I think the labor approved certificate is valid for only 6-7 months. they have to file I-140 before that validity that else that labor certificate is not valid...

Should the new employer B file the extension based on pending perm of employer A for transfer?

My current extension petition is valid till Aug 2016(past 6 years max out) based on pending perm. My PD is Nov 2013. My 6 years max out is Aug 2015.If i do a transfer to another employer any idea till what time can the extension be done? Will it be only till Aug 2015 or till Aug 2016?

As Raj requested , if you could share your denial reason for your application it would help others.

If we see DOL website majority of the denial cases for these applications seems to be falling under the category wherein the job description is not supportive of the PERM application submitted.

I have seen denial documents from DOL site wherein they have responded with supportive documents for incorrect position rather than what was asked.

Sometime i see the denials reason being not providing the correct response for the DOL Audit Query in the first place.

Whenever DOL raises a Audit it gives a fair first chance for the employer to respond with correct set of supportive documents to answer the query. If the employer tries to fool around and respond with incorrect documents/answers, these cases are denied 100% with no exceptions.This is one of the criteria for PERM denial. Immediately those cases will be sent to BALCA if Employer tries to re-appeal the denial.

This answers the reason for denials going around here.

First thing is there is no proper documentation maintained pertaining to each employee application.
Response is done generically which will not support all the PERM application as each job description/experience/role/salary/skillset is different for each employee. Looks like mass denial will happen when mass filing is done.

As per BALCA stats which you can see in DOL site, the % of approval is very very very low once the case is in BALCA.

One good thing you can take from that is you can continue staying for 2-3 years until BALCA responds.

You can try checking with good immigration attorney if you can change jobs on 7th,8th years on pending PERM.

But what i noticed is no good reputed employers are willing to proceed to hire these kind of cases.

Only very small consulting/contracting companies are willing to take these kind of cases with 100 conditions.

Good reputed employers are preferring resources with atleast 2-3 years H1 validity or atleast I-140 should be approved.

People who have done their 7th year extension , you can go and see the I-129 form filed and it shows a screenshot from DOL site showing your perm application # with "In Progress" status. I think this is done to request for 1 year extension with USCIS based on pending perm.

I still believe these cases could be in audit and not yet told to the employer from DOL.

It is not true..There are folks in my division whom PERM was filed this year. 1 of them will have 6 year H1 max out by Feb ,2015.

Other guy had 3-4 years still left in his H1.

As far as i know they did file applications this year, but very minimal compared to 2013.

Looks like they are doing case to case basis.

As ETA9089 responded, if your perm is denied past 6 years you are eligible to stay till your more recent petition expiry date hoping an extension was filed based on pending perm earlier(365 day rule).

Meanwhile if the employer files for an appeal, it will go for a BALCA and it would take more than 2-3 years to come a conclusion. So again till BALCA arrives at a conclusion you will get 1 year extension for each extension filing.

I doubt the accuracy of this statement that was provided to you that "that the PERM applications are now expected to take 1 year to 18 months".

How about for folks for Jan 2013 audit cases who are still waiting.. For them it is going to be near to 2 years with no updates....

If denied and if employer is willing to pursue further on the denied application they can appeal the denial and the Case will be sent to BALCA court and will stay there for 1-3 years to give the final denial(which is most likely) as cases sent to BALCA are lined up mostly for denial.Based on stats rarely BALCA court will overturn the denial decision. You will keep extending the petition till BALCA gives the final verdict.

(OR)

If employer is not willing to pursue further the denial, you can stay till your petition expiry date and leave the country.

(OR)

Later the same employer can file another PERM which most the cases are getting in audit ,if PERM is filed with the same employer for the same applicant for the same designation/role. Not sure if filed under different role/category it escapes audit.
But based on history either way the % of audit/denial is 99% these days filed here.

Best option is to file GC elsewhere if your priority is GC. Before joining/filing at any other place check the history of them if they have good approval rating and decide..
