What you really mean to say is that "if everything goes fine your perm will have a 3% chance of approval", which is about how many CTS labors are being successfully certified these days. Seriously...do you guys not do your research before joining a company? Being optimistic is one thing, but ignoring statistical data that is stacked against you and going in expecting a miracle (approval) is just foolish. Where I come from we refer to that as "tunnel vision", focusing on a specific goal while completely ignoring all of the environmental factors at play and failing to see the bigger picture. It is actually a diagnosed DSM-4/5 psychological disorder :)

You knew going in that CTS has an extremely low approval rate for PERM. They bulk-file for all of their employees, regardless of how unique or dime-a-dozen their skillset is. Somebody could be a plumber and CTS would file a PERM for them and claim they received no resumes for the job. So it should not come as a surprise that many of them get denied. When your company plays the system like a lottery, your odds of approval become no better than winning the lottery :)



What's up boy? Not so low rate of perm approvals anymore. CTS PERMs got approved in bulk in case you didn't know. Don't talk BS when you have no clue what it is you are talking about.

I can also see mine as certified in icert. Oct 2013 priority date. Not appearing on dolstats. Will update when/if GIT sends mail for i-140.

These are the same arguments that right wing nut jobs use against ALL visa holders, including H1. No need to freak out over this tiny change. Many will not use it, most will just take up small time jobs.

Those won't work. You'll need detailed letters explaining your roles, technologies used etc. It has to be on company letterhead too.

In case anyone is interested to know. Even if a person has to leave because H-1 max out and GC not 1 year old, it is possible to file extension and come back when GC is 1 yr old. No need to wait the full year. I was in the same boat but came back, also got visa using drop box.

That is a bunch of dishonest bs. If your kids are born in US, they will get citizenship no matter your status. Influence helps, but only to a certain degree, the person has to fit the qualifying criteria for EB1C.
There is none honorable enough here who will complain if CTS files their case in EB1C, I know I wouldn't. And by the way, no other category is as heavily scrutinized as EB1C.

You can file for H1 after PERM is 1 year old
Joined CTS with 3 years on H1, got delayed by GIT in GC filing.

First off, I wish you the best of luck that it all works out for you and you don't have to uproot your life from States. However, if history is any guide, you need to be prepared to leave US for a few months. My H1 was maxing out in July'14 and PERM was filed in Oct'13. I waited and waited and no updates came and had to leave US in July this year. I had about 40 days recapture which I was not able to use due to some personal reasons. Anyways, after coming to India I was able to work for about 2 months from home but then my asshat manager forced me to join offshore office in Blr. Mind you, the manager, NOT the client. Client has no issues. I can tell you that after working for years in US, coming to offshore and working in EST timings is nothing short of a punitive prison sentence. You need to search for house and give big deposits just to secure a decent place. Not knowing when you'll have to leave and what will happen to deposit. The cab transport is hellish and drivers behave as if they are doing you a favor. 0 professionalism all across. I have to walk some distance in late night because my cab driver does not want to drive a few feet on off road. Have to submit to bag checks like you are a common thief and get a laptop pass, failing which your life will be made miserable by the guards. Just before my PERM was 1 year old, I happily uploaded all the documents, but my onsite manager started balking on premium processing, even though they have promised the client that I'll be back in 3 months! And even though recently my team won a big MM$$ project. Even after all this I have to bug him days to be able to get the premium approval. And they gave it to me like it is some kind of big favor. After that my offshore manager went on vacation and even after multiple calls did not approve my application in my visa. When he came back I had to stand over him to get it approved. And now GIT has taken more than 2 weeks and not filed it with USCIS. Frustration after frustration.

so tl;dr - You need to be prepared to leave and be gone for months. Do not think for a minute that CTS will be proactive and file your papers just in time to get you back immediately after your PERM is 1 year old. They'll all delay because they all see us as privileged mofos who are at onsite just because of pure luck and not because we work our ass off.
