Yep...in order to have any hope of getting the same H1 validity (end of year 7) after the transfer, you need your I-140 approved, not just PERM.

Hi...My employer requested a 'recapture' based on # of days spent outside US and in addition, requested a 7th year extension since Labor was filed more than 365 days prior to the max out date. Hence the approval till 5/11/2017.

My question was for the scenario where I change employers after I-140 is approved via my current employer. If I don't manage to get the I-140 filing/ approval papers from current employer, and my future employer files for PERM, is there no way DOL can tag the information to the original filing date?

Hi...My H1 extension was recently approved till 5/11/2017. Max out date is 5/11/2016. PERM was submitted 12/05/2013 and still pending with DOL (has not gone into audit yet as per my employer). My employer has a policy to NOT share PERM or I-140 documents with employees, they say it's company policy and company property.

So my question is, if I change employers now, will I get H1 validity till 5/11/2017 or only till 5/11/2016? Also, will my priority date remain the same if a new employer submits PERM, given I won't have the original I-140 filing details? What details are required to get the original priority date?. Any advise or suggestions are much appreciated!
