Exactly what I thought about my case..and what I felt that I am not out of status at any point in time and none of the status is illegal etc..as my first case is still pending which was applied in oct of last year almost 5 months before my i-94 was going to expire.. My new employer's attorney office contacted USICS as soon as they got the hard copy as i797b instead of i797a and USCIS finally fixed it and we got the new approval notice yesterday with i-94 same dates that were mentioned in email or i797b, though and not back dated to Jan 29th.. but I think that is ok..

This was a real pain and a miracle .. as I was ready to leave and get back to US with stamping done..Thankful to Almighty for getting me out finally out of this mess, I have been into since oct last year..

Thanks all for all the help.. as I did ask other questions etc on different threads here..

Lessons learnt:
- Never let i-94 expire ( if you i94 is going to expire soon have a new transfer application applied as soon as possible if you find a new employer that soon )
- Always apply extension in Premium from the get go ( may apply only to me, this was my third extension and this was the first time I applied in Regular the other 2 times I did in Premium )

Hi All -

Sorry this is going to be a lengthy one.

Have few questions regarding an H1 B transfer approval that was done recently for me.

I had to transfer to another company as my previous employers H1 Extension went into Security check and it was just taking awful amount of time ( Applied in Oct 2015 as regular and converted to Premium in first week of Jan 2016 as my i-94 was expiring in Jan 2016, end of month ) and I gave up on this extension to come out as approved and it is actually still pending adjudication ( as many folks who ran into security check were doing transfers and getting it approved, I went that route too ) and applied for a transfer from another employer as a direct hire no layers.

This transfer was applied before the 240 days of previous employers i-94 expiry ( end of Aug 2016 was the transfer initiated ) and I started to work with the new employer from Sep when we got RFE and I was 2 weeks away from reaching 240 days of i-94 expiry, the new companies attorney said I can work based on AC-21 rule or something...anyways the transfer got RFE asking for legal status and legal stay in USA etc and everything was sent to USCIS and it got approved in the next 2 weeks and email notification showed validity for I-94 dates as below:

10/19/16 as start date and expiry as 02/04/19 for the same i-94 number which I got the very first time when I came to USA for my Masters in 2007. I have been waiting for the hard copy as my attorney was saying sometimes the hard copy differs from the email approval notification and we just got it 2 days back..

My concerns / questions are:

1.
As my previous i-94 had date of Jan 2016 as end of validity wasn't the new i-94 should have been issued from 1st Feb 2016 ? this gap in i-94 is an issue? I spoke to company attorney and another attorney who is famous in immigration local to my area and they said it is a non issue , as USCIS has all the receipts and i-129 timely filing with them

2.
The hard copy we got from USCIS does not contain i-94 and it shows as consular processing is what my attorney was saying.. can the email notification which had i-94 dates in it and hard copy differ, is this possible ? or is it an error on USCIS which can be corrected ?

Attorney said they are going to send justification to USCIS so the correction on the hard copy approval can be changed and get a new one with proper i-94 dates on it.. again is it possible to get it corrected and will it get corrected ?

3.
Do I have to leave the country straight away for stamping or wait for the change that USCIS is going to do on hard copy approval ? Can I continue to work for my employer ?

Thanks for reading and being patient. Appreciate help from experts here.. I have appointments set with company and outside attorney's but it is not until next week I can talk to them so wanted to get any expert opinions and suggestions from here.

My initial extension case is still pending.. I did a transfer and it is approved just few days back.. its a pain.. if your i-94 is not expired have a transfer applied as soon as possible even if expires try to have an application out as soon as possible.. by now you must have googled about security check and most of cases online in many forums people are reporting that they did a transfer and it gets approved and never bother about the first case.. one one guys case online who updated I saw said was approved.. most others transferred or changed employer. so no one can actually predict if the security check stuck case result will come out soon or never... i waited for almost more than 9 months while my other employer was preparing to file for me and it just took lot of time from the new employer to file so I was ok with the wait.. I wanted to stay with the first employer as my i-140 etc are already approved with them.. anyways.. all the best and decide by yourself.. my suggestion don't let the i-94 get expired .. and apply for a transfer..

If one's H1 extension or transfer gets approved and approval letter is I-797B ..

1.
The candidate has to leave USA immediately once they receive the hard copy from USCIS / Employer ?

2.
I think there is no time allowed to stay in USA to book interview date in home country when it is available or to any other country out of US like Mexico ?

3.
If the candidate leaves within week of receiving the original I-797B, and the i-94 was expired how to justify at consulate about the stay after i-94 expiry say if the decision from USCIS comes late but falls within the 240 day stay after i-94 expiry. Does it make us out of state or illegal for the stay from i-94 expiry to decision date from USCIS with an approval of I-797B .

which Service Center ?

H-1 Extension applied in April 2015 ? Did you change it to Premium ? How did you know that case is in Security Check Since 4 months to be exact ? When did your wives i-94 expire ? Did she get any 221(g) in the past ?

My case is also in Security Check .. applied for H-1 Extension Oct 2015 upgraded to Premium in Jan 2016 .. after 20 days of Premium time frame came to know from USCIS Premium Help line that case is in Security Check.. called many times got different answers one representative said case in Security Check Since Oct .. one said since Dec .. going to wait for 2 more months and go for transfer as that is what some of the other forums suggested worked for people stuck in Security Check.. i-94 expired Jan 28.

