney. Resuming H1 for remaining H1 is untouched for now.

As we saw PP resumed phase by phase medical staff, Non Profit petitioners and recently for new cap. We can only hope for PP soon for the rest.

Once I receive the receipt, does the notice/received date on the receipt notice date back to day USCIS received package/cheque en cashed date? Is it up to USCIS discretion?

Thank you for the info. Yes, USCIS received package before 60 days grace period. It has been a week since the package received but no receipt yet. There is no paper notification or online notification to attorney as of now, cheque is not encashed yet. However other x-colleague received receipt notice within 2 days of USCIS receipt, applied to the VSC and that application is filed days after mine was filed. I'm not sure if it actually works on a first come first serve basis.

Question: Once I receive the receipt, does the notice/received date on the receipt notice date back to day USCIS received package/cheque en cashed date? Is it up to USCIS discretion? Any repercussions in future if the notice date issued falls after 60 days grace period and i have already started working from package received date?

Urgent help needed. H1 application sent to Vermont.

I lost my job on H1. I'm in my grace period of 60 days. I got a new Job offer meanwhile and on my 53rd day of grace period, H1 transfer is filed and package is received by USCIS on 54th day. I have already crossed 60 days of grace period now and I HAVE NOT received the H1 RECEIPT NUMBER/NOTICE yet, per my new employer.

1) Is my stay in US legally valid now, since there's no receipt number yet?
2) How long does it take to get the H1 receipt number once USCIS receives the package?

Thanks so much for your opinions in advance.
