Does CTS provide a copy of I140 approval once the I140 is approved. I came to know that they withhold the I140 approval from the employee. What if I need the I140 approval copy for applying H4 EAD for my spouse. Will I get it from CTS?

Is it true that GIT is not releasing the I140 receipt no for all the applicants with I140 approval? Any news on this. How much time is it taking for the GIT to apply the I140 if the PERm is approved

To answer your question I can give an example. One of my friend started his career at offshore on 29Sep 2007 and came to onsite on 29 Sep 2012, which means he started from India on 28th Sep 2012. His case has been filed in EB3. Seems they mean it when they say 5 years.

If you were SA for 1 year in offshore and have L1A visa you are eligible for EB1 as well. But this rule is per the book, not sure if this happens in real life.

I am planning to switch to an american bank and apply gc through them. My wife will then be able to work through them via H4. If this law suit succeeds we will be in a soup. Anybody has any idea if the injunction will be there before 26th May.

Where did you get this from? You mean the salary that they show in H1B petition is not what they pay out? Are you mad? They will be screwed up big time if they do that. There has to be parity. I heard that the difference between the deputation letter and H1B petition letter salary(if any) is considered as LCA pay and they will out that in 4 quarterly installments.

if anybody got any friends who has renewed their petition in Dec 2014 or later can find out this info.

I don't think that the pay structure is better. CTS pays around 10k lesser for a similar designation than Infy and at par with Wipro and TCS. They were violating DOL minimum wage criteria and still filling PERM for those persons. This might have put all the PERM on Hold. Now they are paying 80k for A level for people who are renewing their visa after Dec. when payroll is asked they are saying that this is the minimum wage as decided by DOL for your location. Hence we are including this as LCA pay. This might be an adjustment as suggested by DOL and this may help in PERM approval.

The minimum wage is as per DOL guidelines. They are aligning the pay structure as per the DOL guidelines. This can be a positive move and may help in PERM approval through DOL.

Not sure if you guys notices CTS is increasing the salary for all A and above associates who are submitting visa renewal petition post Dec 14. May be they want to clean their image infront of DOl and hence giving better pay. Hope we will start receiving approval because of this new pay structure.

Does anybody know the actual criteria for EB1? I read in the process doc that its 365 days of mangerial experience outside US and 365 days in US as an SA or above? Is this enrirely true or they have some hidden rules? If this is true I am planning to go back for a year and then come back to file EB1.

Well Said. H4 EAD rule is in final rule making process and is pending for OMB approval. This should be in existence this year. So no worries about that.

The second part about CTS changing the rule is absolutely possible. They can change the rule anytime because of the pending PERM application. Also I heard that for SA 1 year in 2 countries is no more valid. They are not giving EB1 for SA having the same criteria. They are also not providing any reason.

The US company is a obvious choice but you know what EB1 is a too much lucrative proposition and one has to think 100 times before not attempting to try for it. I am still getting pricked by the thorns of dilemma.

I have been considered for promotion to SA. I have an offer with an American bank with a lucrative package with green card processing. What should be the right decision for me as of now? Should I stay back in CTS and try for green card processing in EB1 by staying at onsite for one year and at offshore for another year and then again come back to onsite location or go with the American company?

Yes. You may be correct. I know few people who got their PERM filed through CTS when he has about 3 years remaining in his H1B. So now the question becomes if the PERM is rejected and I have tenure remaining in my H1B does my H1B become null and void. I got mixed opinion about this and cant find any info on any of the DOL sites.

I have H1b valid till 2019 Sept. If I apply for a green card through CTS it seems it will take years to get that processed. Do you have any idea if CTS files the PERM application at the end of the H1B tenure or they will file as soon as possible. In any case if my PERM is rejected will my current H1b be still valid or the visa status will also become null and void.