What is the app name ? and are you putting some random number from here close enough to your case into tracker which will get in 500 cases after that case number to be monitored ?

on Andriod I downloaded 2 apps USCISApp & USCIS Case Status... but didn't see anywhere mentioned about track some n number of cases.. are you manually adding cases to the app to track or there is a tracker which generate n number of cases after the first case entered to track ?

Case changed to Premium Jan 12.. but came to know after 20 days of no response from premium that case is in Security Check..still waiting

Thank You user rsc3c for your response. so the SR was the reason the looked into the case and approved it within 60 days of SR was opened.

Any clue about ...What is the date from applying for I-129 can one open a SR ? Will the date be same if the case was made a premium say after few months of the case being Regular Case ? or the SR open date also gets pushed and new date to open SR starts from the new Receipt we get from Premium ?

I went to India when I went for H-1 stamping my friends and family members suggested go to Canada as in 2013 I think Canada was good to get visa or stamping done quickly.. but I just wanted to face whatever it is and be in India... Almighty helped me and the 221(g) processing finished within 1 month...

It is totally up to you where you want to go for stamping.. getting or not getting any color slip is totally an unexpected thing...I believe people who went to Canada or any other country also got some kind of paper and the only thing is sometimes the processing from these countries is a little faster than from India is what I think is happening...

Check the current trend not sure which forum or thread it is.. where people are discussing about it..as to where it is easier to get stamping done and if there is any bad/good trend if you go for stamping to India or the state close to your home town where you have to go for stamping..

Completely unrelated question.. need input from you guys please... I am still waiting on my extension to get approved but wanted to check if my dependent need to get I-539 from here in USA ( they are already in India )? I think they just need to fill up form I-539 and use a copy of my approval and go for stamping will get them H-4 right and don't need approved I-539 from USA ? its been a long time and just want to confirm ?

Hi

Got my License renewed today.. I was getting a bit worried as I didn't see any updated until yesterday evening..and then again I checked it late in evening around 7 PM and it was coming up as Returned to Agency .. Called in the morning around 7:45 AM representative picks up after 20 min hold and says she still sees it as not approved .. I was too sleepy.. I just slept and called back again around 10 or 11 AM and representative said it is approved till Sep end can go and get it from local DMV. A bit of relief when she said it was approved unlike the morning representative who was saying it is still under Review.. :(

Not sure how they calculate these temporary dates.. I mean the second representative was saying as you status expires in Sep it is only being given till Sep end.. and I-140 never expires.. I think it is just temporary time which USCIS gives to candidates and moves it ahead if required.. anyways hope the extension approval comes soon..

For people who have to call multiple times or even for the first time if you don't want to listen to all the Krap and want to get a representative on the line.. then after you dial the number (512) 424-2600 provided by user krishere1982 just enter on your phone keypad 3 ; 6 ; 1 ; 2 ; 0 after say every 3 or 5 seconds gap and you will just be kept on wait to talk with representative and don't have to listen to the automated thing every time.. as I had to call twice I just remembered it first time..

Well one would expect logically that as they did the checks earlier they should just do the next checks after the dates which show them as not being cleared.. unless something is changing in the process every time which requires the checks to be done from scratch or may be they don't care about previous results and just do it from scratch again :(

Well when I first got this 221(g) crap since then I knew for sure this is going to happen to me every time.. as my name is a Muslim name and seems it is getting flagged on their database of name checks..

Hope this gets cleared soon.. is all I can say and think for now..

My SAVE process is under review.. its been only 2 full business days since I went to DMV.. so I think I might know something about it either by today EOD or early Wednesday.. is what I am hoping.. and hope to get a positive result out of it..

Yes when I was coming to US for first time on F-1 this Security Check was done.. not sure if it is same or anything changed.. it was called name check then or something like that and they would just say to the candidate that Additional Processing ( AP ) is required or is being done on the candidate and they hand over 221(g) white slip.. which I believe is still going on in India when you go for stamping.. there are few other colors and each color has some different reasons white usually means AP.. and my guess is correct this is a Name Check or Security Check.. and this is a random thing say if your name when they input it to check across the databases of names they ( US Govt or USCIS etc ) have raises a flag.. i.e., someone who has similar name as yours had criminal background etc it causes the application to go under AP .. so they can verify if you are that person .. which is kind of frustrating to a legit guy who has no criminal background yet his case goes under processing and delays his/her approval for this case..because his name is similar to someone who is a criminal... not sure when this additional processing started probably more intense since 9/11 and in the beginning I just used to think it is mainly on Muslim Names.. but many people from other religions too started to get 221(g) :(

My name is a Muslim name so I believe that is why it is under Security Check or Name Check.. the second time I went to India when I had gone there for my H-1 stamping again I got 221(g) white slip.. but this time the processing completed within a month.. and it was in 2013.. I thought as they already did it once in 2007 which took 6 months this time it went quickly.. but it was never done while I was in USA ...so now its been almost near to ~5 months, as my application was filed in Oct first week and one of the representative was saying Security Check started within 15 or 20 days of filing the case...so it is definitely taking longer than what I am guessing and the previous checks are not helping in any way to speed this process.. probably they added few more checks and as they are doing it from US this time it is longer time.. I am not sure if it is totally different than what they do when we go for stamping.. but for sure when it is Name Check or Security Check it means your background and history is checked here in USA and everything you did back home .. like mostly looking for any kind of criminal activities the person was involved in..I have no criminal records or any offenses.. :) lets see when this gets cleared up.. I am waiting patiently for approval if not proceed with other options come June or July..
