My last H-1B extension was processed Nunc Pro Tunc. I will be going for H-1B Visa Stamping.
1. Do I need to get any document from the company indicating the Nunc Pro Tunc approval of my H-1B Extension?
2. My attorney is telling that my approval notice should be enough to indicate the consulate that USCIS approved my last H-1B extension Nunc Pro Tunc. Is it correct?
3. What documents should I carry for H-1B Visa Stamping?

Topic: H1 Petition revoked by mistake; Nunc Pro Tunc Petition
My employer revoked my existing H-1B petition by mistake in place of some one who had the same first and last name and left the firm last year. My employer came to know about it when USCIS raised an RFE on my H-1B extension application mentioning that my existing petition was already revoked at employer's request. My employer's attorney is planning to submit a Nunc Pro Tunc petition to USCIS with details about the inadvertent mistake from the employer and request to grant me H-1B extension on Nunc Pro Tunc basis. My LCA has not been revoked. The attorney have also asked me to provide an affidavit citing the personal (humanitarian) aspect of my case and US connections. I also traveled to Canada last year for one week and re-entered US on my existing H-1b Petition. I was issued a I-94 at the port of entry last year that was valid until the expiration date of my existing petition. My attorney is going to mention this fact as well in my affidavit.
Has anyone faced this kind of situation? How amenable USCIS is to accepting such requests? |

Evidence that two people with the same name exist in your company. Copy of the revoke letter. Proof that you are still getting paid etc. Your lawyer should know

My employer revoked my H-1B by mistake instead of someone else who had left the same and have the same name as mine. They found out from USCIS while my H-1B extension application was being processed by USCIS. My employer is going to admit their mistake with USCIS and request USCIS to approve my H-1B.
Has anyone else been through this kind of situation? Will USCIS approve my H-1B extension? Appreciate your feedback. |

I think your lawyer can reach out to DOL to find out where your application stands. Sometimes lawyers do not want to spend any time to look into it. Once DOL website starts showing April/May as PERM processing month, you may ask your lawyer to provide you the detailed status. You might want to make sure DOL is not waiting for any inputs from your lawyer. |

My lawyer is just throwing "no update yet..; March is still being processed" cliches at me. Are you guys also hearing the same from your lawyers?
Is there a way to push our lawyers to get more information on our applications, probably by reaching out to DOL and making sure that DOL is not waiting for any information from our end? |

where do you get information that 100% of March is processed ?
Sorry for the confusion. I was saying if 100% of March were processed, could we have our Attorney reach out to DOL asking for status specific to our application. I am hoping that it does not come to that point and all of us get our Labor before that. Keep fingers cross at the point. |
