If you have not reached the Max Out date, there is always an option to push your Max Out date, by working outside US for the number of Days. For EG: IF your new PERM is filed tomorrow, you may work outside US to make sure your Maxout date falls after 365 days from tomorrow. That way, you can still get your H1 extended. IfF you have already on 6+ years of H1, this will not workout.

GIT shoudl have sent a notification to those individuals. I got a notificaiton form them stating they indeed responded. It is a waste of time to fight with them. Good news is that they processed a new PERM for me immediately.

I got the Notice fr Docketing last year January. Got the same response from GIT when I approached them. The case was updated last friday 6/19/2015. I see 4 more cases listed in oalj as Decision made, but the desicion and documents are not posted yet. So far I'm the only one with OD status (Order of Dismisal - no response).

For thsoe who appiled the PERM in June 2012 and case went to BALCA, I'm one among them and BALCA dismissed my case stating the appeal was nto filed on time. Is there any one int he same batch as mine, please check your case status in oalj.dol.gov. You should have received an email from GIT as well....

I have got my 8th year extension till Nov 2015 based on perm pending in BALCA. Has anyone attempted to file a PERM with another employer and tried H1 transfer? Would there be enough time to make move?



You cannot transfer the H1 if the PERM is still pending. H1 transfer is possible only after I140 is approved. This is what some employers (desi Consultancy) have told me.

i am also looking for re-filing for June 12 case. Is anyone refiled and got success. I got an info from other thread that someone refiled and he got audit again. that means , we cant get success PERM approval for guys got audited once in CTS?




I have heard about one of my friend's friend who was part of the June 2012 batch (EB3), got his PERM filed thru a consultancy and approved (filed in EB2).

Please check your facts " None of the GC applications filed from cTS from 2012 have been approved in category 2 and 3. "

Check permchecker.com or visadoor.com for approval stats.... You can say they will go to audit but dont give blanket statements that none are approved



I'm one among those who filed in June 2012. I don't agree that None were approved. But a lot of them were rejected. Most of the Audited cases filed in June 2012 were rejected around April, May 2013 and have been appealed. If you look at oalj.dol.gov website, there are around 500 PERMs that went to BALCA for appeal in 2013 where as less than 50 went to BALCA in 2012 and previous years.

I'm at 9th year extention (submitted) based on pending pERM (mine is with BALCA after DOL rejection). If your perm is not approved, you cannot switch jobs.. because the Work Permit extension is based on the AC21 rule (PERM pending for more than 365 days). But if you switch jobs, this rule is no longer applicable and your WOrk Permit beomes void. THis is the answer I got from some employers. So, be careful and check twice.. event thrice before switching.

I recently got approval of 1 yr extn based on pending perm from offshore. Do you know if they will give the same salary in US that I was getting before (i.e 2 months back) coming back to India or will it be less? This company can do anything.

Pls. advise



I was in a similar situation. I was transferred to India to recapture 3 months and get 7th year H1 extension. When I came back, I got the same salary as before. In my case I was working in the same account all along. I don't know if that played a role here. But good thing is that the salary didn't change.

Maxout date : Nov 18th 2013
Perm applied : Jan 19th (Audit)
Need 2 months recapture

Have spoken with my account manager and he is not interested to leave for 2 months(asked for vacation /unpaid leave) now and return back and apply for extension as joined a new project recently and he says they need people from my technology onsite.
It appears he will convince me to go to india after maxout , but i see from the forms salary would be lowest and coming back it would be lowest and then a pain to apply H1 Extn in premium (Need to Beg people), Also need to sell my stuff.
Need to discuss with him further.(Dont want to get into a situation of Use and throw)
Now,Can i negogiate on my indian salary and whether salary would remain same coming here and that they would apply for my extn(Premium) at offshore if they ask me to move after maxout.
Or
Will CTS HR exploit me and does account manager have a say in the above.
Please suggest



I was in the same situation and luckily my Manager was kind enough to transfer me to India for 3 months (Work from India). I have to say that the India Salary may not meet our expectation. Considering the situation, I really didn't cared about my offshore salary as my goal was to come back asap. So, I didn't negotiated. (I heard max for SA is ~10L and M is ~12L).

Good thing was that when I came back, I got the same onsite salary as before.

Hope this clarifies some of your doubts.

I moved back to Chennai due to Visa maxout and my Perm pending.
I am planning to stay here for 1 yr and apply for L1A visa instead of traveling back after PERM/I-140 approval.

Will Immigration team allow me to apply for L1A when my PERM is approved or I-140 is approved ?





Hi,

I'm not sure on GIT process. But, please be aware that there is a restriction on L1A. Not all roles are eligible for L1 type work permit. For example, any individual contributors (mostly T&M type billing, directly work under the client) are not eligible for L1. Those are considered as Specialty worker and fall under H1 category. Check on those aspects and make sure you don't fall under this category.

Does any one know what is the criteria to file H1 extension in PREMIUM process. Is it some thing like that "DL is expiring within 100 days", I got response when I raised gsd ticket.



1. DL expiring within next 3 months
2. You had to go o India in next on a personal emergency
3. Go to India for a planned unavoidable situations .. like getting married

The charges for PREMUIM processing is billed against the project.. so need director approval as well.

My Max out date is Nov 18th 2013 and my PERM applied in Jan 2013, Going by the current trend it looks like there are more chances of an audit. In case of audit i cannot extend 7th year.
I am thinking of applying for Canadian Work permit, If possible can you provide your email ID as i have few questions on the Canadian work permit process.



You can still file your H1 7th year extension even if the PERM status is "Under Audit". I did the same and got extended for one more year. Lucky me.. the PERM got denied just 2 das after I got the approval the H1 extension (7th year).

There is one catch.. was your PERM file at least 365 das before your H1 max-out date ? If yes, you are safe. Otherwise, you may have to stay outside S for certain period to extend your max out date till the PER PD.
