Topic: CONSULAR PROCESSING LET US Gather here.

Hi everyone,
My case was completed by NVC on Jun 19th 2017 but so far there is no interview scheduled. Originally I thought it was because my status was not current but NVC confirmed it was current when I called two weeks ago. NVC won't tell me what the holdup is and kept telling me that there is no timeframe for scheduling the interview. I also tried to contact the local interview office but they sent me back to NVC. Has anyone experienced this long period of wait for the interview to be scheduled?

The lawyer is from Fragomen not an internal one.

According to USCIS's website, it takes 67 days to process a FOIA request. Sometimes I wonder if USCIS lives in another planet where people get to live 1000 years or something.

It does have a way to track the document's whereabouts. I found it on USCIS's website (you can check it out from below link) but my company's immigration lawyer dismissed it and asked me not to believe what I found on USCIS's website.
I called USCIS two weeks ago to try to track the package myself but they refused to talk to me and told me they only shared info with the lawyer.

Mine was approved on March 15 but so far there is no sight of the original approval notice. It is pushing 30 days at this point. The lawyer said USCIS is delaying sending out paper due to the uptick VISA volume. I still feel like I am the only person stuck in traffic because I didn't really see anyone has any discussions on this subject.

I feel the same way too, humanity123. It has been a very frustrating experience dealing with anyone from that renowned immigration law firm. They are not transparent at all. Most of the time I am kept under the dark and often time am giving half-assed answer when asking the progress.

Thank you so much for your feedback, humanity123! I didn't know the lawyer could request USCIS to send another copy of original approval notice after 30 days.
I found out from USCIS's website that the lawyer could call to request a tracking number about two weeks ago but when I shared the info with the lawyer, he was offended and argued that he had never heard of such service and asked me not to believe what I read on USCIS's website. I wonder what he would say when I ask him to request USCIS to send another copy of original approval notice. Can't wait!

No one experiences delays like I do? It's been more than 3 full weeks for me. I am beginning to think it might get lost in the mail or USCIS hasn't mailed it even though it did say it was mailed on March 15th.

My cases was approved under premium processing on March 15 and the approved document was also mailed out the same day, according to USCIS status update website. But the company lawyer told me he hasn't received the approved document from USCIS. Has anyone also experienced delay on your side?

Hi Dkvijayan,
You probably need to follow up with your company's lawyer and make them call USCIS to check on your case.
What happened to me last year was that my case was submitted with premium process early September last year but after two weeks, there was no update from the lawyer so I sent them an email about it. Upon receiving my email, they started investigating and found out that USCIS hadn't cashed the check (it's about 3 weeks after submitting the application at this point). Two weeks or so later the entire package was sent back from USCIS citing "one page is missing". Because of that I have been stuck outside of the US and unable to return. When I left the US, I was told I'd be back in less than a month. They totally botched my case and gave little damn about it. I hope this won't happen to you. Best of luck!

How long did it take for you to receive the approved I-797?
My case was submitted with premium processing on March 7 (Nebraska service center) and it was subsequently approved on March 15. From USCIS's update on the website, the document was also mailed on the same day but so far, almost two weeks have pasted, there is no sight of the document.

This post is for the people out there who got the same "my document was mailed to me" update on USCIS's website. I saw a lot of posts online from people who received the same status update but not many of them provided a follow up update after the initial post.

2 days after seeing "My Document was mailed to me" my case status was updated to "Case Was Approved" today!
Best luck to everyone out there who also got the same status update! The approval is coming your way so chin up!

My status changed from case received to " my document was mailed to me" on USCIS's website.
My previous H1B extensions (I did a lot of recapture trips in the past two years for the green card process) all had "case approved" in the subject line so I am very confused about this one. Has anyone had similar experience? What document did you end up receiving from USCIS?

My pursue of green card journey is pretty bumpy so far which is I am very worried that I would be stuck in this status for a long extended period of time. Plus the uncertainty that could come with the newly elected president doesn't help either..

Hey guys,
How long does it take for you from submitting I-824 to receive approval? Could you please share the info with new?

My company is transferring my case from AOS to CP and it has been almost a month since I-824 was submitted. I read a lot of posts online and some people said it took them more than one year to get an approved I-824 to move on to paying fee and submitting supporting documents steps.

USCIS returned the package last week citing one missing page from the package but the law firm insisted they had all the pages when filed. I am waiting for HR to check with them to see if it can be appealed but I am guessing that the chance is very slim given the fact that I am no longer eligible for a H1B since my priority date is now current..

Company's attorney has plan B and is currently preparing to transfer my case to consular processing because the earliest date that they can refile a H1-B extension for me is the end of Feb 2107 which is when my PERM filing hits one year mark.

I was told it could take about two months to transfer AOS to Consular Processing (my online research told a much different story and it is ranging from 4 to 12 months to transfer).
I guess I have to play this waiting game like most of the people out there.. :(

I shared your story with the immigration lawyer last week and I was told that they did call USCIS about it but unlike a more cooperative USCIS that your lawyer encountered, the person who answered the call this time told her that she would have to wait it out.

I am a weirdest situation and it even sounds made up to me. If anyone has any input about this, I am more than happy to hear.
My I-140 was mailed on Aug 30th 2016 (premium processing) but last day of my H1B VISA was on Sep 16 2016. So immigration lawyer for my company recommended that I leave the US on Sep 14th and told me to book a return flight one month later because they estimated that within one month time frame, they should be able to use the approved I-140 to file and get the approved 3-year H1-B extension for me to get back to the US.
Back in Sep, the VISA's category I belong to was retrograded but starting in Oct, it is back to current.

My I-140 was approved on Sep 14th as expected so H1-B extension was filed (or so they told me) on Sep 16th.
2 weeks later on Sep 28th I followed up with the lawyer to see if everything was on track and the answer I got was that they didn't know what happened to the case because they hadn't got any feedback from USCIS even though the case was delivered on Sep 16th, no receipt number provided and no response from USCIS.
So now I am perpetually stuck outside of the US and the only way for me to return back to the US is that my green card application is transferred to my home country and get processed and approved.

The lawyer's guess is that since USCIS hasn't cashed the check, they either are in the process of denying my extension application because I am no longer eligible to get the extension now or they still haven't "received" my case because the potential, and I quote, "chaotic situation" in the mailroom that causes my case to be lost in the shuffle.

I am not sure what to think of this situation. I am hoping that USCIS will find my case and approve the extension in the next few days so I can return back to the US.
The situation is so far-fetched, I am suspecting that there are other reasons at play that the immigration lawyer doesn't want to share with me so he made up this wild story.
Has anyone ever experienced a situation like this before?
Thoughts?
