Docs like this can sometimes be submitted if signed by a Notary Public.

Normally it’s for letters though, so just get the email redone as a letter and then Notarized.

Why would H4 EAD need GC application? If Infosys is doing that, they should stop it IMO so that other visa holders better chance.
As far the latest information I received, Infy is not going to hire H4 EAD for now. I think they will wait for the final word on that from DHS.



Why do you think H4 EAD does not need a GC application? In your opinion which visa holders deserver GC?
If you are from India and having priority date > 2009 , you should know by now that GC applications are just to keep extending H1 Visa and not to get permanent status.

I am in a non-IT field and not aware of the inner workings of the IT industry as it pertains to recruitment with fake resumes. Just out of curiousity if somone gets hired with faking their expereince and skills on a resume, how does that person perform their job ? Wouldn't they be exposed in a matter of days ? How do they continue to survive and thrive?



It depends on how critical the project is and how tolerant the people in the project are. 99 % of the cases, the project members and manager can easily identify the fake candidates. But whether they want to keep him/her depends on the performance of the candidate in the project.
Some may be smart to learn quick and sustain. Some may be be stupid to get kicked out in couple of months. But again it depends on how the person entered the project. If he/she was referred by someone having influence in the Organization/Project, he/she may stay longer then you expect... :)

Topic: Role changed in Visa extension, will it impact I140


I'm a Project Manager with big 4, when it was time for my visa extension, my management offered me to assign me to Tech Arch role to fix my salary (another story, had a drop earlier). I took it despite feeling this could impact elsewhere in the visa, GC process. Now I have an approved I140, and I just stumbled upon another thread like this saying we have to redo perm and I140 process if there is a change in role. I'm just terrified of the thought of redoing anything visa or GC related with all the challenges recently. Can anyone confirm, have I caused myself damage by filing a Tech Arch role in the extension instead of the Project Manager which I have been using for all Visa purposes in last 5 years and also my Perm and I140.

If you are working for Deloitte and having a role >= PM, Deloitte will do GC in EB2 and if you have to take any role < PM while working with them, Deloitte will redo GC in EB3 even if your previous EB2 I 140 is approved. This is Deloitte Policy.

In general regarding redoing the PERM, if your new position holds all responsibilities of the previous role + additional responsibilities for the new role, you may not need to redo the PERM. If the new role is entirely different role from your previous role, then you need to redo the process

Topic: Should I report this?


Someone that was recently hired by a team that I know closely and work with has deceived his/her way in the team by doctoring his/her resume. This person has never directly worked for the prestigious US companies which are listed on his/her resume. In the resume, the person has deceitfully worded working for these US companies in such a way that it is hard to find out that they were actually the clients of the body shopping company(2 of which are from WITHCES) that he/she worked for. The deception is so obvious if you look at his/her resume carefully.

The hiring manager(also an Indian) who knew this person from a previous work setting conveniently decided to ignore all of this and brought him/her on board(obviously).

I have access to the actual resume and the email that this person sent to the hiring manager. In the email this person summarized his/her top competencies which included false statements about working directly for the US companies..this time without even playing with the words..just simply lied.

I am planning to report this to :
1) Company's internal ethics and compliance(anonymously so that I don't get in trouble).
2) Possibly to USCIS

What do you guys think?? please let me know..



If I understood your comment correctly, the person have listed the client names he has worked for in his resume. But you may need check if he had listed the clients under projects or under employers. If he had just listed them under projects then I do not see any foul play.
Again, you do not select a candidate based on whom he worked for instead you pick him based on what he worked. Assuming the candidates project experiences are genuine, I don't understand why you think he is not a deserving candidate.

There is nothing absurd about the country quota. The queue is proving that it is needed. Otherwise nobody but India/ China would every get a green card. And the queue will not decrease because of this law. Maybe temporaly but there will be new line in a few Years. And what's next? Only allowing India/ China to get a GreenCard?
We would need really strict H1B Rules only allowing the best of the best to join and than this Problem with the long line will be gone for ever.

Add her as an authorized user to your credit card and Use 10% of the credit limit on the authorized user card.

Register in creditkarma.com to check your score [ lets say after 6 months]

Apply for capital one quick silver once you build a history....the credit limit might be lower but you may be qualified for an un secured credit card.

Note : Do not open a secured credit card as it will be difficult to get the annual credit fee waived later once you build your history and you may end up paying it every year. Cancelling the card also impact your score as it being your first credit card.

You can continue to work until your current EAD expire [October 8th] and cannot work from October 9th until you receive the renewal approval

Topic: Is it legal to stay in USA after completing of 6 years H1b


Hello- My I 140 was upgraded to premium processing on Aug 18,2017. I got receipt number on August 21, 2017. My H1b is expiring on Sep 5, 2017 and my priority date is Dec 18, 2016. So there is no question of 1 year extension@(365 days rule). Below are my question.

1) I am expecting a update on my case in 2 weeks. I can stay until Sep 05, 2017(7 days more). Can I stay beyond that in USA like one week more which is Sep 10,2017.

2) If I stay in USA until Sep 10,2017 and my I 140 is approved after H1b expires. Can I applied for H1b in consular processing and work in USA?

I know I asked same question many times . I am bit confused please do reply me if you have any update brothers.

Appreciated your advice. Thanks.





1. No, You cannot stay beyond September 5th as your current I - 94 expires on that day. You need to leave the USA on or before September 5th

2. There is no legal option for you to stay on H1 B in the USA beyond 5th of September as you have maxed out your H1 days. Staying longer could cause more trouble legally.

Good to know that you are interviewed for multiple positions.. do you say the recruiter that you would join only after the H1B is approved or you are ready to join with just receipt notice?

Do you mind sharing the employers information, who are interested in H1B, it would be helpful to fellow mates in this group?

To add a note about the number of H1b s approved from India in the chart released, remember it number of approved cases, extensions, fresh h1s, transfers etc. Considering the H1B crowd in the USA, this seems to be a normal number

The un-used visas of EB1C used to spill over to EB2 and EB3 earlier.
That made the EB3 porting less and EB2 PD movement fast.Imagine spill over of more than 70K visas.

You are complaining about the spillover of different category which did not help your priority date move and never worried about the 100 K people standing in your Q
All you need to realize that we are waiting in the queue as our queue have more people than the allocated visas. If USCIS can start vetting fake candidates and remove from the queue, the queue would move faster.

All,
The only solution(not H.R. 392) for all the problems is as below: Think why we are all in this mess,GC backlog and now worrying about H1 extentions.
The answer is simple, indian IT companies sponsoring EB1Cs. Otherwise, the PD could have been at 2013/2014.
No matter how many desi consulting companies have filed H1s and GCs,all of us could have been at a better place.
From 2012 around 70 K EB1C visas were issued,which could have been spilled over to EB2 and EB3.
If that spill over before 2012 was not there,probably 2007 fiasco EB2 people could have been waiting for GCs like us.

Report EB1C abuse here..This is our only hope..
Even if you get the slightest of a doubt,that any WITCHs are applying for green card:
