Topic: I-94 related question

Is that true for H1B amendments as well? I thought only H1B extension will be considered.

Topic: I-94 related question

I have a question regarding my extension of stay based on I-94: Below are my details:

I797 valid till Aug'2018
Visa valid till Aug'2018
I94 valid till Nov'2017 (because my passport expires by Nov'2017)

I was with Client A in Work Location A. Because of change of project, i had to move to Client B in Work Location B. My employer filed H1B Amendment. After working for 6 months my previous client asked to come back so i moved to same Client A in Work location A. My empoyer said H1B amendment is not required because you are moving to the same location and we have a LCA for that.

Now my H1B amendment is approved with I94 specified as Aug'2018 as in my original petition.
Can i use the new I94 to stay in US till Aug'2018?
or is my stay valid only till Nov'2017?

Thanks

Topic: H1B Amendment Process

Hello All,

My employer filed my H1-B amendment on july' 2016 and it is still pending. In the meantime, I need to move to different location and my employer will file my 2nd amendment. Here the 1st amendment is still pending.

I know if the H1B amendment is not approved with-in 240 days, then I am not allowed to work officially. So my question is,:

1) If my employer files my 2nd amendments, will my 1st amendment goes in-valid and the counts gets reset to 1 again?
2) While 2nd amendment is still pending, and if 1st amendment goes beyond 240 days, am I NOT supposed to work though my 2nd amendment is still pending?

Thanks

One last question:

Can I renew H4 EAD using the approved I-140 from Employer A and H1-B petition from Employer B? Or to renew H4 EAD, I should only submit current employer I-140 and H1-Petition?

Topic: Employer Change on 6th year with I 140 approved

Hello All,

I am into my 6th year with Employer A with I-140 Approved. It was approved on Oct'2015. And I will be maxing out by April 2017.
However, Employer A filed my H1B Extension and got approved for 3 more years by using approved I-140. My current H1B petition is valid till August'2018 with Employer A. I was given an offer from Employer B. And I have the following questions:

1) Can Employer B file H1-transfer based on Employer A's I-140?
2) Can Employer B file H1-transfer based on Employer A's existing petition?
3) Since I am into 6th year (365 days), even if my H1B transfer is complete and they file my PERM and not approved, should I move out of US?

On a average, how many days does it take to get the H4 EAD approval? My wife will be travelling to India for couple of months. Should she be here at the time of approval?

She was here physically in US at the time of applying for H4 EAD though.

I submitted all the necessary documents to USCIS (Texas) branch and I saw they received it on 2nd Dec 2015.
I see my check for $380 was cashed on 07th Dec 2015. However, I haven't received the Receipt Notice yet.
Usually how many days do they take to send the receipt notice.
