Company's Legal team is still advising against upgrading to premium. Based on the case details of recent approvals, I think I have a strong case..I think they are just giving the same general advice to everyone.

I have reported this to USCIS with the evidence I had. Hopefully, they will take necessary actions. I will be reporting this to DOL as well shortly.

Like I said, I work with this team very closely and the resume was sent to me directly. Yes, I have my job but I cannot close my eyes to something so blatantly obvious and deceitful as it affects the moral of the people working in that team and in my team. Folks in my team will probably start thinking that when it comes to hiring decisions even I will not be completely honest and will play favoritism.

Someone that was recently hired by a team that I know closely and work with has deceived his/her way in the team by doctoring his/her resume. This person has never directly worked for the prestigious US companies which are listed on his/her resume. In the resume, the person has deceitfully worded working for these US companies in such a way that it is hard to find out that they were actually the clients of the body shopping company(2 of which are from WITHCES) that he/she worked for. The deception is so obvious if you look at his/her resume carefully.

The hiring manager(also an Indian) who knew this person from a previous work setting conveniently decided to ignore all of this and brought him/her on board(obviously).

I have access to the actual resume and the email that this person sent to the hiring manager. In the email this person summarized his/her top competencies which included false statements about working directly for the US companies..this time without even playing with the words..just simply lied.

I am planning to report this to :
1) Company's internal ethics and compliance(anonymously so that I don't get in trouble).
2) Possibly to USCIS

What do you guys think?? please let me know..

I have been waiting for over 4 months to hear back on my H1B extension based on approved I-140..I know there are people in this forum who have been waiting for 5-6 months and are yet to hear back from the VSC.

I think I have a strong case(direct hire, non-IT, level 3 wage..relevant education from the US, got approved for H1-B extension till 2020 with my previous employer before changing jobs)..would it be wise to convert to PP now given the AC21 uncertainty going around?

Before pointing fingers at others, look at yourself. It could. However, I would say this - it could also cause startups to increase their offerings for the deserving candidates. I mean, If they see true potential in one's profile and are confidant about the value one can bring to their venture, they should be willing to up their game at least to a level where they can cross the threshold for immigration.

If implemented, it would be just another rule with false positives, exceptions and hit rates. Immigration is a complex issue, one rule cannot cover/satisfy the whole spectrum of requirements. That's why there must be multiple rules/qualification criterion..just like the proposed point based system(Age, education, salary..etc.)

Yeah..with that quality of reasoning, there is no question about that! :)

It's about putting an eligibility filter based on an applicant's(more specifically - an applicant's overall profile's) monetary value as perceived by the corporations. Although not perfect,this measure could be used as one of the indicators of one being bright/desirable/eligible to receive certain immigration benefits.

Brilliance/intelligence is a subjective measure - No system can scan one's mind and assess categorically how bright/dumb one is..they have to rely on yardsticks like these to assess these subjective measures.

So you can think in your own head how dumb/intelligent you are..it doesn't matter. In this case, It is about whether you can meet/exceed a certain threshold to be called "bright" for a specific eligibility.

I agree. I am not sure if you read my previous post carefully. I am completely against H1-B lottery or random allotment and I hate WITCHES for what they have done to the H1-B visa. I am all for Skill/Education/Merit/Salary based H1-B allotment.

BTW, I have never worked for any H1-B dependent company(or WITCHES) and I am in a non-IT field.

The intent of introducing H1-B was not COST CUTTING!! it was to bring/retain best talent from across the world to fill specific positions that US workers cannot fill. Do you think WITCHES file truckloads of H1-B petitions to bring premium talent to this country?? They just exploit it to offer cheap alternatives to companies to fill/replace low skilled jobs.

Yes, DT exploited a legal loophole in the tax system..IT WAS A LOOPHOLE..there.. I said it. That is not what we are discussing here though.

And not all WITCH employees are fraudsters..but it is not about fraud/not fraud it is about taking undue advantage of a system and putting others at disadvantage many of whom have a genuine case that is aligned with the original intent of H1-B.
