Again, I dont think the PERM Delay is a new thing in CTS. I have known guys who applied PERM in 2009 , which took close to 2 years for a Decision. we can take solace in the Fact that I-140 will get approved quickly once PERM is approved.

PERM filed in EB2 - Oct'13.

Having No Approval for CTS for quite some time led me to thinking. I have Listed a few possible reasons. Hopefully I am wrong and its simply a delay.

1. Did Cognizant abuse the process which Led DOL to take some actions - I think so , to some extent CTS have utilized the loop holes to obtain GC.
2. Is it profitable for company to keep it employees on H1 rather than the risk of losing them once GC is obtained.
This definitely a cause of concern for CTS as I have seen people switching after getting their GC.
3. Immigration department - Goofing around/ No Accountability -If everything goes well , it doesn't bode well with the imm. team , if not , every year they need to file for extensions - which means - some level of job security.
4. Truly DOL related - Like all the immigration team and Schwartz's claiming it to be ...

I am leaning towards #2.

Thanks and Good Luck to all.

Just wondering if we can directly check with the help desk or this can only be done via the employer.

From the website
https://icert.doleta.gov/index.cfm?event=ehGener...

"If your application was filed more than 3 months prior to the month posted, you may contact our Helpdesk for a status on the application at plc.atlanta@dol.gov."

If you were in a Manager role, SA or Above and have spent more than 12 months offshore its EB1 , I know a couple of folks in my project filed through EB1 meeting the above requirement.

I spent 9 months as SA offshore and I was told 12 months is required for Eb1.

Again ,I dont want to give any false hopes , this happened couple of years back , Not sure if there was any change to the policies.

Good luck with your filing!
