Quick question, when was the last time (year) you did your visa stamping at Mumbai? I am asking because if it was a long time ago, they may require fingerprints again.

Did you only have to do fingerprints, or fingerprints and interview?

When you were at the consulate, did you notice if they were approving the visas for other dropbox candidates who were called in for fingerprint / interview? Kindly give us all an update on your status so others are aware of current trends. Thanks bro!

Guys, I am actually curious where exactly in H.R 170 bill does it say that the amendments are only applicable for H1b dependent companies?

Would HR 170 also apply to exempt employees (US masters and salary > $90K) but who work for companies which are NOT dependent on H1b, example Google?

Topic: DS160 Question about unlawful presence, overstay or violation

Guys - quick question, if many years ago, you were out of status (in my case 3 months) and you wrote YES on the DS160 for this question about unlawful presence or overstay, then explained old case reason to the VO at the consulate when applying for a new H1 and they issued a new H1 with new employer...... now when it is time to extend the H1b visa again with new employer, do you have to keep writing YES for that question and keep mentioning that OLD case? Or is it that once you've explained to VO already and they issued you a new visa, then after that you always mark NO for all future extensions?


Background details on old case:

- Last day of employment with previous employer was Feb 2015. Their H1b petition was valid till September 2017. USCIS revoked this petition on April 2015 after employer notified them of end of employment.

- NEW employer's H1b petition filed in April 2015, approved in April 2015, stamped on my passport in May 2015 and valid till September 2017.

Topic: Laid off, H1-B 60 days grace period ended

I know a case where a friend was laid off in 2014. Since back then there was no 60 days grace period, he was technically out of status immediately after the last day of pay. He eventually found a job after 2 months, and the employer applied for H1B transfer which was approved with I-797 but without I-94. He had to leave the country to get visa stamped in India which was also approved without any issues.

The only thing he said was that he was asked by VO about the out of status gap, which he answered honestly. I think the problem becomes very serious if you are out of status for more than 180 days.

It is unfortunate that in these times, snakes like Ron Hira get all the limelight. And he is obviously milking the situation as much as he can to build up his professional profile.
Once the dust on H1-B eventually settles for good and the system is fixed, people like him will be forgotten. And Karma is always a bitch, one way or the other he will get his dues.

Yes, thats very true. Bottomline is, that's what is important to any business - how to improve margins. Without that, your business wouldn't survive the competition. And no one is in business for charity, so things are obviously cut throat in the real world. Perform or perish, something that applies to both individuals and large corporations.

Job offer is ALSO tied to your critical skill and experience valuable to an employer for that particular position. And you need to prove that with appropriate documents. Masters alone doesn't cut it anymore.

LOL, you seem to be a very frustrated chap. Whats your problem? Stuck in a long immigration line with a deadbeat low wage job?

Harvard and Wharton can't churn out enough MBA's to fill all critical business positions in the world. And an MBA from Harvard or Wharton is not much different from an MBA from UC Berkeley or MIT.

And I would not need to prove anything more to USCIS, they already know my skills are very scarce.

In one way, you are right - when you compare an IT background person with a business background person, ofcourse the IT person would fit the bill as technically more qualified. That being said, H1B is not just about IT alone. There are a whole bunch of other fields and industries which require people with critical non-IT skill sets as well in their operations. That is where folks like me come in the picture.

Regarding my last employer, the less said the better. I worked with them for just a little over 4 years and they wanted to wait out till the entire 6 years before starting the GC process close to the start of the 6th year. I just didnt want to wait that long and so i quit at the start of 2015.

My current employer (very large global MNC) gave me an offer letter within 18 days of quitting my old job and started my GC right after i joined them. They valued my skill and experience more than that previous startup.
