Topic: Timeline for passport receipt for dropbox

Hi All,
I have not submitted my DS160 yet as I have some questions and need some help here:

1. My current stamping is valid till Aug 30 which is on old and expired passport. So do I need to submit new as well as old passport ?
2. I have to restamp for my entire family. My son just turned 14 , does he have to appear for in-person i/w or fingerprinting? If yes, is it only for him or for everyone (2+2).
3. Do we need to submit Client letter in initial submission or only in case if we receive 221g (add'l info reqd). I am on Employer-Client model. Though client letter is not possible, my employer can send work order copy and it can take some time and hence I have not submitted DS160 yet. If client letter/WO is not needed upfront, I can complete DS160 and submit for dropbox while I will be receiving WO from employer
4. Since stamping is needed for me and my family (2+2), does everyone should be in-person present in dropbox while submitting document? Please advise.
5. My last interview and stamping was in Chennai (as I was in Bangalore), however now I am in Maharashtra. Is it advisable to use Mumbai consulate or shall I go to BLR/Chennai for processing using my BLR address. Please advise.

Need an advise here:

Presently I am working with Client A and contract is getting over in few days. Been interviewed for Client B and most probably will work out. The distance between A to B is 80 miles which makes it necessary to file amendment.

If I join Client B, after 3-4 months I am planning to come back to Client A (through same employer). Now since amendments taking 6-12 months to approve, what are possible options from below:
1) Cancel amendment (for Client B) which eventually makes Client A work location ? Is this possible?
2) Premium amendment for Client B, so after 3-5 months I can come back to Client A (Is premium suspended now?)

Apart from above :
1) Can I travel to India while amendment is pending approval (Have valid petition till 2018)
2) Can I move back to India for good while amendment is pending (Emp will cancel my H1b for sure)

Please advise.





Any advise is appreciated on above questions ?

What I understand , we have to choose Consular processing or Adjustment of Status while we file 485. Since my I140 is just approved (with PD 2016), I am no way near to file 485 until so many years since filing date is not current. So while filing 485 (8-10 years from now - minimum), we can choose. Correct me if my understanding is not.

Great thanks for clarifying my doubts. So as a follow up question: I am from India with my PD as 2016. So as I understand I may not be able to file 485 since filing date is not current and hence cannot file AC21 as well. I have to wait until filing date is current (or my PD of 2016) Please correct if I am wrong.

Also with your in-depth knowledge on legal matters, please advise for my friend who is in same boat as mine (I140 approved with PD of 2015). He has high school going kids and in couple of year will hit college(2019). His question is whether he has to pay International / Out of State college fees for his kids if he dont get a GC (and kids continues to be H4). Appreciate if you can advice.

For #1, since I am already through lottery, shouldn't I be considered as cap exempt forever ? I was under such impression. If PD being current that time, for my case I would need 3 years extension as I need to refile PERM and I140 with whoever would be new employer (else I have start from home country as mentioned in #3). Per your suggestion, I wont get 3 years if PD is current. Is it some rule?
For #2, in case if I140 rule won't lasts, in that case I may not be able to port 2016 PD as my current employer would already have revoked I140 by then and with no rule in place I may not be able to port PD. Correct me if I am wrong here.

Guys,
Presently I am on H1B, have recently approved I-140, however company has already conveyed that they will revoke I140 if I ever move out.
My plan is to complete 6 months after I140 is approved, quit the job, relocate back to home country for 6-8 years. Once PD is approaching near I join any US based company to move back to US.
Questions:
1) Do I need to do fresh H1B and whether it has to be in fresh quota ( I dont think so, as with new I140 rule, it can be used for unlimited extensions)
2) For GC, can 2016 PD be ported. I know I need to restart PERM and I140.
3) In case if I need to do fresh H1, PERM and I140, Can I get PERM and I140 while being abroad, select CP and enter US on immigrant status (without H1) and directly get a GC? Is it possible as I understand GC is for future employment.

Please advise.

As I understood (immigration-law) there are 2 separate bills 1) one (introduced 1/4) for raising minimum salary to 100k and making sure of master degree and I believe this is applicable for all extensions and transfers (as it did not mention anything about new visa/quota/lottery or so). Pls note that as per USCIS any petition (new/transfer/extension) are same 2) Second bill (introduced 1/5) is for getting away with lottery and replace it high salary bidding.

If above is correct, it will impact all who do not have master degree

So does this H.R. 170 means that anyone whose H1b to be extended must have 1) Salary >100k AND 2) Master Degree... So what will happen for guys with more than 7-8 experience, earning more than 100k but do not have master degree ? Any analysis?

Do we need hard copy of PERM for filing I140? Mine is approved on 12/14 and my employer is all set to file I140 by Monday or so, though he never mentioned anything abt hardcopy.
As a beneficiary, should we have a copy of PERM? Will employer share PERM with us?

I dont think this is correct. Mine is Oct 14, my company name starts with D , still waiting whereas most of the same date approved (Oct 14) cases, had company name started M, N and enev had Y. So I dont think your presumption is correct.

Anyway congrats for your approval. Are planning to file I140 in premium now?

My case # is A-16288-***** which makes it Oct 14 date. Though 11 cases are approved of Oct 14 , mine is not one of them. If all goes well I am expecting anytime in next 1-2 weeks.
I am planning to file I140 ASAP in premium so that it is approved before Jan 20 at least :). Can anyone help me with below questions:
1) Usually how many days it takes for an I140 approval (with and without premium)?
2) My Attorney is suggesting to NOT to file I140 in premium in Dec particularly as there as high chances of RFE in Dec due to holiday season. Instead I should file regular now and should upgrade to premium in Jan to avoid any possibility of RFE... Does anyone have across any situation (RFE in premium in Dec) or had any such suggestion from your attorney/employer?

I am confused with your dates. Mine PERM # is A-16288-***** and Perm Filing date / Priority date is Oct 14. It is also as per calculation 16288 = 14 Oct 2016. Similarly your filing date should be Oct 7th, 2016.
Please recheck your Perm number and filing date once again

Wanted to ask to gurus here: Once I140 is approved, does he have to stay with current employer for minimum 6 months before switching to another to ensure his 140 is NOT revoked by DOL(despite of employer withdrawing it)? This question is applicable for both scenarios - with or without rule.
(As I understand , revoke and withdrawal are 2 different things ,as withdrawal (by employer) does not necessarily revoke your I140 (by DOL/USCIS) )

Anyone has any knowledge on this?

Thanks for noting my miss in dates.
So even if as on Mar 31, they have processed Aug 31st case, it means 213 days. So with this 213 days, today they should have processed Oct 19 case. But I have not seen anyone have updated Oct case as approved in regular.

I know no has any answer for their processing, but I am not sure if forum users are updating their cases here regularly here else it is misleading for all.

I dont think we are getting accurate information here. As per USCIS site, as on Mar 31, they have processed Sep 17,2015 case which means it is 196 days. So howcome from Mar31 - till date (1.5 month+) we see no progress.
By 196 days statistics, today they should be processing Nov 5th case, but we have not seen a single Oct approvals..

So does that mean that forum/tracker users are not updating case here as it approves or am I missing anything here..

Topic: I-94 extension due to passport expiry date

You can also try going to CBP immigration office (not sure what is the official name) at these airports with your new passport and I94, they may be able to issue new I94. I read/heard that they will issue only in circumstances when there is any mistake from their end (and not in these situations), but its worth giving a try.
