DO you know the reason for your RFE? I'm afraid but in all probability your current status means - NOID (notice of intent to deny) but keep your fingers crossed. GIT can decide to appeal against it

My I140 got NOID and GIT responded to the USCIS and today morning I see the following status - "On March 16, 2016, we received your response to our Request for Evidence for your Form I-140, Immigrant Petition for Alien Worker , Receipt Number SRC159046XXXX"

My question is - Even if it was NOID, why USCIS site say its RFE?

During my PERM filing , TCS had given me only a skillset letter but no roles and responsibilities. After NOID when I reached out to them last month, they were ready to give roles and responsibilities as well as long as I have approval from one supervisor. So there policy have changed between then and now. Infy might have done the same. Reach out to them and see what they have to say

This is what my case manager said to me - in case of RFE and NOID, we should only submit affidavit if we have the email thread as proof where your previous employer is saying - they wont give you the experience letter with roles and responsibilities defined in the format you ask.

I got NOID for experience letter last month. Reached out to previous employer to get the exp letter in more detailed format with specific skillset mentioned as suggested by the cognizant immigration officer. Today GIT is going to respond back to the NOID with the new experience letters

My status changed to NOID on Feb 9th and GIT reached out to me on Feb 15th. USCIS asked for previous employer letters with detailed roles and responsibilities and with specific technologies mentioned in the letters. I managed to get all the letters from my previous employer and submitted the docs to my case manager. My NOID response deadline is mar 14th and my case manager said they track response timeline for each noid/rfe very closely and there is no chance of any slippage. Keeping my fingers crossed for the approval.

At this point am not even sure if its a RFE or NOID. All GIT said is - they will know once they receive the actual notice which takes 7-10 days and then they will reach out to me only if they need something from me. Did GIT tell you that USCIS has asked proof of employment and abilility to pay?

In my GSD response GIT said - it will take 7-10 days for the notice to reach them. My status in CIS got changed on 9th..so will have to wait for few more days.
