either way we get a decision .... my only hope is that we are lucky enough to get the 50k visas allocated to the EB categories in the deal that is reached ....



Rather than looking to welcome the 50K from lottery we need to worry about where will they bring the 800K to give out to DACA recipients.

This is exactly what I said. Legal immigration will be curtailed by the DACA bill. Not just the diversity lottery only. It is all over in the news, for those who read beyond the headlines.

Expect parts of AC21 to be repealed by the DACA bill. It's going to be a comprehensive immigration bill and far reaching like the tax bill.



At least someone talking sense here (compared to folks who are crazily following IV).

The 800K from DACA will be adjusted by reduction in legal immi. So much so for HR 392 to allow 1.5 million backlogged legal EB immigrants to fast track to GC !!!!!!!

The fact that IV is posting specifically to address issues raised by folks who IV calls "trolls", it is clear that this defensive stance is just trying to cover their own deed. No sensible non-profit org that is really focused on solving problems would care to address the "theorist".

Very interestingly, any comment that does not thank them is deleted !!!! If you see a note "Top Comments is selected, so some comments may have been filtered out." ......... just means they have messed around with the comments ........ mind you none of the deleted comments were abusive but just don't agree with IV or thanked them ...... so much so for the First Amendment.

Any relief to H1b holders waiting for Green card will anger Republican base and may cost votes. On the other hand, solving the issue will not result in any substantial gain for Democrats. At the end of the day, both political parties will not gain anything by solving this backlog problem.






Agree.

There should be no expectation of a major clean up on the backlog. None of the industry groups would support it either.

I think it is important to understand that there is no reason for anyone to do anything about the backlog. Back logged folks are paying taxes, H1B renewal fees for over a decade ..... why would anyone want to stop the gravy train ?

You read it here first ...... probably in the following order:

(1) Minimum H1B salaries will be raised to at least $100k,
(2) Post 6th year extensions will continue to get tough and we will see more and more 1 year extensions rather than the 3 yr extensions, and
(3) 3rd Jan 2019 will be the last day of HR 392 and it will end with the 115th Congress

Raising the min H1B salary will automatically take care of the GC backlog and the proposal of $1k under HR 392 wouldn't make much sense when annual H1B renewals will result in much more revenue.

They are a bunch of morons. Even now all USCIS is saying is that they were never considering such a policy change and that “any suggestion that USCIS changed its position because of pressure is absolutely false.”

Told y'all that Aman is going to be next DHS head. That is why he is receiving special updates from DHS .... lol

IV created the chaos and handled the situation themselves. More aptly, they gave themselves a hard-on and sucked their own .... ;)

It is about fairness and not about me being Indian and siding with what is good for Indians. It will screw up an already screwed system of H1B. HR 392 will make it worse for H1B lottery. However, agree since H1B is restricted to 85k, backlog will never be an issue with 392.

Again, the real problem is the H1B program. Managing it will solve more than half of the program.

I have been saying it for a while ...... everyone needs to worry about the 100K min salary .... that will sneak into the deal and become reality much quicker.

(Just helping you not make an ass of yourself in real life also ...... it is Jeez and not Ji)

What are you ranting man? The 15% is reserved for ROW. The 85% will be based on PD ie - first come first served. YES Indians would get most of it because we are soooooo fkn backlogged.

When slavery was abolished some slave masters took a hit. That doesn’t mean leveling he play No field is not the right move.



No one country can use more than 85% during transition period ... hence, you would expect 119k Indians will file ..... not most but all (too complicated ?) ...... leaving only 21k for ROW (so we will start backlogging them). I do understand that HR 392 is trying to clear the backlog .... once cleared, there will never be none since u got 140k EB GCs and only 85k H1B each year.

P.S - u could try to be little bit sensible and not bark here on ppl who do not share your POV :) ........ I understand I am asking too much.

(1) I am with you that they have done good ... but blame others for all wrong in the world.

(2) Screwing H1B out of $$$ ...... no issues.

(3) I point was that HR 392 is in primarily #IndiaFirst ..... brings Indian backlog forward and retrogresses ROW ....... until the backlog is completed cleared. Lets says for a second that HR 392 is passed today in its current form. When 140K EB visa numbers open on 1st Oct 2018, 85% will be taken by Indians (transition phase). Balance 15% is left for the ROW. (Thank god to the 85% limit) .. think if there was no 85% limit ........ on 1st Oct 2018, 100% would have been taken by Indian and ROW will not have any numbers until 1st Oct 2019, when again backlogged Indians would apply. (trust me brother, I would love that ..... being here long time). I could be wrong and open to your views and respectful discussion :) I agree EB is not to maintain demographic.

IV is feeding off the vulnerable folks who are stuck in backlog. Again, "if" 392 makes its way into DACA deals, what goes in and what comes out will be VERY different.

Outrageous ideas like "unionization" is not what capitalism is about. Collective bargaining rights do not exists in a capitalistic society.

IMO, people getting suckered into the BS being sold by IV probably desire it. Everyone is an adult and suppose to be "skilled". Whoever thinks are screwing every single country in the world to reduce Indian backlog - what a selfless idea .... #IndiaFirst !

All they need to do is push up the min salary to $100K for an average location in the US. Places like SF, NY higher ($150k)and a small town in Alabama probably lower ($80k).Hence, no standard H1b salary to account for local cost of living and salaries.

We (me included) could be in this country for 20 years and still not "demand" a GC. Residency is a privilege and not a right.

IV has lost its mind. Suggesting work stoppage and unionization .... LOL. It will definitely solve the backlog since these workers will be laid off and out of status. Asking ppl on non-immigrant visa to unionize ... awesome idea.

Interestingly, they have not been saying anything about HR 170 .... Plus, why should DHS worry about $1k per applicant when they can scrap 3 yr extension and replace it by 1 yr extensions and push up the revenue 3 times for lord knows how long ...... Imagine the $$$$$$ that will bring in for the wall.

Stupid AK said this - "State Dept will probably have to maintain two separate VB, the current VB and the new Visa Bulletin after this bill."

Sounds like the President is about to appoint AK as DHS head ;)

All that will take weeks/months. Curious when you are in the middle of such an important process why would you not update your address with USCIS. Every I-797 says to keep your address updated.

This is going to force employers to re-evaluate their strategy. Spend on H1B extension once in 3 years and 3 times in 3 years. We are talking about serious money once you include the lawyers fee .... plus if the minimum H1B salary goes to $100K ??? You got the point.

Agree.

All this is coming from one source - IV. Not saying it is false but this sense of chaos is being created by them. McClatchy and Hindustan times are both from IV.

This BS about mass deportation is all coming from the leader of IV. If you listen to his conference call, you can see the fear mongering. Try questioning him on his FB group ... he will say something stupid and then block you. Then his followers will ask you to reply and why have you now run away .... probably without realizing that you have been blocked from posting.

Hopefully no one will bash me for agreeing with you :)

HR 170 has got NASSCOM's attention. They believe that 170 has a stronger chance of getting passed in an amended state. Pushing min salary to $100K will clean up a lot of the BS and to a great extend take care of the backlog. Of course, if I make leas than the minimum proposed salary in HR 170, my best bet is "hoping" HR 392 passes. Of course, just the way it does not cost to call senator (I agree with EB24life here), it does not cost anything to hope.
