Topic: DACA/HR 392 are DOA, what comes next is ...

You guys are so dense.
EB1C is not a scam - USCIS has repeatedly ruled in AAO how it interprets international managers, what functions mean etc.
It is a stupid interpretation that can lead to someone leading a team of 5 developers in Mumbai to transfer to US and get a green card almost instantly - however, those are the rules - we gain nothing by being envious of their good fortune.

Topic: H.R. 392, Fairness for High Skilled Immigrants Act

Yes they might be credit hungry, and i know they misrepresent facts to improve their standing among us :
1. Intervention in Save Jobs USA case is one example.
2. The recent I140 based extension fiasco is another.

But the fact is, they have smartly realized a few things :
1. HR 392 solves a lot of problems the community faces.
2. The only way to pass it would be for it to be part of another legislation as they have rightly figured out that the congress does
not have the stomach for real immigration reform. Even if the GOP were to get to 60 seats in the senate, the GOP is a
complex party of a varied set of ideologies - all the way from free market moderates to KKK sympathizers. It may not be
possible to build consensus on a bill. Plus they will rather use their political capital to work on issues they have consensus
on - entitlement reform, increased military spending etc.
3. DACA is popular among Americans, and it is the most logical vehicle to the passage of this bill. But, there has to be a reason to include this to DACA (hence the suggestion for the $1000 fee - it may not work, but it sure doesn't hurt the cause)- nobody, i repeat nobody really cares about fairness towards us - remember, previous immigration legislation specifically excluded Indians and other Asians. We were described as "The most undesirable of the Asiatics". You know the original purpose of the Diversity Lottery was to engineer a way to ensure that there was a pathway for Irish and other Northern Europeans to immigrate to the US. I doubt anyone would do that for us.
4. Their work to sign up cosponsors (or cosponserers as Aman calls them) ensures that they bill is viewed as a non controversial piece of legislation when included into any other piece of legislation.

Now we all hate how arrogant they sound on their FB/Twitter pages etc, i do think of all the groups working on this, theirs is the best strategy - sending letters/tweeting at people will not move the needle.

You've hit the nail on the head brother - i'm just a keyboard warrior here, but i can't for the life of me figure out the hate IV gets - their members seem serious about the cause and are working hard. They may fail, and we can do a postmortem to decide why. The thing is the odds are so long that there may be no good options. It's like we just lost the 9th wicket, need 12 runs in 3 balls and IV is the last batsman. If we win it's fine, but if we don't we can't blame IV.

Topic: Feedback on IV call

The Ds would clear HR392 if it comes to the floor - on the House Committee where this bill is languishing, almost every D has supported this bill. Infact when there was a hearing on HR170, Zoe Lofgren (D) tried to push this bill through.
The problem is if you are not from India, Mexico, Philippines, or China - the immigration system is working perfectly. The only flaw is illegal immigration and therefore all the focus will be on fixing that aspect of it. We become an after thought.

Topic: Feedback on IV call

I don't understand why hating in IV is such a big part of this forum - while they are far from perfect, they are just a group of people. Far stronger lobbies have failed to achieve anything. I don't think IV's work has hurt immigrants, it may not have helped, but they are trying. I think they tend to oversimplify, over exaggerate, and engage in fear mongering - but i believe it is necessary to make sure the community stays focused.
Now HR392 may never see the light of the day, but their efforts ensure it is a topic, and it is a consideration when negotiations happen. And this may result in some other form of relief - it could be temp gcs, or eads/aps, or whatever.

I-140s are for future employment, unless you expect your PD to be current real soon, there is hardly any point.

I hope they post it.
I don't think HR392 gets done outside of a DACA deal, and that too to fund some aspect of the overall bill - neither Ds nor Rs have any motivation to fiddle with EB. IV realizes that, and their whole $1000 gambit is smart

Good point man!! So right now the deal Trump rejected would have redirected the 50k to TPS, the lawmakers may decide to redirect it to EB and get a deal.
Can't believe i'm saying this - GO TRUMPPP

The problem is, when they look at our situation, it doesn't look so bad - we are people working jobs that American's aspire to, make good money, most of us are from stable countries (albeit with problems) - so while our potential may be greater than the refugees, our plight certainly isn't worse.
And politics is often about perception - 50k Haitians getting GCs would be thought of as America helping 50k people in a desperate situation. 50k EB2/3 getting GCs would be interpreted as 50k good jobs eing stolen.

Only 7% of the additional visas will be available to Indian nationals - so we go from 2800 for EB2/3 to 4000. There will be a 45% reduction in wait times from 70 years to 40 years

Not "just because" - because. And the fact that Dreamers either went to school here, or served in the military. The fact is, they are probably more American than most of us in the EB Queue. It is not an either or question, either reforms would move forward or they will stall. I do not see the possibility of EB rules being changed outside of some other measure. And honestly, the DACA kids is the only pressing immigration issue - if our backlog is not addressed with DACA, we can kiss it goodbye for the next few years. There is no way you'll have two major immigration changes in one presidential term.

I wish HR 3012 would have passed the Senate - that was a clean bill and by now, the backlogs would have reached a predictable level.

only 7% of those unfortunately - you'll get your green card 45% sooner...instead of 35 years, 20 years.

Topic: Immigration Reform is coming soon

You do realize that the gang of 8 bill was passes with bipartisan support in the Senate. The House didnt even take up this bill because you know...the black guy was the president..
Obama's deportation rate was higher than all previous presidents.
We're just mad at him because he didn't do as much as he could have. This administration is no friend of any immigrants, we can be happy that they hate illegals more than they do us, but, they hate us alright.
Obama wanted stem grads to get a green card, made sure employers cannot screw h1bs over by withdrawing i140s.

Topic: Should you follow IV?

I'm not an IV fan, infact I was the first one to point out the Leon connection to the story. But that said, IV is our last best hope. HR392 will not solve all problems, but it is a step in the right direction. It takes activism to get things done, and IV is doing that. Way more important bills took grassroot efforts, for ex. The zadroga act, it was something as basic as providing health care to 9/11 responders. Nothing gets done without the advocacy.

Iv has done well to get some traction on the bill. Their leadership may be a bunch of jerks, but i'm perfectly fine with them being that if they can pull this off. Also, i feel Kevin Yoder has worked with IV of all the groups.
Maybe IV is not the best at it, but where we are, they are our last best hope.
