Thanks. I have signed the petition and this is a good initiative. I have seen similar kind of traction for the H4 EAD rule and finally got it approved in May 2015.

Even if we apply in premium couple of months before , there would not be sufficient time for applying H4 EAD and it getting approved. Unlike H1 we can't work on H4 EAD extension.



I just looked at the H4 EAD renewal tracker and seems like few got H4 EAD approved in 10 Days, when H1+H4 extn+H4 EAD was filed on PP and concurrent. These may be a best case scenarios. For your case it is going to be an upgrade of PP before 2 months, then better to apply for H4 EAD 120 days and hope for the best that everything (H1, H4 and H4EAD) gets approved within a month from upgrade.
So the other cases I saw in the tracker similar to your case H1&H4 extn filed at same time and H4 EAD applied 120 days before expiry date and got the H4EAD approved in less than 2 months.
Check the H4 EAD tracker and read the notes to better understand these scenarios.

I have 140 approved and my wife is working on H4 EAD. I have my H1 renewal in Jan month. Does CTS apply H4-EAD concurrently with H1,H4 extension? When I mailed GSD, they told you have to do it yourself. when H1 exn takes 7-8 months how come we make sure H4 EAD is submitted along with H1 exn?



H4 EAD renewal need to be applied separately by your wife before 120 days of the EAD expiry. You may need to get an approval from your Manager for upgrade to priority processing couple months before the H1 expiry day.

Hi, Has anyone received RFE email from GIT team who got their RFE around March 8th. I raised GSD and getting default reply. Any idea how long they will take to reply. Is it good to upgrade to premium processing now? If so with what reason I can ask my directors? My H1B expiring on Jan 2017 only but I need I-140 for H4 EAD.

I have my RFE updated in the USCIS website on March 2nd. Raised GSD and got the default reply and no case manage or update in my visa.From this thread I could see the RFE response is taking close to 75 to 80 days. Just few weeks/ days before the deadline. I don't think now an upgrade will help. Are you maxing out in Jan 2017 or just extension? If you are maxing out and you already have 7th year extension filed under AC21 ( based on PERM applied before 365 days) then you can apply for H4 EAD and don't need an i140 approval for that. If you are not close to max out then you need i140 for H4 EAD.

, I have a good friend of mine who got close to 120k at M level an year back.


There is no APM role to my knowledge now. It was gone way back around 2012. What skill set matters on the pay. If your friend has some niche skills and based on the urgency to get a resource they go a fix the pay. The city also matters. So where did you friend join and for what skill set ?

Yes. Mine max out is oft 2016; 140 is in NOID. So upgraded my H1B to prem to get the approval before I140 decision to avoid risk as suggested by GIT.


Hi GCUSAGC, did you mean your max out is OCT 2016? Then how did you apply for H1B extension now as it is allowed 6 months before only which is possible by April 2016. Or even thought your max out is oct 2016, your last h1 expired recently in Jan/ Feb ? I am on my 7th year of H1 which is expiring in end of Nov 2016 and last week got RFE on my I 140. So the RFE response is going to take another 2.5 months ( may mid) and anther month or 2 for a decision, so trying to see if I need to wait for a decision and apply for extension or raise it earlier and upgrade the H1 to premium as you did. Thanks in advance for your reply.

I have been waiting for the approval, but got the test message yesterday saying something changed. Checked the status and disappointed to see the RFE as below. Now few more months of wait and the hassle of follow ups and gsd request..Oh GOD!!

I saw couple of other folks who are unlucky like me got the RFE. Please help me to set some expectation when our folks will respond to RFE ( approx days) I am on the 7th year of H1 now expy in Nov 2016. Trying to see if I can push to send response to RFE faster so I can get a decision on I-140 and then file the extension.

Mine was also filed on 9/24 and waiting to hear the Good News, getting agitated day by day with the delay. Used to check few cases above and below my case id and seems most of them have decision approved. Mine is Texas SC with case starting with SRC1690003***. As per USClS website processing time Advanced degree or exceptional ability (EB2) and Skilled worker or professional (EB3) is August 26, 2015. So i think it is worth the wait.

Anyone filed I-140 on Sep 24 2015 with Texas center and waiting? I see that (From USCIS website random check) few of the serial number close to mine got approved recently last week and last friday. Getting nervous, keeping the fingers crossed and waiting with patience to hope for the best. My details are available in the tracker and seeing approvals close to my numbers in the tracker too.

Me too in the same boat as many others here. perm expy 9/28, no case manager assigned yet. pre processing documents requested by S in towards last week of Aug. Mailed back checking for case M last week and no response back. Last Friday saw in digital docs some new person M M accessed few of my docs. hoping for the best to have a case manger assignment and i140 processing before expy. All others in my account either have their 140 filed or have a case manager.

To those who are local in Dallas / phoenix have the opportunity to use FedEx same day same city service for close to $12/13. Check themail FedEx website. Th3 package will be delivered in couple hours. I used this service but there is no tracking and need to call FedEx to know delivery.

I sent mine to Lewisville on May 26 via fed ex same day same city. I did not had a tracking number from FedEx and they said no tracking for same day and it will be delivered by evening. Called back fedex that night and got a conficonfirmconfirmation that the package was delivered. I had a chase money order attached. I have not received a text or email. Calling the bank to see if my money order is cleared. Will keep you posted.

Good luck to all to get the EAD faster for those already filed and in the process of filing.

I have a situation and need some advise. Please help if anyone of you can give some inputs/suggestions.
I plan to apply for the EAD for my spouse under AC21. My PERM was certified/approved in mid of April and my company is in the process of filing I 140. Normally my company takes 60 to 90 days to file I 140 after PERM approvals. So now I cannot go for AC21 (b) as my my I 140 is not yet filed. So my question in can I still file under AC21 (a) ?. Thanks in advance for your valuable inputs.

4/1 - PERM Approved
4/10 - Email received to update address and fill questionnaire
4/111 - Completed address updates filled the questionnaire.

Some notes on my findings
I found the Scanned PERM approval notice from Dol under digital docs in the PERM section of internal site.
This scanned copy has a stamp on one side says 04/8, so assuming this is the date either our team received or DOL send it.
So after receiving this approval they trigger emails.

I have my PERM approved on 4/1, as per the https://icert.doleta.gov website I saw my case number was Certified on 4/2. I received the email from GIT on to 4/9 evening to update the questionnaire and address confirmation. I completed the necessary actions from my end and informed GIT back and waiting now to receive the original form 9089 to sign and send it back.
