Topic: H4 EAD Revocation rule

With the new rule coming up in Feb 2018, do you think they might actually go for making it stricter, rather than removing it completely by adding min salary requirement and/or STEM criteria? I realize it may be far fetched but these, if I remember correctly, were some of the criteria being considered in 2014/2015 when the H4 EAD rule was being discussed.

(PS. I know DHS announced agenda to rescind the rule, but that doesn't mean they have to do it.)

Exactly! The language!

DHS likes to keep H4 EAD folks in limbo and in stress. So, they have, yet again, provided a very ambiguous response.

I like to look at DACA as an example. It was announced to be repealed *6 months* later because of the pressure from GOP senators. But very cleverly, the Govt said "they will look into it, if congress does not fix it in 6 months". It was a mass-apeasement move.

Even though H4 EAD does not have that big scale in terms of awaareness among general population, I feel (or rather hope) this is just another gimmick. [Also, H4 EAD is much much more legal/ethical than DACA!]

Yes, that is what I have been asking around. The language is ambiguous - so removing "Certain spouse of h1B" looks like restricting to limited set. May be limiting to STEM, or some min hourly wage - something along the lines of versions before original rule was proposed.

That's not true. Govt cannot just remove H4 EAD rule overnight by some EO. First they will need to follow rule making process (draft, comment period, final decision etc). So, HYPOTHETICALLY if what IV is saying is true, then H4 EAD will continue until the final rule to rescind H4 EAD comes out.

In this conference call, they claim that they know this from 1:1 (off the record) conversations with people from new administration. They also claim that H4 EAD will follow same path as the entrepreneur visa rule.

Sure, IV sound arrogant in their reply. They seem to be over-exaggerating their usefulness in H4 EAD case. However, they are probably closest to the case - they are involved in the court as well. Such stupid behaviour on their part still doesn't take away the fact that know the details of this case more than other lawyers.

So, I don't who is more reliable : an arrogant/narcissist organization yet closest on H4 EAD case or normally behaving regular lawyers :)

I am not sure. But this statement by IV "We believe, if it weren't for our Motion to intervene, everyone currently working on the H4-EAD work permit would suddenly have lost the ability to work on April 3rd 2017." make them sound very pompous and ridiculous. You can see the first 30 minutes of this video for a detailed analysis of what could be the possibilities with this ongoing lawsuit.

This call happened on march 9th and he clearly states if anything should happen, it will take a long time to change and absolutely nothing will change on April 3rd. I feel IV is pretending to be the saviors here. Nothing more.



Logically speaking, what this lawyer (Rajeev khanna) and others (Reddy & Neumann) etc are saying, makes sense that the case is somewhat lacking logic and ground. Its just that the organization (IV), which is probably closest to the H4 EAD case (or self claiming to be the closes), seem to be saying the opposite.

Why does removal of H4-EAD have through rule making process??

I can understand if creating a benefit like H4EAD has to go through rule making, however, removing a benefit need not.

Is there any precedence where removing a work authorization benefit (or similar case) that has gone through the rule making process?



This has been clarified by multiple lawyers that if DHS decides to rescind H4 EAD rule, it has to go through the rule making process and not through an EO.

You can apply it concurrently with H1B... Traditionally, it has followed same timeline as the H1B application (i.e. H1B/H4 COS/H4 EAD gets approved altogether). However, there have been some exceptions recently.

Regardless of how you apply, your spouse has to stop working if EAD come not arrive in hand before H1B status expires.

But nobody from IV recanted the frustrated guy's words. And its not like they are presenting an opinion : they seem to be dead sure that the administration is hell bent on getting rid of EAD. That's what worries me....

Hi All,

I had check IV's post where they mentioned (with slight arrogance, I believe) that their intervention in the H4 EAD case prevented SaveJobs and DHS to settle out of court. In the comments, IV said they are sure that H4 EAD rule will be gone withing 6-12 months for sure. They were dead sure about it.

However, no other lawyer/article seems to suggest even remotely similar. Infact Reddy& Neuman (Emily from immigration Girl) mentioned that there are no such plans or indications shown by Trump administration. Her points also look logical (i.e. they dont need court case to do anything to H4 EAD, and also that H4 EAD is a much smaller fish to fry for the administration as compared to DACA/DAPA - which was even vocally advocated against by the administration). However, IV is working closer to this case (even involving themselves in the court, so I would imagine IV knows more).

At this point, I feel both the sides have logical points and IV is trying to unite everyone in supporting HR 392 (unfortunately, by discouraging H4 EAD users). What's your take on this?

PS. I am not talking about the rumours like leaked exec order etc bullshit. I am only worried since a reliable firm like IV is saying so.

I think you have to stay in US while your COS/EAD applications are pending. So you can't be staying in Vancouver when this happens.

Also, I think there is a restriction that you can only apply 6 months in advance i.e. you can only select future date of 6 months from now. (Need to confirm this). If it is right, then it wont help you since its taking longer than 6 months to approve COS applications, and its not easy to guarantee approval.

Other option you may have is to fly outside US and get H4 visa stamped and then come back and apply for EAD. Standalone EAD applications are faster (may be 1-2 months; best to check latest tracker cases)

Guys check this out : it looks somewhat of a good news. Any changes will require same rulemaking and cannot be done by court. My understanding is that making changes in H4 EAD through rulemaking will face a severe backlash by Congress/Senate, which makes it extremely difficult to change H4 EAD. Isn't it?

Apparently, GCLayaAya is now saying this was the shocking news (deferral request by DOJ/DHS). Sorry to say, it wasn't. Nice try correlating the two and trying to say "I said so"

Apart from that, trying to portray self as a professional politican who understands deep politics while belittling others by saying "you can't comprehend bigger agenda", I really don't think GCLayaAya has some credible news. By saying that "it is a bigger agenda and something is being planned by govt", we are just spreading fear (I feel desi folks are highly gullible when it comes to things like this)
