Topic: EAD and H4 visa ???

I got the advise from lawyers that - prefer to maintain the H4 status as long as primary applicant maintains the H1 (non-immigrant status). By using EAD dependent won't lost his/her H4 status.

You have to consider following trade offs to choose
1. H4 re-entry:
If H4 visa stamp is not valid in the passport, then you have to go US consulate at India for Visa stamping, here they may (very less possibility) get RFE (like adminstrative processing for data validation / confirmation) this may delay your return travel.
2. Advance Parole re-entry:
She/he can't move out of the country without valid advance parole.
She/he has to depart from country once they received the denied notice on I-485 and again re-enter using H4.

we were with same situation and we took H4 re-entry and my wife continuing her job after re-entry on H4 using EAD, for stamping in DS-160 H4 we mentioned that as working. we haven't got any issues in visa stamping and re-entry.

If you are planning of moving to CTS offshore for 1 year only to get EB1 Green Card, then think couple of times - Explore what all options you have to take controller on this return, therwise it may take 1, 2, 3.....years (God Knows) to come back

Corporate companies won't work as per employee needs they work as per organization needs. Just they will try to help you if possible like mutual needs are met (they have requirement and no resource available like bla, bla....), so in that criteria some people might be lucky enough to get back to US and roll the ball as they wished, but it wont work for all the folks.

Topic: Does H4 expire while working on EAD

If the spouse working on EAD turns into current immigration status as "AOS" or "Parole", what happens to depedent children (age less than 21 yrs) and who (children's) are not working. Is the dependent children can remain on H4? Why I am asking this question is in children H4 approval notice it shows spouse name as applicant and dependent children as beneficiary and the applicant itself no more on H4.

Topic: H4 Visa Stamping for spouse while spouse EAD is in USE

We received H1 & H4 extension (to re-enter to USA these needs to be get VISA stamped at US consulate out side of USA), and after that we received EAD/AP (I-485 Pending). Still I am (primary applicant) in H1 and haven't used EAD/AP, but my wife started using EAD for fultime job.

Now my wife is travelling to India, does she has to get stamping of H4 at US consulate for re-entry to USA or she has to use Advance Parole for re-entry?

If she enters in to USA on H4 - I 94 Is the current EAD will be valid to continue her Job?

And we are planning to apply EAD extension before her travel to India, Is this travel makes any issues on her EAD extension (mean any override of Renewed EAD with re-entry)?

Please help me with answers to above queries.
