Mine filed in normal processing on 05/06...

in my case 8 business days to get the CIS submission..! for normal processing it will take 3-5 weeks to get reciept...

Not much dicussion... jst got confirmation that can continue to do H1 extensions without I-140.. as earlier GSD tickets said otherwise..!

looking at I-140 tracker., normal processing appears to be taking 6-7 months...! I guess its jst one more wait again..!

One good thing is we can pursue H1B extensions based on approved PERM and anyway even after I-140 approval most ppl are getting 1 year extensions only even though you are eligible for 3 years...

Same case with me.. in my 8th year and due to file for an extension next month... Interestingly GSD case said you must need I-140 and PERM approval means nothing... Case manager shot it down and confirmed that with approved PERM you can initiate 1 year extension and I-140 filing is not required... so normal processing for I-140 as I file H1 extension..!

I can get the PP approval for I-140 but thought it is safe to get 1 year extension with approved PERM first as though very small but I-140 still has a risk...! My PERM wait days has made me so skeptical :-?

Question:
Can you file H1B extension with just approved PERM even when the PERM was not filed 365 days before max-out.

I am getting mixed responses on web.. I am due to file extension in June. My case manager confirms 365 day rule does not apply when PERM is approved and they will proceed for I-140 in regular mode..

Any inputs?

My PERM is not filed 365 before maxout but My case manager told me that post PERM approval that rule is not required... as long as it has been 365 days since your PERM filed then you can apply 1 yr extension without I-140...

so they are doing it in regular mode for me and sure for as many as possible.....

reply frm case manager doesnt look promising on PP... says H1B extension can be filed in 1 yr increment with approved PERM and without I-140 filed... I-140 approval is not necessary to file for a post max-out extension and also does not gaurentee a 3 yr extension...
