The website does say 4.5 months but i had sent my application in Aug2017 and still waiting.. 8th month now
Already raised 2 service request.



Looks odd since currently they have reached till December cases as per USCIS website. Are you sure your case has no issues in filing? Did you use an attorney or self filed?

CSC is about 3 to 4.5 months




Yes. that's right....Good to hear the time frame is reasonable. Poor guys who are stuck with VSC..I feel bad.

Me too same situation. I have an approved EB3 and EB2 with previous employer. Moved recently to new employer. Haven't started the perm process here yet .. would like to know the options.

Suppose if EB3 dates moves forward, can I ask my old employer to apply 485 ?and after getting GC go back to old employer and work for 6months ?




Yes. I guess you could...But you will need to check that your old employer has a job for you at that time when dates become current to hire you back.
Safer option is to port your EB2 or EB3 dates to new employer.

u can file either eb3 or eb2 as long as with same employer




Now i am not with the original employer that helped me to port. Moved recently to a different company and here they have not yet filed perm labor. Still in the recruitment phase and hence i was checking if i can ask for EB3 instead of EB2 when they go on to file I 140 later this year....

I think F1 will be issued as per program start date you mentioned in filing. Just curious why are u leaving H1b status to become a student? You can study part time online also and not completely leave the job

Old date is same Feb 2010 for both I 140 since i ported from EB3 to EB2 with my previous employer.
Then i guess i will have option to pick EB3 at the time of I140 filing.The previous I 140 approvals have not been revoked either

I just joined new employer and they initiated perm processing in January. I have EB3 and EB 2 approved I 140 from my previous employer. Should i ask here to file my I140 in EB3 when time comes for the filing?My priority date is Feb 2010...

You will need to maintain H1b status with proper employment and pay stubs until your F1 is approved.Current processing time in VSC is minimum 9 months and upto 1 year.

All applications will go to Dallas lock box and then distributed. Not sure about IL.Most likely VSC.
I am in TX and attorney says it will go to CSC which is faster...hope so cos i only have 7 months left on H4 status

For this fall now is the right time to apply and even if approval doesn't come by August this year you will still have H4 status till next June to continue to study. But risk is you may not get OPT visa if u have enrolled for less than a year on F1. that you need to check with your advisor
This way you won't have any gap without H4 status.
Expedite request is not premium processing. It's a case by case basis USCIS allows to request for certain circumstances beyond our control...See link below... Not planning to travel to India.Risk is there that they will refuse F1 Visa.

For 2019 fall program start i am not sure if you apply for COS until next year. Why don't you attempt to file COS for this fall?
VSC processing center will cause delays and it's better you file this year itself.
I have similar issue and my H4 expires due to age out this November and i am rushing to file this month and planning to ask for expedite request to USCIS due to age out

When is your H4 status expiring? Nowadays VSC is taking 9 to 12 months to approve COS . You need to plan to keep your H4 also extended since gaps with no status are getting rejected

Hi,

I am currently on H4 visa turning 21 in November and just got admission to a US university for graduate degree. Due to huge delays in VSC for processing change of status i am planning to travel to India next month and attempt to get student visa stamp.
Did your friend who got visa stamp also turning 21 or he is a spouse of H1 visa holder? Just wanted to check if any cases are there who got successfully visa stamp in India due to turning 21 years

That's good to hear. But now USCIS policy became stricter with gap in status.
It's tough to handle when kids are turning 21 since we cannot extend H4 and due to delayed processing it;s highly likely that there will be gap until F1 is approved.
We live in TX so attorney we are using says that case will go to CSC where processing is much faster.
BTW please advise to folks here how did u handle RFE for close home ties and proof that she will return to home country? It will be helpful in case we get same.

Did you r sin’s case go to Vermont?
The new USCIS policy as of February 2018 states that person needs to maintain
H4 status until 30 days prior to program start date or if H4 cannot be extended then
a B1 status need to be filed to bridge gap until F1 is approved
In your son’s case I think it’s better to consult attorney on how to handle since on B1 he cannot attend college
My daughter change of status we are filing next month and hope for the best

Topic: H1b extension processing time - Nebraska

It seems like on 2/23/18 USCIS have made changes to filing locations for different kinds of H1B petitions. Since then all H1B extensions with same employer and with no changes in Job duties are going to Nebraska service center.
But transfers and amendments goes to CSC or VSC depending on employer's location.
This could affect processing times in a good or bad way for extension cases in coming months....let's see
