I dont believe there is a deputation process for onsite hires to work from offshore.
Its like quitting CTS Inc and joining CTS India pvt. You will be given a new offer for employment and as I saw other posts, you dont get to negotiate the salary.

Yes, you have to work your way on identifying a project, before you fly. Your project allocation should happen before you go to offshore. Talk to your Managers at onsite/offshore to identify a potential project. Good luck !

If you think its going to take time, you can also request CTS to file a fresh H1B petition, but this will override your PERM.

I have noticed from DOL website http://icert.doleta.gov/ that the PERMs in audit that are filed around 06/30 are being processed now.. Not sure how much time it would take per week ?

I noticed that PERMs that are submitted until 06/30 and in Audit are being processed now , from the DOL website http://icert.doleta.gov/.. Not sure how much time it takes from here. Saw the same status for 05/30 for 2 months tho..

1. You cannot get extension based on PERM approval. Even if your PERM gets approved by 04/30, you need 2 weeks for I140 approval assuming they do in Premium, and another 2 weeks for premium H1-B extension. So you should be good by your max out date ie., 06/01.

2.I dont believe 365 day rule applies for I140, atleast from the numerous conversations I had with CTS GC folks. Again, you cannot get extension based on PERM approval to my knowledge. But in this scenario(PERM approved, but I140 is not approved) , if you move to Cognizant offshore then your petition will still be in progress. And whenever the I140 is approved, CTS can file your H1B petition, you can go stamping and come back to US.

Regarding your last question, it looks like you have only two months to make a choice and thats already late..
Sooner you decide, the better.


Please confirm with CTS as well.
