Totally agree with herohiralal.

We should not assume the count of approvals based on the updates that we see in PERM tracker.

We can see lot of cases in pending state with 2007 PD.
People are not updating their cases in timely manner; can't expect either.

We should just use PERM tracker as a mean to ascertain similar situations.

In my case the extension was initiated automatically. Believe the whole thing is automated; when you enter into the last 6 months, you would start receiving the emails from GIT.

Yes, my PERM is still pending post audit and I received my new I-797.

To my knowledge, you need to have 365 days based on your PD for getting 1 year extension. Not sure of USCIS holding I-797 back until PERM is approved.

Saw a lot of posts regarding 365 day rule for PERM; thought of shedding some lights for few since I fall under same category.

PD: 6/29/2012
Max-out date: 7/3/2013 (I went to India for 2.5 months to recapture 365 days)

My H1-B extension was filed on 1/14/2013 and I got the approval too. My new I-94 expiry date is 7/2/2014.

GIT did inform me earlier that USCIS might give extension till my new max-out date or new max-out date + 1 yr. Guess I was lucky.

Bottom line; you do not have to necessarily have crossed 365 days on your PERM for getting 1 year extension.
But if you do not have 365 days pending when your PERM was filed, you will need approved I-140 for extension. Just PERM approval will not suffice.

Did anyone get any response on June audits? I am very worried. The dates in DOL has not been updated since Nov and shows current PD for audit as April 30 2012.

Wondering whats going on with DOL.

Yes, payroll will be transferred. Returning back to US after capturing 365 days will depend on the project.

I have a very urgent question.

Current Visa validity: 30 March 2013
Max out date: 29 April 2013
PD: 29 June 2012

I had only around 302 days when my PERM was submitted and received audit. Audit has been responded and currently waiting for response from DOL. I am getting transferred to India for 2 months to recapture 365 days.

My question is when I come back and apply for extension in Jan or Feb, what would be the extension period?
Would it be time captured + 1 year or just the time captured or just 1 year?

I would not have captured 365 days at the time of applying for extension, but I would have captured 365 days based on my PD and the new max out date.

Please let me know.

I had received GIT's audit email on 9/18 and received email from GIT that my docs were received on 9/19.
Still awaiting their confirmation on responding to the audit :-(

Has anyone's audit been responded yet?

I heard that each of us will be assigned a case manager who will be responding to the DOL's audit.

I am not sure how to find the case manager. Does anyone know?

Thanks fast4g for the details. I have one follow up point/question though.

I don't think it is a must to be out of US payroll to get the recapture. For ex, if we go to India on vacation, we still get the US salary and also we recapture the days we were outside US.

What I mean to say is, recapture is purely based on being outside US not based on payroll.
Having said that, I do agree that Cognizant or the Management will not keep the associate in US payroll if the associate is going to be working outside US ( I wish they do ;-) ).

But if Cognizant agrees, the associate can work from anywhere outside US (even India), but still be under US payroll and recapture the time for being outside US.

Any thoughts or comments?

I am also on the same boat. Need some additional details on the relocation to Canada.

1. Do you mean permanently relocating to Canada or on a temporary period say 2-3 months to recapture the time?

2. If it is temporary, could you also please let me know the type of Canadian visa that you are are going to use or your other project mates used in the past?

3. Is it Visitor visa or apply for Canadian work visa? If work visa, how long does it take to get work permit?

4. Also how would the payroll work in this case? I mean do you get transferred to Canadian payroll?

Please let me know; I need to make a decision soon according to this.

hi all - pls help me out with my situation.

My PERM was applied with less than 365 days before end of my 6 years

PD: 6/29/2012
Visa expiry: 3/30/2013
6 yrs H1-B expiry: 4/29/2013

I received the email from GIT today that an audit was received for my PERM.

Question is, if I go outside US for 2-3 months now (i.e. bridge the gap to attain 365 days), will I be able to extend without getting PERM approval?

Appreciate your guidance...
