Topic: H4 EAD Revocation rule

The only way to defend this rule is to wait till it is published for commenting. Once published, we as a group need to file a lawsuit on the merit of this change. Government doesn't have a real proof that it is hurting American workers (so called Buy American, Hire American agenda).

I can understand that you are worried about the security of your employment. Do you want to continue in H1B for rest of your life?

This forum is full of IV opportunists now. They want to mint some easy money simple..

You guys claim yourselves High Skilled Labor and still worried about these things. Only Illegals and fraudsters should be worried (at least at this point). Do you really think with India's current position in World Economy it is feasible to revoke all existing H-1Bs? Where is your head?

The worst can happen is some additional scrutiny, which I support too, for new H-1Bs / Renewal. Revoking H4 EAD will not be easy as well.

Let Mr. Trump utter the word "Removal of H4 EAD" first. Practically the chances are very slim (may be 1%). Let's not make this a topic of discussion unnecessarily.

Okay guys...Let's not create the buzz all around that H4 EAD rule will be reversed. There is no such thing said by Mr. Trump during his election campaign or even now. He is always only against the illegal immigrants.

Why do we need to discuss this over all different places and make it a topic unnecessarily? Let's wait and watch, and please don't spread any negative words around H4 EAD rule. This simply doesn't make any sense.

How long is it taking now from Petition Approval to Card Production? Spouse's H4 EAD Renewal petition got approved on 11/04 (took only 18 days - impressive). We just received the Approval Notice yesterday in mail. However, the status haven't changed to CARD PRODUCTION ORDERED so far. Should I contact USCIS?

In my opinion, nothing will get changed drastically. Fraudulent desi consultancies will be impacted to some extent in terms of scrutiny and all for PERM / new H-1B / H-1B Renewal. The big body shoppers will not be impacted much as they mostly follow all the rules. They might get impacted financially if rules like minimum $100k salary for H-1B etc. get passed. Otherwise, there is not much impact.

People are crying over EB1C abuse, but they have to understand that it is a provision under the the current system. It will continue until there is a big change in the law. Moreover, most of the big body shoppers have anyway stringent their criteria around EB1C already. They are now only sponsoring EB1C for handful of senior resources.

Let's hope we have I140 portability in place if not I140 EAD. If Trump proposes higher salary for all H-1B resources, I hope all of us will get benefited to some extent as well. Less skilled folks will be sent back home anyway in such situation as companies will not pay higher salary for them.

It doesn't matter whatever forum / law-firm you follow or associated with but we as a community should post these kind of comments throughout the REVIEW period. If they get 20k comments like this then something may change.

I would really request all the members here to post this comment in whatever forums (Immigration Voice, Immigration Girl, OH Law Firm, Murthy Law Firm, Skilled Immigrants of America etc. etc.) you are associated with. All of you have my legal approval without any "Compelling Circumstances"...LOL. On a serious note, please go ahead and post this wherever you can. Thank You..!!

This is a flop show from USCIS. This is no way going to provide reliefs to the legal immigrants waiting for years in the EB queue.

Here are the points I am going to write once the public review period starts -

1. USCIS should allow to apply EAD once an immigrant passes 180 days after I140 approval showing THE "Compelling Circumstance" that EB visas are not available for his / her country. The person should be able to renew the EAD card based on the same "Compelling Circumstance" without any other restrictions. That's what will provide reliefs to the immigrants.

2. USCIS should also allow to use approved I-140 petition to apply I-485 whenever PD becomes current for an individual. The clause to restart the PERM / I-140 process again after changing jobs will no way provide any sort of relief.

Please try to comment in the same line if you are equally frustrated.
