If I moved out of USA and my H1 sponsor company ABC withdraw H1. I do have green card in progress with approved I140.

In case my date become current , Is it possible for ABC to apply for my EAD while I am not working for them and in India.

Thanks a lot. Here is what I think is best in my situation.

Go to India and still work for USA client remotely (if they allow :-)). Join India branch of US employer and get paid in Rs.
H1 Employer update USCIS about my relocation to India and don’t withdraw H1.

Come back USA after 1 year with same US employer.

Do you suggest any alternative plan?

Thanks a lot, while I am making a very important decision.

1, if I go back to India and join US employer's India branch, in this case, do they still have to withdraw if they go by rule?

2, In case my current US client allow working from India remotely for 12 months, do my H1 employer needs to notify USCIS that I am not in USA and withdraw H1? Does it matter if I get paid in India or USA?

If I go to India for 1 year, and joined a new company in India. In case my US H1 employer, doesn’t withdraw H1, Can I come back on USA after 1 years or so using my H1 and rejoin H1 employer in USA?

If yes, in above situation, Do I need to file h1b amendment after coming USA and joining a new project/client? Is there require US employer current/pass 2-3 months’ pay stubs? (in this case I won’t have it)

I am on H1-B with 9 years of stay already in USA and having approved I140 in EB2. Recently got 3 years extension till 2020 based on I140.
1, For family reasons If I go back to India in 2018 and stop working for US h1 sponsored employer, will my H1 till 2020 will be cancel once I am in India?
2, if somehow I continue working for US H1 sponsored employer from India, will my H1 till 2020 will be valid and I can reenter US in 2020? Assuming I get a visa stamping done.
3, Will approved I 1410, is it possible to apply H1 extension while you are in India? If yes, what’s risk factors?

Hi, I applied I140 in EB3 in May 2016 at Texas center and so far USCIS status is Case Received.

1, What is time line for I140 approval ?
2, Can I raise a SR or anything else to speed up my I140 as its already pending for 10 months now?

My 2017 contract with same client is usually done around 31st Dec. Can interviewer asked me why you still not have 2017 contract? If ask, what should be answer ?

When I checked 1 month back it was showing 80 days. Is this changed ? What dates are available for Dec. /Jan at Mumbai ?

I and my spouse are going to Mumbai for H1-B stamping and we are having a 3 years US Born toddler.

- Does Mumbai consulate allow toddlers for finger print and visa interview appointments?

- Is there a rule which says it’s allowed or do I need to take permission somehow, Once again this is for Mumbai?

I forgot to mentioned that my H1 stamp is already expired, still I can enter in USA in March for which I use 797 from July 2017-2020 for visa stamping?

Is there a way to know in advance if consulate will allow I797 effective on July 2017 in March 2017?

Sorry my friend, I am not clear.

Question is if I use July 2017 to July 2020 new 797 and go for stamping in March 2017(if they allow).

1, Will they print visa stamp expiry date as July 2020 or March 2020?
2, Can I use that visa stamp to enter in USA in March (asking as 797 used for stamping is for July 2017 to July 2020). I do have current 797 till July 2017.
