Topic: H1b Transfer Denied

Did you get an approval though? I am leaving on my attorney to come up with a strong strategy. I am hopeful that they will do everything to prove it.

I am not sure of the details. All I know they din't believe it requires even a bachelors degree to perform these job duties. Myn company is reapplying for the visa and putting a stronger case together. I hope you get through !

Hi thanks for the recommendations. I will let my new attorney know all these suggestions. I am sure she is experienced. I am just shocked to know that my occupation title and my education completely match and still the officer denied it. I hope to update the approval soon on the same thread.

Agree. My company has changed the attorney and they are reapplying. I am hopeful that I will get an approval now. I find it hard to believe that they did not believe it doesn't require bachelors degree to perform my job duties.

Thank you so much for being so helpful. I am just frustrated with this denial.

Would I need educational evaluation in-spite of having a US degree?

Yes, I do have my LCA. My attorney is convinced that the officer did not want to approve my case what so ever. They did provide evidence of other company requirements for the same job title. I only want to know if there is any success story of refilling from the same employer here. It is absurd to have been denied ! I literally have prior approval for the same EXACT job tittle !

I just found this

I did get an RFE and RFE was based on specialty occupation. Reason for denial too was that they think its not a specialty occupation. I don't have much details, but the attorney kept saying the job is not listed in DOL and hence it has been rejected. I have an Msc in Regulatory affairs and my role is Regulatory Affairs Specialist in a medical device company.

Topic: H1b Transfer Denied

My H1b transfer has been denied in-spite of holding a Msc in the same field as my job. I have had two prior approvals based on the same job title and in the same industry. My company is reapplying for the same. Any similar story and any idea of the chances of approval?

I am hopeful that mine comes sooner. Few of the recent RFEs that I have heard of got approval within a month :o

OMG ! If you don't mind me asking when was your RFE issued and reason?

Mine is the specialty occupation. They wanted proof , if a bachelors was needed for my position.

Topic: RFE Approval Time

Hi ,

My H1b transfer was applied in CSC in July and received an RFE in October. My company responded to the RFE in the first week of November. How much time does CSC take to respond to an RFE and give an approval?

In what order are cases approved? The numbers above and below me are approved. Is this a sign that my case must have been reviewed too?
