Apart from what the above poster ^^ mentioned, you must remember that IV is not a shop or a contract organization. You do not pay IV to get certain results. It is an advocacy group. SIRA is another one with a different focus. With an advocacy group, you donate money with a reasonable expectation that it will be put to use to use for a cause and vision you agree with. To influence an advocacy group and change/understand the details behind it, you need to be involved by attending meetings, taking responsibilities for action items .
If you feel entitled for an outcome because you are donating money, perhaps advocacy is not for you. Ever donated to NPR because you want them to show one program? Even they don't guaranty it but they do try to make the best effort.




i have donated to NPR and i have shed tears for a number of true stories and always liked their ability to bring out the fact as it truly is. I really liked the way you explained this as my perception has changed a lot since i read your message.. honestly..
Now QN- What would be your feeling if they gave a long list of upcoming programs and if they started playing just songs all day all of a sudden at the end of the week just a 30 mins quick news for last week and if they started doing that every other week.
Again... I was certainly not trying to call down on IV but was trying to understand truly if they are doing good as i have felt they promised a number of things. Do you guys all feel that IV is doing its best or if its doing what you guys thing it should be?
I am open to correcting my opinions but i am not one who likes to donate to one of those corrupt charities.. I want to have an open talk on what they are doing. Am i still wrong?

When you commented this, IV did not disclose their comments then how did you compare and say gregs comment has much more meaning than IV, you are nothing but a brainwashed lawyer blog/forum bhakt... Grow up!




I appreciate you taking your time to respond. I am definitely not against IV and there is not a dime i get by staying against them. If posting their comment on the last day was their plan then why tell us that there will be another series of comment that they will send us and why was not a skimmed down/different version shared with us as promised by them. Or why not tell us that this was the reason why they did not share the second line of comments atleast after the fact..
I personally think if someone takes money for a specific task/reason and if they said they will do something and if the donation was for the very specific task and to change the action on the last minute as an act of surprise is displeasing.
If we are not obligated to ask anything and if we cannot demand updates then they cannot demand our donation also.. If you were there on the call on January and if you tell me that the call was not to collect donation then you must be dreaming my friend.

I have no bias for lawyers and i on L1 and have no need to get anything done with those lawyers but they are there for their own benefit and if they are equally contributing with similar comment then i would not be bashing them as i saw a tonne of bad comment from IV for their Visagate issue.

Anyways.. I hope someone does something and I personally think IV is just trying to make money out of our problem.. Any place that rejects negative criticism is not a honest place or a open forum to trust.

Just my personal view!

I saw all the follow up post for IV post that they have posted the comments. Not 1 soul even asked as to why we were kept out of it and no comments were shared earlier with us like they promised. on the contrary.. Folks are joining in to add subscription. I fail to understand the reason unless these folks are just part of the IV chain trying to fool us.. May be i am too old and too dumb but i just dont get it!

We certainly can but they never promised us anything nor are they obligated to do us anything. Even if they were to all speak against I140 EAD if someone pays them to do that we still cant blame them as it would be their right. I clearly see from the blogs on immigration-law and gregs blog etc that they are trying to show how bad the rule is and I look at them like news readers /press as to me they show what the situation is.

Again.. Just my view..

They are not stupid people.. We certainly are to continue to throw money at them. Their January call focussed and only focussed on Getting donation.

If you have donated i believe that you have all the right to ask them as to what was done with your money. They even set a goal on Jan and Feb to be reached to do something with this rule...What a joke!

Just a Hero like speech by yelling at USCIS will get nothing done. Might get folks like us clap for that but nothing past that..

Just my thought though and I truly hope i am wrong about them as if they did anything good then i get benefited as well but to me they are blood sucking leach.

last year I joined travel job from non-travel product company for really great product and my previous employer withdraw 140 and waiting for my employer file the GC in 3 months..
This is my first travel job and facing lot of challenges wants to move to Non travel . I am getting no travel US product companies and not they're interested to hire . BTW its not developer position and very senior role so many local US product companies not interested to Hire H1.I have only option do travel or go back to india after lot of years spend here ..

Because of this backlog I stuck and facing lot of issues ..Hoping this rule may help us..

There is no change to 1 year limit for filing of I-485 when dates are current. In essence the H1b extension is not perpetual. Once the dates becomes current, the adjustment should be filed in 1 year. The same applies to I-140. You have to file I-140 within 1 year after approval of PERM.




Its usually 6 months / the perm expiration date to file I140. Please dont provide incorrect information as it will confuse the confused!

Hi Folks,

Do we know if these comments are being tracked via IP addressees? I have been commenting every couple of hours since this morning in various different way for different points mentioned in the proposed rule. So far have sent around 5-6 comments. I understand the comments are reviewed first and then updated. However, just wondering if different comments from the same IP address with different names would be rejected??? My goal is to provide atleast 700-800 quality comments before the end of the comments period. Please let me know. thanks



Hopefully not.. as most of our IT folks trying to comment sitting behind their office pc's mostly share the single corporate ip for the building.

Okay so if i understand everything that has been shared and i stand to be corrected.

Consider a scenario, an L1 visa holder after 5 years has the i140 approved and didnt get lucky with the H1 quota.. will that qualify as a compelling circumstance ?? the thing that concerns me is that he/she needs to have a valid visa.. L1 is not renewable after 5 years so trying to get some perspective on this..




No idea. Let the rule get published. Everything until then is pure speculation.




Exactly.. Nothing is clear at this point and assuming we get EAD and if that qualifies as compelling circumstance -To add to the confusion- Also.. your stay in US is based on i94 and so EAD is not good to stay legal and re-entry requires AP or a valid visa.

Does anyone know what this could possibly mean for L1 guys.. Just fyi . L1 guys suffer even more than the h1b folks as they not only cannot switch employers from beginning but also cannot extend their visas past the maxout date unless converted to H1b which has to go through CAP/lottery.



You just might be right. This is probably the only compelling circumstance I can agree with.



The big issue would be that without AP the EAD would still be useless for L1 guys. right.? Can you think of any possibilities for this to still work..?

I understand most folks here are on H1b and i appreciate sharing any thoughts on this also.

Correction on your statement.. its not a possibility of getting kicked out as there is no possibility of staying and so its certain. For us to be able to win this- there needs to be EAD on approved i140 and also AP. That is how i am seeing this. I dont see any light at the end of this tunnel for me. I wish they allowed the L1's to extend their visa also past the maxout based on an approved I140. This is a complex system and we are little bugs trying to fly around to survive while the giant eagles are outnumbered trying to hunt us down!(that was a bit of exaggeration).

To add we cannot get anything with just an EAD as our visa is intracompany transfer and that answers it all.
