TY gcnov13 .

For my case where my perm was applied on May 31st 2014 during my 8th year extension (way after my max out) , the approval came thru on April 7th 2015. Based on what you have said , will i be eligible for a 1 year H1 extension without I140 approval - my current H1 expires in July? I asked my lawyer and he said i would not be eligible until I140 is approved but our company is giving very contradictory information (GSD said no but H1 case manager is saying i am) . Please advice.

If the new perm case is filed and is pending with DOL for 1 year before the 8th year extension expires(for example Perm case is filed June 2014 and 8th year extension is till July 2015) , would we not be eligible for a 1 year extension based on the new perm case being pending with DOL for 1 year?

Hey Everybody Need some advice and wise thoughts on my current situation. Desperate for help :(.

I am currently on my 7th year extension valid till July 2014 based on my Perm denial at DOL and pending with BALCA. I cracked interviews and my future employer is planning to transfer my H1 and has also agreed to file for my Greencard.

1) When the new employer transfers my H1 , will I get a 1 year extension or only till July 2014 (my current H1 validity)?
2) Assuming a 1 year extension, is it wise for me to think that the PWD(6 weeks ETA), the placing ad (1 month ETA), labor (8 months without Audit) and I140 can be approved before the 1 year timeframe?
3) My case was moved to BALCA in May 2013. Based on the current timeframe and assuming BALCA will deny my case, appx when I can I anticipate the BALCA decision?
4)CTS is willing to withdraw and reapply for a new GC but I have put a hold on this until I get my 8th year extn based on pending BALCA decision. Is this the safest and more importantly the wisest option for me?
5) For my 8th year extension , If I continue with CTS and assuming case is pending in BALCA and my 8th year extn is approved in March 2014, will I get my extension till July 2015 (my current H1 expires July 2014) or will I get only 1 year from the date the 8th year extension approval - ie till March 2015?

Please advice asap.

skr25 - They did the same thing for me and i also had approval for filing in Premium way ahead. I can't believe how irresponsible they can be. Good news is you get the reciept number in 5 business days as opposed to the 4 weeks they tell us. Once i got my reciept number i escalated to get it filed on the same day in Premium and they did it. We need to unfortunately push push push these guys to do thier work responsibly.

Hello Friends

I am currently applying for a H1 Not subject to Cap in Premium and getting the below error message when viewing status in the USCIS website.

•At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.


Has anyone got this? I called up the number but they need the Employer to authorize me so i've sent an email to my case manager. Any advice on what else i can do?

Hi

As far as i know and found out, your salary will remain the same if you return back within 6 months.In a worse case if the salary changes , you should be able to fight back to get the salary you recieved.I had a friend who had to go back to India last year but was out for 9 months and then came back and got a lesser salary - he fought to get back his original salary. Also this would depend on your LCA - they cannot give lesser than what is in your LCA. Have faith.

I am in the same situation as you. Let see if there is another fight in the waiting :). Can you tell if your H1 was processed in Premium and how many days it was approved? Any RFE?.

Did they file your extension in Premium or Regular. When did they file it?. Did you get an RFE or straight approval. Did you submit SOW with your petition? Thanks for your time in advance.
